SUBJECT: Council Waiver Of Street Closure Permit Fees For The Sons Of
The American Legion For Up To Ten (10) Events Per Calendar
Year
RECOMMENDED ACTION:
Adopt resolution 2001 -_ waiving the $51 Street Closure Fee for up to ten (10)
events per year.
DISCUSSION:
Michael S. Brigandi, Past Commander of Squadron 291, has submitted a written
request to obtain a fee waiver of the $51 street closure fee for up to ten (10)
times annually. The request is made to maximize the money collected from
fundraisers which will go to charitable contributions. Street closure permits are
used to obtain permission for the organization to park in part of the alley that runs
from 15''' Street to the Marina Park gate.
The loss in revenue to the City and the gain is reduced overhead for the Sons of
the American Legion would be $510 annually. Street closure permit applications
will still be required for those events where the fee waivers are applicable.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH WAIVING FEES REQUIRED TO
OBTAIN STREET CLOSURE PERMITS FOR NO MORE
THAN 10 EVENTS PER YEAR HELD AT AMERICAN
LEGION POST 291
WHEREAS, the Sons of the American Legion was created in 1932 in order to extend
membership to the sons of those eligible for membership in the American Legion; and
WHEREAS, Newport Harbor Squadron 291 was established in 1934 and annually
raise thousands of dollars for worthwhile local causes; and
WHEREAS, the Newport Beach City Council can waive City fees when appropriate.
NOW, THEREFORE, be it resolved by the City Council of Newport Beach, California
that fees for no more than ten (10) street closure permits annually are hereby waived, with
Street Closure applications still being required for fee waiver events.
ADOPTED this day of 2001.

In 1932 the American Legion created an organization known as the Sons of the American
Legion. Membership was extended to the sons (including step and adoptive) of
individuals who were eligible for membership in the American Legion. The purposes of
the organization include upholding and defending the Constitution, maintaining law and
order, fostering a true spirit of Americanism and inculcating a sense of individual
obligation to the community, state and the nation.
Newport Harbor Squadron 291 was established in 1934 and currently has more than 350
members. They concentrate their efforts on fund raising. Each year they sponsor events
that have resulted in thousands of dollars in donations. A partial list of recipients includes
the Newport-Mesa Schools Foundation, Newport Elementary School, Newport Beach
Library Foundation, the Sea Scout Base, and various veterans related organizations.
These donations are made possible by keeping our overhead to a minimum and the
support of numerous volunteers. Several times a year we hold events that require a
special event permit. We include in our application a request to park in part of the alley
that runs from 150' street to the Marina Park gate We make certain that we allow for
access for emergency vehicles. Each time we have applied for a permit approval has been
granted.
A number of other times during the year there are activities at the American Legion that
do not qualify as a special event but still require a permit to use the alley. We will apply
for that permit on each occasion but would like to be exempt from paying the fee. We
would deeply appreciate you granting us that exemption. It is anticipated that we would
use the alley approximately 10 times per year.

Dear Mr. Brigandi:
I am in receipt of your recent letter regarding the Special Event Permit process. Please be
aware that the fees for a special event are established by the City Council and a waiver can only
be granted by the City Council. While this is normally done on a per event basis, you are free to
request an annual waiver limited to a certain number of events per year. If you wish to pursue
an individual waiver, the next time your organization requests a Special Event Permit, I would
recommend you also forward a waiver request to the Council.
The City records for the past three years do not show any requests or approvals for parking,
which would block the alley at Marina Park, as the sketch provided indicates.
The Legion does have, through the authority of City Council Resolution No. 92 -129, permission
to utilize the Las Arenas Park, a maximum of twelve times per year, subject to prior approval of
the Community Services Director, so that the irrigation can be pre - protected.
If you wish to pursue a Special Event Permit for parking in the alley, that request will be
forwarded to the City's Traffic Affairs Committee for investigation and action.
If you have further questions, do not hesitate to call Andrea McGuire, Senior Recreation
Manager (644- 3161), who has responsibility for administering the City's Special Event Permits.
