Alford (949) 644 -3235 JWA Settlement Agreement Extension General Plan Amendment (PA 2001 -222) Initiation of a potential amendment to the General Plan relating to the extension of the John Wayne Airport Settlement Agreement Extension. Adopt Resolution No. 2001 ------ initiating the General Plan Amendment (GPI 2001 -003). In 1985, the County of Orange, the City of Newport Beach, Stop Polluting Our Newport (SPON), and The Airport Working Group (AWG) reached a settlement concerning the development and operation of John Wayne Airport (JWA). The Settlement Agreement allows for the expansion of JWA in exchange for operational and capacity limits. The Settlement Agreement is set to expire on December 31, 2005. The City is currently in negotiations with the County to extend the term of the Settlement Agreement. The extension of the Settlement Agreement may involve a limited expansion of airport facilities and aircraft operations. Since some policies of the General Plan directly relate to the Settlement Agreement, some revisions to these policies may be necessary in order to extend the term of the Settlement Agreement. City Council Policy K -1 requires that amendments to the General Plan be initiated by the City Council after recommendation from the Planning Commission. Analysis If the General Plan amendment is needed to extend the Settlement Agreement, it will likely involve revisions to sections of the Land Use Element and the Noise Element. Land Use Element Policy K links the land use designations and density /intensity of property within the City to the JWA facilities and operational limits imposed by the Settlement Agreement. Therefore, any change in these limits may require revisions to Policy K. Section 3.1.1 (Transportation Noise Sources) of the Noise Element identifies common noise sources in the City, including aircraft operations. This section will likely require revisions, if only to update references to the Settlement Agreement. Section 3.6 (Community Noise Contours) of the Noise Element may require updates to the references to the Settlement Agreement. ■ Goal 4.4 of the Noise Element directly addresses noise impacts from JWA. This goal and some of the related policies may require revisions and updates. The extent of the revisions will be dependant on the modified terms of the Settlement Agreement. A number of project scenarios are currently under consideration and are being analyzed in an environmental impact report prepared by the County. Planning_ Commission Action As of this writing, the Planning Commission has not reviewed the proposed General Plan amendment initiation. The Planning Commission will consider this item on December 6, 2001. Staff will report on the Planning Commission's recommendation at the City Council meeting. Environmental Review The initiation of an amendment to the General Plan is not a project under the provisions of the California Environmental Quality Act (CEQA). If the proposed General Plan amendment is initiated, environmental review will be conducted prior to the public hearings. Recommendation Staff recommends that the City Council adopt the attached resolution initiating the General Plan amendment (GPI 2001 -003). Submitted by: PATRICIA L. GPI 2001 -003 December 11, 2001 Page 2 of 2 RESOLUTION NO. 2001- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH INITIATING AMMENDMENTS TO THE LAND USE ELEMENT AND NOISE ELEMENT OF THE GENERAL PLAN RELATING TO THE EXTENSION OF THE JOHN WAYNE AIRPORT SETTLEMENT AGREEMENT [GPI 2001 -003] WHEREAS, City Council Policy K -I establishes that amendments to the General Plan shall be initiated by the City Council after recommendation from the Planning Commission; and WHEREAS, the extension of the John Wayne Airport Settlement Agreement may require amendments to certain policies in the Land Use Element and Noise Element of the General Plan; and WHEREAS, on December 6,200 1, the Planning Commission of the City of Newport Beach considered the initiation of the proposed amendments at a public meeting and recommended that the City Council [INITIATE/NOT INITIATE] the proposed General Plan amendments; and WHEREAS, on December 11, 2001, the City Council of the City of Newport Beach considered the initiation of the proposed amendments at a public meeting; and WHEREAS, the public was duly noticed of these public meetings; and THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: The amendments to the Land Use Element and Noise Element of the General Plan (GPI 2001 -003) are hereby initiated. Planning Commission Action On December 6, 2001, the Planning Commission reviewed the proposed General Plan amendment initiation and voted unanimously, with one absent, to recommend initiation of the amendment (GPI 2001 -003) to the City Council.
