SUBJECT: LIDO ISLE STREETLIGHT BANNERS
RECOMMENDATION:
Approve the request of the Lido Isle Community Association for the installation of
double flag banners on six City streetlight poles year -round. Installation shall be on
poles along both sides of Via Lido. If approved, the installation of banners will be
subject to the Public Works Department's conditions of approval.
DISCUSSION:
The applicant (Lido Isle Community Association) has requested that six (6) private
double flag banners (3 streetlight poles on each side) be installed in the Via Lido public
right -of -way at the entrance to Lido Isle (see attached letter and exhibit).
Staff has identified several issues with the application, the principal one being that the
banner installation on an annual basis would, in effect, deem the installation permanent
in nature. A precedent for permanent installations has been set by the previously
installed flower banners along Coast Highway in Corona del Mar and the Orange
County Museum of Art artist on exhibit banners on San Clemente Drive in Newport
Center. Lido Isle Community Association propose to install /switch the double flag
banners a few times a year to reflect holiday /seasonal themes and community events
(see attached letter).
City Council Policy L -16 allows one 2 -feet wide by 7.5 -feet high (15 square feet) banner
per pole. The Lido Isle Community Association proposes to install two 25.5- inches wide
by 44- inches high (total of 15.58 square feet) triangular shaped banners per pole.
Although there are two banners per pole, the total square banner footage is almost the
same as the 15 square feet allowed in the Council Policy. In addition, if required by
Utility Division, small slits /cut outs can be added to the banners to reduce the wind load
on the streetlight poles.
The request to install double flag banners year -round on each streetlight pole is not in
conformance with City Council Policy L -16. Policy L -16 only allows one banner per pole
for 30 days. In addition, Section 2.c of City Council Policy L -16 specifies that, "Banners
may be installed only between September 1st and May 31st, a nine (9) month period."

Should the City Council decide to approve the Lido Isle Community Association's
request to install double triangular shaped banners on six streetlight poles year- round,
Staff recommends the following conditions of approval:
1. The installation shall be limited to the six streetlight poles shown on the location
plan.
2. The Association shall provide on -going maintenance of the banners and brackets.
3. The Association shall agree to indemnify and hold harmless the City of Newport
Beach for any liability associated with contractors, maintenance, design, installation,
and other activities related to the banners and /or brackets. The format is subject to
approval of the City Attorney.
4. The Association shall maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher. The City and the Lido Isle Community Association
will be named as additional insured.
5. The banners shall conform to City Council Policy L -16 with the exception of double
banners per pole and time of installation.
6. All banners and brackets shall require issuance of an Encroachment Permit from the
City of Newport Beach Public Works Department, and shall comply with the
Encroachment Permit conditions.
7. If needed, the City may require removal of the banners to allow other organizations
to install banners authorized under City policies at the same location and during the
same time period. Two weeks advance notice will be given and coordination with
the applicant will be provided.
8. The banners shall be limited to non - commercial images only.
9. The structural integrity of the streetlight poles shall be approved by Utility Division
prior to installation of the banners.

RE: Encroachment permit - temporary displays of seasonal flags
Dear Council Members:
We respectfully request that the City Council review and approve the request of the Lido Isle Community
Association to allow the display of seasonal flags on the Newport Beach City light standards on both sides
of the Via Lido approach to Lido Isle which were installed by the City in 1991. In the past, the City has
allowed LICA to fly these flags and they are very colorful and well liked by residents and guests alike.
We propose to install the flags as per the enclosed drawings as follows:
