ACTION: Authorize the Chair of the Task Force to advise The Irvine Company
to proceed with development of senior affordable housing on the
Lower Bayview Landing site.
After holding study sessions to discuss Newport Beach's need for affordable housing and
opportunities to meet that need, the City Council appointed Councilmembers Debay (Chair),
Adams and Ridgeway to an Affordable Housing Task Force on March 14, 2000.
In their deliberations so far, the task force has concluded that affordable housing for the City's
senior citizens is our most pressing need. They also believe that it is time for The Irvine
Company (TIC) to develop the affordable housing required by the General Plan Housing
Element in conjunction with the development of over 850 units of market rate housing pursuant
to the Circulation and Open Space Agreement ( CIOSA). The task force looked at potential sites
where TIC might develop senior affordable housing, and concluded that Lower Bayview
Landing is the most likely site on which a project can be developed without significant delay.
This site has a General Plan designation of Retail and Service Commercial. Affordable senior
housing is allowed as an alternate use, if the Coastal Development Permit findings demonstrate
that adequate visitor serving uses exist in the Newport Beach coastal zone. The General Plan
does not limit the number of units allowed, but the Planned Community zoning allows 120 units
of senior housing. The City could set TIC's affordable housing requirement for CIOSA at 15%
of total market rate units developed (129 affordable units), or 20% of total market rate units
developed (172 affordable units). Previous studies of the site suggested that 120 to 240 units are
feasible, and it may be possible to amend the Planned Community to increase the number of
units allowed. This would enable The Irvine Company to meet its CIOSA obligation fully with
one project.
The Irvine Company has indicated it is waiting to hear if the City desires this project to go
forward. Therefore, the task force is asking the City Council to approve the attached letter
expressing that desire, and authorize Councilmember Debay to sign and send it.
The task force is continuing to work on ways to use in -lieu fees paid to the City by Ford and
other market rate housing developers. Parties who are interested in developing senior affordable
housing have contacted task force members and staff to discuss sites and development concepts.
Staff is beginning work on a request for proposals that will give the City Council the opportunity
to review all the proposals in one process.

Dear Mr. Hunt:
The City Council has discussed the need for Newport Beach to demonstrate progress on
implementing the Housing Element of our General Plan at study sessions over the past
year. An issue that has been part of every discussion is The Irvine Company's obligation
to provide affordable housing in conjunction with the Company's development of over
850 units of market rate housing pursuant to the Circulation and Open Space Agreement
( CIOSA). At the Council's request, City and Irvine Company staff have met to explore
options for the Company to meet this obligation. Despite sincere efforts from both
parties, not many viable options have been identified, and we always seem to come back
to Lower Bayview Landing. At our study session on affordable housing in April 1999,
Carol Hoffman stated that The Irvine Company was waiting to hear from the City if you
should proceed on this site.
In March 2000, the Council established an Affordable Housing Task Force, on which
Gary Adams and Tod Ridgeway serve with me. Our duties include identifying,
evaluating and implementing one or more affordable housing projects to satisfy
community needs and achieve regional housing goals. The task force has concluded that
our greatest community need at this time is for senior housing, and we need to make it
affordable to low income seniors to satisfy both community and regional needs. The task
force also has reviewed potential sites for a senior project, and confirmed our two staffs'
conclusion that there are not many options in our built -out community.
The recommendation from the task force, which the City Council approved on September
12, 2000, is to advise The Irvine Company that you should proceed with plans to develop
a senior affordable housing project on the Lower Bayview Landing site. The Council
believes it is in the best interest of both the City and The Irvine Company to resolve this
outstanding CIOSA issue. Furthermore, it is in the best interest of the community to
provide for the growing need for housing that is affordable to our senior citizens.
The entire City Council looks forward to seeing this project move forward. Our primary
staff contact will be Assistant City Manager Sharon Wood, and she will be in contact
with your staff very soon.
