Subsequent to the publication and distribution of the subject Council reports for
November 25, 2014, Community Development staff provided the following comments on
the Environmental Review section of the referenced report:
Item 17— Request to Construct Private Improvements within the Public Alley Right -of-
Way located adjacent to 401 and 403 Heliotrope Avenue.
With respect to Heliotrope, the City Council should also find that project is exempt from
the California Environmental Quality Act ( "CEQA') pursuant to Section 15303 (as shown
in underline.)
Revised Environmental Review:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in a change to the environment, directly or indirectly. Also,
the proiect is exempt from the California Environmental Quality Act ( "CEQA ") pursuant
to Section 15303 (New Construction or Conversion of Small Structures) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because the proiect is
limited to the construction of a small retaining wall structure and driveway within an alley
as an appurtenant structure to an existing single family home.
Recommended Action
Staff recommends the above change to the Environmental Review section of the report
(shown in underlines) be accepted to clarify that City Council shall find the project is not
subject to the California Environmental Quality Act based on Sections 15060(c)(2),
15060(c)(3) and 15303.
