BACKGROUND: The Legislature has approved, and the Governor has signed, legislation that requires each city and county that has an established civil service system to either implement a veterans' preference system or adopt a resolution identifying the reasons why it has decided not to do so. The veterans' preference applies only when the candidates have identical qualifications and staff believes the preference should be given only for an appointment to an entry -level position. Staff has prepared a resolution adopting a veterans' preference system in recognition of the service veterans have given to our Country and as an additional incentive to those considering military service. RESOLUTION NO. 2002 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADOPTING A VETERANS' PREFERENCE SYSTEM WHEREAS, the California Constitution states that the Legislature may provide for preferences for veterans and their surviving spouses; and WHEREAS, the Legislature has, through the adoption of Senate Bill 36, required certain public agencies with an established civil service system to either implement a system for giving veterans preference over other identically qualified applicants for appointment to a position or adopt a resolution specifying the reasons for refusal to implement a veterans preference system; and WHEREAS, the City Council of the City of Newport Beach supports the concept of giving preference to veterans over other identically qualified applicants in recognition of their service to the United States of America and as an additional incentive to those who are considering entering military service. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH RESOLVES AS FOLLOWS: Section 1. That the City Manager or his/her designee shall give a preference to veterans over other identically qualified applicants for appointment to any entry- level position in the City; and Section 2. That, for purposes of this Resolution the term "Veteran" is defined as any person who has served: (a) full time for 30 days or more in the armed forces in time of war or in time of peace in a campaign or expedition for service in which a medal has been authorized by the government of the United States; or (b) in the armed forces during the period from September 16, 1940 to January, 31, 1955; or (c) in the armed forces for at least 181 consecutive days since January 31, 1955, and who has been discharged or released under conditions other than dishonorable Section 3. For purposes on this Resolution, the term "Veteran" does not include any person who served only in auxiliary or reserve components of the armed forces and whose service in those components did not exempt him/her from the operation of the Selective Training and Service Act of 1940.
