Subject: For the Public Record re. Group Residential drug /alcohol rehab uses
TO THE CITY COUNCIL AND CITY MANAGER - -I am just out of surgery and unable to attend
tonight's City Council Session.
Many residents have asked that I relay comment on the above - referenced issue.
I am writing to support the recent report regarding Operator CRC /aka Sober Living By the Sea.
The approval of this and other operators ,through the City's administrative process,
ratified by resident's comments, is a clear indication that the City, and its residents at large,
are supportive of well- supervised Operators of this type of Use.
It should be noted for purposes of this and other matters relating to "Group Residential"
business uses, that
The Residents at large have been supportive of this type of Use , and ONLY objected when:
1. The City exercised no regulation of these Uses prior to the 2008 -05 ordinance(despite
regulation of other group residential businesses)
2. Due to non- regulation,These Uses became Over - concentrated in our dense residential
neighborhoods, particularly in the Penninsula /West Newport "zone "(this zone, per
City's own inspection went from 5 known drug & Alcohol residential care uses in late
2003 to over 112 reported in 2007, 80% of which located in this zone)
3. There were Operators that claimed to provide care and treatment, but did not /were
not licensed to do so— putting the public health and safety(and their clients) at risk
4. The character and integrity of the family neighborhood in Penninsula /West Newport
zone was adversely impacted by this Overconcentration
The Uses in our community subject to Residents' objection cater to clientele from all over the
country and world, and are not simply here to administer professional supervision and
treatment. The proliferation of these businesses in Newport Beach's residential
neighborhoods is not in direct response to" local need ".
One must wonder why all group rresidential rehab businesses operating in Newport Beach
did not join those operators who have chosen to file legal claims against the City --
As has always been the case, the Residents of this community are only seeking Reasonable
Regulation and Relief.
Local government is the only jurisdictional level in the position to practically regulate Land
Uses, Nuisances, and Business Operations.
And observe and take action when there are business practices jeopardizing public health and
safety.
We appreciate the protections that Individuals are granted, per current Federal law. The
regulation of these Businesses
Is important for the city, its residents, and individuals who are seeking responsible care and
treatment .
