INTRODUCTION
Development agreements have been used by the City Council to
mitigate the impacts of projects and to obtain public benefits that
substantially outweigh impacts. In the past, various staff and/or
Council members have participated in the negotiation of the terms
and conditions of development agreements. This policy will ensure
that development agreement negotiations are conducted in a
consistent and orderly manner.
PROCESS
The Planning Director shall submit all applications for a development
agreement to the City Council. The application for a development
agreement shall be submitted within thirty days after filing or at the
time the City Council considers initiation of any general plan or
zoning amendment required by the project to be implemented
through the development agreement, whichever occurs later. The
Planning Director shall submit the application with a report that
contains, at a minimum, the following information:
1. A description of the property subject to, and the project
to be implemented by, the development agreement.
2. The current general plan and zoning designation and
entitlement for all of the property described in the
application.
3. The general plan and zoning amendments, if any, that
would be required to implement the project and the
proposed development agreement.
The City Council shall designate an ad hoc committee comprised of
the Council member from the district in which the project is located
and other members of the City Council, Planning Commission and /or
staff to participate in discussions with the applicant regarding the
appropriate terms and conditions of a development agreement. The
ad hoc committee shall provide the City Council with periodic
reports on the status of discussions.
