Dear Mr. Ryffel:
The City of Newport Beach has received a complaint that there is
a violation of the Harbor Permit Policies regarding the pier
permit area bayward from the property at 2294 Channel Road.
Specifically, the complaint is that a hot tub has been installed
beyond the bulkhead and is supported by a structure over the City
Tidelands.
A field inspection conducted on September 1, 1995, verified that
the complaint is correct and there is a structure built beyond
the seawall in violation of Section 1, C. of the harbor Permit
Policies Only piers, floats, certain patio decks and their
appurtenances shall be permitted between the bulkhead and
pierhead lines."
Please remove the above mention hot tub and supports within 30
days from the date on this letter. Failure to do this may result
in the matter being turned over to the City Attorney's Office for
further action.

at the dock of 2294 Channel. They, however, were moved approximately
two feet furt'l-L-ler out from where the old pilings had been.
This pier in its old condition was in violation of the Us

I, Tony Melum, declare:
1. I am the Tidelands Administrator for the City of Newport
Beach. I have held that position for the last nine years. I have
personal knowledge of the facts stated in this declaration.
2. As part of my responsibilities, I am familiar with the
regulations relating to the construction of structures on the bay
side of the bulkhead or seawall for property owners who abut the
bay.
3. Any work involving the construction of a structure which
extends beyond the bulkhead and into the Newport bay requires a
harbor permit. I am familiar with the harbor permit policy

1 adopted by the City Council of Newport Beach and can state that
2 the policy does not allow the construction of a wall bayward of
3 the bulkhead. In order to engage in such construction, the
4 property owner must apply to the City Council for an exception to
5 the above -stated permit policy. This would be true with regard to
6 the property located at 2296 Channel Road, Balboa, California.

DECLARATION OF TONY
MELUM
I, Tony Melum, declare:
1. I am the Tidelands Administrator for the City of Newport
Beach. I have held that position for the last nine years. I have
personal knowledge of the facts stated in this declaration.
2. As part of my responsibilities, I am familiar with the
regulations relating to the construction of structures on the bay
side of the bulkhead or seawall for property owners who abut the
bay.
3. Any work involving the construction of a structure which
extends beyond the bulkhead and into the Newport bay requires a
harbor permit. I am familiar with the harbor permit policy

1 adopted by the City Council of Newport Beach and can state that
2 the policy does not allow the construction of a wall bayward of
3 the bulkhead. In order to engage in such construction, the
4 property owner must apply to the City Council for an exception to
5 the above -stated permit policy. This would be true with regard to
6 the property located at 2296 Channel Road, Balboa, California.
7 I declare under penalty of perjury under the laws of the

Beach Municipal Code dealing with structures in the harbor and
copies of the City Council Harbor Permit Policies.
When you read the Code you can see that the construction of any
structure within the harbor would require a permit. The Harbor
Permit Policies, in those sections I highlighted, would preclude
the staff issuing a permit for a wall bayward of the bulkhead and
would require City Council approval.

Complaint of Pier Design Violation
Dear Mr. Ryffel:
Regarding the complaint that the pier and float bayward of
2296 Channel Road was in violation of the Building
Department's standards for pier designs, the Marine
Department is sending you this additional information.
There existed some ambiguity as to whether the structure was
in fact in violation of the designs requirements for piers
and docks. The code is unclear on this aspect, however, Mr.
Grosso, did consent to modify the existing pier and will cut
back the beams on either side to about 24" from the deck.
This department will do a field inspection to confirm that
the beams have in fact been reduced.
