Council Member Bromberg has suggested that dogs also be prohibited in Carroll Beek Park. Carroll Beek Park is a relatively small park located on the west side of Agate Ave between just north of South Bayfront. The majority of Carroll Beek Park is improved with a heavily used basketball court and community center with very little in the way of grass or vegetation. Dog feces present a potential health and safety problem given the size and nature of Carroll Beek Park. Staff has prepared an ordinance that prohibits dogs in Carroll Beek Park with the standard exception for guide dogs. RECOMMENDATION Introduce the proposed ordinance amending Section 7.04.050 and pass the ordinance to July 1p, 2001 for second reading and adoption. Robert H. Burnham ORDINANCE NO. 2001- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING SECTION 7.04.050 OF THE NEWPORT BEACH MUNICIPAL CODE, PERTAINING TO PROHIBITING DOGS ON PIERS AND THE CARROLL BEEK PARK. The City Council of the City of Newport Beach does hereby ordain as follows: SECTION 1: Section 7.04.050 is hereby amended to read as follows: 7.04.050 Dogs Prohibited. (a) No person shall permit or allow any dog on any public pier or dock. (b) No person shall permit or allow any dog in the Carroll Beek Park which is a public park located on the west side of Marine Avenue between Park and the allev north of South Bayfront on Balboa Island. (c) The provisions of this Section shall not apply to any blind person using a guide dog provided the dog s on a leash. SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. 1 SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption. SECTION 4: This ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach, held on the _ day of 2001, and adopted on the _ day of 2001, by the following vote, to wit: AYES, COUNCILMEMBERS NOES, COUNCILMEMBERS ABSENT COUNCILMEMBERS MAYOR ATTEST CITY CLERK 2
