I hereby affirm that I am exempt from the contractor's license law for the following reasons:
(Sec. 7031d.5, Business and professions Code). Any City or County which requires a permit to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires
the applicant for such permit to file a signed statement that he is licensed pursuant to the
provision of the Contractors License Law (Chapter 9, commencing with Section 7000, of
Division 3 of the Business and Professions Code) or that he is exempt therefrom and the basis
for the alleged exemption. Any violation of Section 7031.5 by any applicant for a permit
subjects the applicant to a civil penalty for not more than five hundred dollars ($500).
I, as owner of the property, or my employees with wages as their sole compensation,
will do the work, and the structure is not intended or offered for sale (Sec. 7044, Business and

ENVIRONMENTAL IMPACT: This office does not intend to prepare an Environmental
Impact Statement on this activity unless significant detrimental effects
are brought to our attention.
CRITERIA: Your written comments or objections should include the number
and date of this notice and must reach this office within thirty (30)
.calendar days. The decision whether to issue a permit will be based
on an evaluation of the probable impact of the activity on'the public
interest. That decision will reflect the national concern for both protection
and utilization of important resources. The.benefit which reasonably
may be expected to accrue from the activity must be balanced against
its reasonably foreseeable detriments. All factors which may be relevant
to the activity will be considered; among those are conservation, economics,
aesthetics, general environmental concerns, historic values, fish and
wildlife values, flood damageprevention, land use classification, navigation,
recreation, water supply, water quality.,,and, in general, the needs and
welfare of the people. Details of changed conditions on the final permit
action will be provided upon request.

AT 2100 EAST BALBOA BOULEVARD
Action
If desired, (l)- approve the permit subject to approval by the
South Coast Regional Zone Conservation Commission, and the
U. -S. Army Corps of.Engineers, or (2) deny the permit.
Discussion
The proposed revision will replace an existing rectangular
float with a largertwo slip float and will replace an exist-
ing non -conforming -pier.
City Council approval is required since the proposed facility
does not conform to the 'City's Standard Drawings or with Section
1 paragraph E of; the Harbor. Permit Policies that states:
"In R-1 zones, only a single pier and float or slip
shall be permitted bayward of each parcel or lot".
The applicant desires. the two slip float to provide adequate
mooring for his two boats.. This configuration will allow a
more secure method of typing up the boats to protect them from
winds and from wave surges close to the channel entrance.
This application would normally be sent to the Joint Harbor
Committee for review and comment prior to submittal to City
Council. However, both the May and June Joint Harbor Committee
meetings were cancelled. At the request of the applicant, this
application has been submitted directly to the Council for review
and action.

The staff has been assured that the applicant would not rent any
portion of the slip facility. The 73.45' of bay frontage is some-
what unique in this harbor. This amount of frontage can efficiently
support two slips while maintaining adequate side setbacks. The
revision, if allowed, will also cause the removal of an encroaching
pier structure as shown on the attached drawing.
The neighbors immediately east and west of the permit location have
been contacted regarding this application. Mr. Svendsen, the easterly
neighbor, requests the encroaching pier structure be made to conform
to the Harbor Permit Policies. No comments were received from
Mr. Gibson, 'the westerly neighbor.
