SUBJECT: Resolution 2001 -_ forming the Annexation Ad Hoc Committee
RECOMMENDED (1) Adopt Resolution 2001 -_ forming the Annexation Ad Hoc Committee;
ACTION: (2) Appoint Council Members and
thereto; and
(3) Set a sunset date of November 1, 2002 for the Committee.
BACKGROUND: On September 26, 2000, the City Council directed staff to file an application with
the Local Agency Formation Commission ( LAFCO) to reorganize (annex) three
neighborhoods within the City's Sphere of Influence. These areas are:
• Santa Ana Heights
• Bay Knolls
• Newport Coast /Newport Ridge
Also on September 26, 2000, the City Council agreed with a team of Newport
Coast residents on several "deal points" associated with the annexation of their
community. These deal points - negotiated in exhaustive but cooperative detail
over 2.5 years - will become part of the City's application to LAFCO. For more
information about the City's action on September 26, 2000, please see the City's
website at www.city.newport- beach.ca.us and click on Annexations.
As staff prepares to file the LAFCO application, several issues may arise that will
require further guidance from the Council. These issues may include:
• Recommendations on placement of a permanent Fire Station in Santa Ana Heights.
• Whether or not to annex western Santa Ana Heights.
• Ways to dialogue with residents of the affected arms about annexation issues.
• Property tax discussions with the County of Orange.
• A proposed Joint Powers Agreement with the County of Orange regarding
development approvals in Newport Coast /Newport Ridge.
• The legislative progress of Senate Bill XXXX Qohnson) relating to the retention of the
Newport Coast Local Coastal Program (LCP).
• Budget and operational decisions relative to municipal services in the annexed arms.
In the past, the Council has used an ad hoc committee of three council members
to discuss annexation issues and to recommend courses of action back to the full
Council. The previous ad hoc committee was instrumental in working with
members of the Newport Coast Committee of 2000 in agreeing to the above -
mentioned deal points.

THIS AGENDA This Agenda Item asks the City Council to adopt a resolution which formally
ITEM: establishes an Annexation Ad Hoc Committee to discuss annexation issues and
to recommend courses of action to the full City Council as the City goes through
the LAFCO process.

RESOLUTION 2001-
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH
FORMING THE ANNEXATION AD HOC COMMITTEE
WHEREAS, the City of Newport Beach has annexed territory at least 94 times
since the City's incorporation in 1906, and
WHEREAS, the City of Newport Beach will soon file an application with the
Orange County Local Agency Formation Commission (LAFCO) to annex or reorganize
three territories, including Santa Ana Heights, Bay Knolls, and Newport
Coast /Newport Ridge; and
WHEREAS, if completed, the Bay Knolls /Santa Ana Heights /Newport Coast
and Newport Ridge annexation will be one of the largest in the City's history; and
WHEREAS, the City Council seeks additional information related to this
annexation, including, but not limited to:
• Recommendations on placement of a permanent fire station in Santa Ana
Heights.
• Whether or not to annex western Santa Ana Heights.
• Ways to dialogue with residents of the affected areas about annexation issues.
• Property tax discussions with the County of Orange.
• A proposed Joint Powers Agreement with the County of Orange regarding
development approvals in Newport Coast/ Newport Ridge.
• The progress of legislation relating to the retention of the Newport Coast
Local Coastal Program (LCP).
Budget and operational decisions relative to municipal services in the annexed
areas.
WHEREAS, the City Council has used short -term ad hoc committees to complete
these advisory tasks in the past; now, therefore be it
RESOLVED by the City Council of the City of Newport Beach that hereby
creates and forms the Annexation Ad Hoc Committee on the date this resolution is
adopted with duties as described herein, and be it also

RESOLVED that the Annexation Ad Hoc Committee shall terminate on
November 1, 2002, unless a later Council action modifies this termination date.

AUTHORIZATION: Established by Resolution 2001 -_ on February 27, 2001.
MEMBERSHIP: Three members of the City Council.
TERM: February 27, 2001 through November 1, 2002
PURPOSE &
RESPONSIBILITIES: To provide guidance to the City Council regarding issues arising
from the 2000 -02 proposed annexation of Santa Ana Heights, Bay
Knolls, and the Newport Coast /Newport Ridge communities.
Subjects to address may include, but not be limited to:
• Recommendations on placement of a permanent Fire Station in
Santa Ana Heights.
• Whether or not to annex western Santa Ana Heights.
• Ways to dialogue with residents of the affected areas about
annexation issues.
