SUBJECT: Adoption of Resolution 2001 -_ relating to $80,000 Pumpout
Facility Improvement Grant from the California Department of
Boating and Waterways
RECOMMENDATION:
Adopt Resolution #2001- authorizing the City to apply for and receive a
pumpout station renovation grant of $80,000 from the California Department of
Boating and Waterways.
DISCUSSION:
In 1992, Congress passed a Clean Vessel Act to help reduce pollution from vessel
sewage discharge in the U.S. waters. The Act included a grant program to help
local agencies fund the construction, renovation, operation and maintenance of
pumpout and dump stations to service public craft.
In California, the Department of Boating and Waterways (DBW) is the State
Grant Coordinator. DBW's grants reimburse agencies up to 100% of the installed
cost of pumpout and /or dump stations. This includes the renovation of existing
equipment.
On March 28, 2000, the City adopted Resolution # 2000 -28 to approve a vessel
pumpout facility grant for Fernando Street station from the Department of
Boating and Waterways, totaling $36,000. Subsequent to that application, we
sought to add four additional pumpout stations that were in need of renovation
in our application to the State. As a result, the State has allowed us to increase
our grant by $80,000 for a total of $116,000. The grant will now include the cost
of installation of the new pumpout facility at Fernando Street, plus the
renovation of four public pumpout facilities at 15�h Street, Balboa Yacht Basin, the
Fun Zone and Lido Marina Village (see Attachment B).
In addition to the 100° reimbursement for purchasing and renovating the
pumpout stations, the State will also annually reimburse the City for 7570 of our
incurred parts and labor expenses for the maintenance of the pumpout facilities;
installed under the state grant.
The DBW requires the City Council to approve a Resolution authorizing the
City's participation in any grant. The Resolution is attached.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH REQUESTING A GRANT
IN THE AMOUNT OF $80,000 FROM THE
DEPARTMENT OF BOATING AND WATERWAYS
FOR DEVELOPMENT OF A BOAT PUMPOUT/DUMP
STATION FACILITY AT NEWPORT HARBOR.
WHEREAS, the City of Newport Beach seeks to improve and develop a boat
pumpout system in Newport Harbor that will meet the needs of the boaters by
providing public access to these facilities; and
WHEREAS, the California Department of Boating and Waterways is authorized
to provide grants to cities, counties, districts, and other public agencies for the
construction and development of boat pumpout/ dump station facilities; and
WHEREAS, the City of Newport Beach is willing to enter into an agreement to
provide for the operation and maintenance of the proposed facilities at no cost to the
State; now, therefore be it
RESOLVED, that the City Council by adoption of this resolution hereby states
the City's intent to request a California Department of Boating and Waterways Grant for
the purpose of improving and developing public use boat pumpouts in Newport
Harbor; and be it further
RESOLVED that the City agrees to accept the grant and hereby authorizes the
City Manager or his designee to sign the grant agreement and accept the grant for the
purpose stated above.
