SUBJECT: TRACT NO. 15012
LOCATION: EASTERLY SIDE OF DOVER DRIVE BETWEEN 16TH STREET AND
WESTCLIFF AVENUE
DEVELOPER: STANDARD PACIFIC CORPORATION
RECOMMENDATIONS:
1. Approve the improvement plans and specifications and accept the public
improvements constructed in conjunction with Tract No. 15012.
2. Authorize the City Clerk to release the faithful performance bond (Bond No. 1114
1572 864).
3. Authorize the City Clerk to release the labor and material surety (Bond No. 1114
1572 864) in six months provided no claims have been filed.
4. Authorize the City Manager to sign the attached letter to accept maintenance
responsibility for the bluff side of the Bluff Top trail in six months.
DISCUSSION:
The public improvements constructed in conjunction with Tract No. 15012 have been
inspected and are satisfactory for acceptance.
The private improvements constructed in conjunction with Tract No. 15012 include the
construction of curb, gutter, sidewalk, streetlight, street paving, and storm drain
improvements. The developer will maintain these improvements. The developer will
also maintain the Bluff Top trail landscaping on the inland side of the trail in Lot "R ".
The public improvements constructed in conjunction with Tract No. 15012 include the
construction of water and sewer improvements and the construction of street
improvements along the Dover Drive and 16th Street frontages. The City will maintain
these improvements. The City will also maintain the Bluff Top trail landscaping
improvements on the bluff side of the trail in Lot "R ".

The developer has prepared an agreement for maintenance of the Bluff Top
improvements located in Lot R. The agreement requires the Association to maintain all
the landscaping and the storm drain system on the inland side of the pedestrian trail. In
addition, the agreement requires the City to maintain the Bluff Top trail, the adjacent
lighting, and the natural vegetation along the bluff side of the pedestrian trail.
The developer has provided the City with a letter stating that they will continue to
maintain the Bluff Top trail for six months after the City has accepted the trail
landscaping improvements.

Re: Acceptance of Maintenance for Lot R of Amended Map No. 1 of Tract No. 15012
Dear Mr. Bludau:
As you are aware, the City of Newport Beach ( "City ") has inspected the condition of landscaping
and other improvements on the 'but board" side of the Castaways Bluff Top (meaning that
portion of Lot R bayward of the easement for landscape maintenance purposes reserved for the
Castaways Homeowners Association on Amended Map No. 1 of Tract No. 15012) (the "City
Open Space "). It is our understanding that the City's inspection has confirmed that the City Open
Space has been landscaped and maintained in accordance with the terms of the Coastal
Development Permit No. 5 -94 -286 dated April 12, 1995 (the "CDP ") and the terms of the
"Habitat Mitigation and Monitoring Plan for the Upper Castaway" approved by the California
Coastal Commission and the California Department of Fish and Game on June 28, 1995 (the
"HMMP ") and that the conditions for acceptance of the maintenance of the City Open space by
the City have been satisfied. Accordingly, it is our further understanding that the City is
prepared to immediately accept the responsibility for the maintenance of the City Open Space
upon the following terms and conditions:
1. To ensure the continued growth and maintenance of the revegetated areas in
accordance with the CDP and HMMP, Taylor Woodrow shall cause the City
Open Space to be monitored by LSA Associates, Inc., the City approved biologist,
for a period of 180 days from April 1, 2001 (the "Turnover Date') and
maintenance to be performed by TrueGreen Landcare. Maintenance to include
the following:
(a) litter control, continued eradication of non native plants;
(b) control of the height of foliage not to exceed the top of the fence;
(c) watering of plantings as necessary to ensure establishment of plantings; and
(d) any and all maintenance and frequency of maintenance required by the City.

All such costs of monitoring the City Open Space shall be borne by Taylor
Woodrow.
2. Except as provided in Paragraph 1, above, from and after 180 days following the
Turnover Date, all costs and expenses associated with the monitorintg and maintenance of the
City Open Space shall be borne by the City.
In the event the foregoing is consistent with your understanding of the City's position on this
matter, you are hereby requested to acknowledge the acceptance of the maintenance
responsibility for the City Open Space upon the terms and conditions stated above by executing a
copy of this letter in the space indicated below and returning a fully executed counterpart of this
letter to the undersigned at the above address.
If you should have any questions with regard to the foregoing, please do not hesitate to contact
