RE: AMENDMENTS TO MUNICIPAL CODE
SECTION 12.56 — BICYCLES - REGISTRATION
AND REGULATIONS
In response to increased complaints, we are suggesting amendments to Municipal
Code, Section 12.56, which regulates bicycles, pedicabs (tricycles), and surrey cycles.
We have
(1) Added findings which set forth the basis for the proposed amendments;
(2) Redefined bicycle to be more inclusive by adding a maximum width;
(3) Added the term cycle and defined it to include pedicabs and surrey cycles;
(4) Prohibited pedicabs and surrey cycles on public property from Coast
Highway to the Ocean which is where these problems currently exist.
The Public Works and Police Departments have approved the proposed amendments.
RECOMMENDATION:
It is recommended that the City Council approve Ordinance 2000 -_,
amendments to Chapter 12.56, and pass to second reading.

ORDINANCE NO. 2000 -
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AMENDING THE PROVISIONS OF
CHAPTER 12.56 OF THE NEWPORT BEACH MUNICIPAL CODE,
PERTAINING TO THE OPERATION OF BICYCLES ON STREETS
AND SIDEWALKS
The City Council of the City of Newport Beach does hereby ordain as follows:
SECTION 1
The City Council finds and declares as follows:
A. The streets, sidewalks and pedestrian ways in the area commonly known
as the Balboa Peninsula are heavily congested with people in vehicles, on foot or on
devices such as bicycles, roller skates and scooters.
B. Many of the streets, sidewalks and pedestrian ways on the Balboa
Peninsula are relatively narrow and cannot adequately accommodate human powered
devices with multiple wheels and widths greater than a bicycle.
C. The combination of heavy congestion on, and the relatively narrow widths
of, the sidewalks, boardwalks and pedestrian ways of the Balboa Peninsula creates a
risk of injury to the operator of multi - wheeled devices that are wider than bicycles as
well as other users.
SECTION 2
Section 12.56.010 of the Newport Beach Municipal Code is amended to read as
follows:
12.56.010 Definitions.
As used in this chapter, the following terms and words shall have the following
meanings:
A. The term 'Bicycle" means any device upon which a person may ride, is
human powered, has two wheels at least twelve (12) inches in diameter, a frame size of
at least fourteen (14) inches, and a maximum width of thirty -two (32) inches.
B. The term "Cycle" means any device that is human powered, has two or
more wheels, and does not meet the definition of 'Bicycle." The term "Cycle" includes,
but is not limited to a "Surrey Cycle" and a "Pedicab."
C. The term "Surrey Cycle" means any device with seating for one or more
persons, is human powered and has four, or more, wheels.
D. The term "Pedicab" means any device with seating for one or more
persons, is human powered and has three wheels.
SECTION 3
Section 12.56.030 is amend to read as follows:
12.56.030 Operation of Bicycles and Cycles on Sidewalks.
A. Prohibition. No person shall operate or ride a Bicycle or Cycle on any
public sidewalk in the City.
B. Exceptions. The provisions of this Section shall not apply to:
1. The operation of Bicycles on public sidewalks on which Bicycles
are permitted pursuant to a resolution adopted by the City Council;
2. A Bicycle or Cycle operated by a physically disabled person;
3. A Cycle that measures:
a. Eighteen (18) inches or less from ground level to the neck
joint,
b. Twenty -four (24) inches or less in width measured from the
outer rear wheels,
C. Eighteen (18) inches or less in front tire diameter, or
d. Twelve (12) inches or less in rear tire diameter.
4. A Bicycle operated by any peace officer employed by the City of
Newport Beach and acting within the course and scope of his or her
employment.
SECTION 4
Section 12.56.040 of the Newport Beach Municipal Code is amended to read as
follows:
12.56.040 Operation of Cycles.
Except as otherwise provided in Section 12.56.030, no person shall operate or
ride a Cycle on any public sidewalk, street, trail, boardwalk, public pier, public parking
lot or any other public property in the City that is south (oceanward) of Coast Highway.
SECTION 5
If any section, subsection, sentence, clause or phrase of this ordinance is, for
any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this ordinance. The City Council
hereby declares that it would have passed this ordinance, and each section, subsection,
clause or phrase hereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses and phrases be declared unconstitutional.
SECTION 6
The Mayor shall sign and the City Clerk shall attest to the passage of this
ordinance. The City Clerk shall cause the same to be published once in the official
newspaper of the City, and it shall be effective September 1, 2000.
SECTION 7
This Ordinance was introduced at a regular meeting of the City Council of the
City of Newport Beach, held on the _ day of , and adopted on the
