Subject: Budget Amendment to update the City's Hazardous Materials Area Plan
RECOMMENDATION
Approve a budget amendment of $10,000 from the General Fund balance for contract
services to update the City's Hazardous Materials Area Plan with $8,000 of the cost to
be reimbursed to the City by Hazardous Materials Emergency Planning (HMEP) Grant
approved by the Governor's Office of Emergency Services. The total cost to the City for
these services will be $2,000.
BACKGROUND
Each county in the state of California, and subsequently each local agency within each
county, is responsible to maintain a Hazardous Materials Area Plan which details risks
related to hazardous materials and defines plans to both prevent and respond to these
type of incidents. Further, State Law mandates that the plan be reviewed and updated
every three years.
The Newport Beach Fire Department, in cooperation with other countywide fire
departments and the Orange County Fire Authority, has just completed updating the
countywide plan. Each agency now has the responsibility to add local elements to the
plan that define each agency's hazards and roles at the local level. The City does not
currently have resources or expertise to complete this report and therefore will need to
contract for these services. The estimated cost for these services is $10,000.
Fortunately, in June 2000, the Governor's Office of Emergency Services made grant
funding available under the 2000/2001 HMEP Grant Application process. The City's
grant application was submitted and on September 15, 2000 was approved for the entire
project cost of $10,000 with the State reimbursing 75% of the cost totaling $8,000. The
City will be responsible for the remainder of the costs totaling $2,000.

In June 2000, consultant Marilee Hansen was contacted regarding the updating,
improvements, and implementation of the Hazardous Materials Area Plan. This
consultant is the same one who developed the Orange County Area Plan. The
consultant stated that the approximate cost for this project would be $10,000.00 and
utilizing her expertise will expedite the update and do so for a very reasonable cost.
On September 15, 2000, we received notification from the Governor's Office of
Emergency Services that our project had been approved for implementation. The State
Share grant amount is $8,000, requiring the recipient's match share to be $2,000.00.
It is, therefore, requested that the City Council approve this budget amendment to
cover the cost of this mandated project with 75% of the cost reimbursed by the State
upon completion.
FISCAL IMPACT
The funding of this project as part of the State Grant will reduce the actual cost of the
project by 75% saving the City a total of $8,000.

Revision Hazardous Materials Area Plan
Introduction
The Newport Beach Fire Department, as the Administering Agency for the city's hazardous materials
disclosure program, is soliciting for consultant services to revise their current Hazardous Materials Area
Plan. This plan is required by Title 19, Division 2, Chapter 4, Article 3. Additionally, Area Plans are required
to be updated and/or revised at least every three years. The Newport Beach Area Plan is overdue for
revision. Finally, since the Governor's Office of Emergency Services (DES) will be conducting program
audits in the near future, timely revision of the city's current Area Plan is advisable.
Proposal Summary
This proposal provides an overview of the process to be used to meet the objectives stated in the goal
below. It identifies specific deliverables. Built into this process is close coordination of the contractor with
identified city personnel.
Goal: Revise the City of Newport Beach's Hazardous Materials Area Plan to meet the requirements
stated in Title 19 of the California Code of Regulations using the Area Plan developed by the
Orange County Fire Authority as a model Area Plan.
Tasks to accomplish scope of work
1. Review and identify parts of the "model" Area Plan to be adapted for the City of Newport Beach.
2. Develop a hazard analysis specific to the City of Newport Beach's hazardous materials release,
spill, or accident threat.
3. Coordinate information with specific fire department staff to ensure accuracy of information.
4. Tailor information from the "model" Area Plan to the City of Newport Beach.
Scope of Work
Contractor will outline a schedule for completion of the project not to exceed four months.
However, this may be re- negotiated by either party at any time verbally or in writing.
It is the responsibility of the city to ensure management/administrative participation and cooperation
in this project. The city will also be responsible for all required public notices and advertising for
any public meetings, as well as provision of meetinglassembly site(s).
The city and contractor shall mutually agree to the length of time allotted for review and comment
by city staff shall be thirty days from the time of mailing. Should there be no comments submitted
within that time period the contractor shall consider that as city agreement with draft submitted and
proceed to finalize product.
2. The city will provide any maps, organizational charts, diagrams, grids, statistical information, etc.,
as required to complete this project.
The contractor will incorporate all available guidance and requirements as cited in the "model" Area
Plan and by the State of California, Governor's Office of Emergency Services. It is the city's
responsibility to coordinate and /or integrate planning efforts with the County of Orange, unless

specified to the contrary by contract.
4. The responsibility for a successful plan rests with the city. Future review, updates, exercises, and
any changes to meet evolving Federal, state, county, or city requirements are the responsibility of
the city.
5. Final product will consist of an appropriately tailored Hazardous Materials Area Plan and crosswalk
identifying legislative requirements of Title 19. Work product will be submitted to the city in a
mutually agreed upon word processing program. The city will receive one hard copy of all finalized
materials and a zip cartridge containing final materials.

IT IS FURTHER STIPULATED THAT ANY OPERATING EXPENSES INCURRED BY THE CITY, ITS
STAFF, OR THE CONTRACTOR IN PURSUIT OF THIS PROJECT IS THE RESPONSIBILITY OF THE
CITY.
These operating expense Include, but may not be limited to:
1. Printing
Printing and binding of drafts and final product, brochures, announcements, letters, memos,
business correspondence, etc. The city will be responsible for photocopying and/or duplication,
binding, and distribution of the draft(s) and the final product.
2. Postal Expenses
Any postage required for correspondence, packages, and notices.sent in accordance with this
proposal.
3. Communications
The contractor agrees to be available by telephone, fax, or email to coordinate issues with staff in
addition to two meetings included in the contract. See below for further information regarding
meeting availability.
4. Office supplies
Paper products, binding materials, and miscellaneous items for city staff use will be provided by the
city.
5. Additional services
Any work requested to be performed which is not contained in this proposal must be requested in
writing by the city to the contractor.

6. Meetings
Contractor agrees to two (2) meetings with appropriate city staff as part of the contracted services
without additional cost. However, additional meetings will be billed at a rate of $100.00 per hour
with $25.00 per hour travel time from contractor's home in Mira Mesa, California to the city of
Newport Beach City Hall at 3300 Newport Blvd., Newport Beach, California.
PROPRIETARY RIGHTS
The city agrees that the product of the contractor's work is for the sole internal use of the city of
Newport Beach. No reproduction of any part of the contractor's work product may be copied or
reproduced (hard copy or electronic media) without the express permission of the contractor other
than for internal city purposes.
