Commission staff have reviewed the information submitted and determined that the above referenced dredging
events conform with Consistency Certifications CC -078-99 and/or CC -077-01 and that no further federal
consistency review is necessary from the Commission for the dredging components of the projects. In addition,
the proposed beach disposal events have been reviewed and found by the Executive Director to be consistent with
Special Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is
necessary from, the Commission for the beach disposal components of the projects.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC -078-99 and CC -077-01 and/or conform with the terms and
conditions of Coastal Development Permit 5-99-282, as amended. Any change in the projects may cause them to
lose their status as consistent with CC -078-99 and CC -077-01 and/or CDP 5-99-282, as amended. This
certification is based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring at that time
must cease until a new determination regarding conformance with CC-078-99'and CC -077-01 and/or CDP 5-99-
282, as amended, is obtained.

Permits to conduct maintenance dredging, per Regional General Permit No. 54 in Newport Bay,
Newport Beach, Orange County, California. This letter authorizes maintenance dredging at
five project sites within Newport Bay (see below).

. Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 54. As long as you comply with the general permit conditions of RGP No. 54, an
individual perrrdt is not required.
Furthermore, you must comply with the following non -discretionary Special Condition:
1. The permittee shall complete all dredging and beach disposal activities prior to
January 24, 2006. Should additional time be required, the pern-dttee shall conduct a new
eelgrass presence/ absence survey per the requirements of the Southern California Eelgrass
Mitigation Policy (see: http://swr.nmfs.noaa.gov/hcd/eelpol.h )and submit results to the
Corps with a request for additional time.
2. The permittee shall confirm coordinates for location of offshore disposal site with City
Harbor Resources Division of all material approved for ocean disposal prior to the disposal of
material. The location of the designated site for LA -3 is expected to change in September 2005.
A general permit does not grant any property rights exclusive privileges. Also, it does not
authorize any injury to the property or rights of others or authorize interference with any
existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other
Federal, State, or local authorizations required by law.

Outline of sample collection and analysis:
COLLECTION
Samples collected by a hand coring device driven into a representative area of the dredge
site and receiving beach. Stored in plastic containers and immediately delivered to the lab.
SAMPLE PREPARATION
Entire sample transferred into 1 liter glass containers, deionized water added, and
mixed to desalt and disperse the sediment, The sediment is allowed to completely
settle and the clear water is removed by siphoning. The sample is placed in a drying
oven at 500C and occasionally stirred until the entire sample is completely dry. The dry
sample is transferred to a desiccator for cooling. The sample is disaggregated and a
Riffle sediment splitter is used to evenly split the sample to reduce the quantity of
material to be analyzed to an allowable retention weight for the sieves.
SAMPLE ANALYSIS
The dry split fraction is processed through a # 10 U.S. standard sieve to remove the
gravel/shell fraction of the sample. The material retained on the sieve is weighed and
value recorded. The material passing through the # 10 sieve is wet sieved through a
#230 sieve to remove the silt/clay fraction. The material retained on the sieve is
transferred back into the glass container and placed back into the drying oven at 50'C.
The remaining sample is allowed to completely dry and the material is weighed and
recorded to yield the sand fraction. The silt/clay fraction is calculated by subtracting
the gravel/shell and sand fractions from the total analysis weight.

Caulerpa Survey Reporting Form
This form is required to be submitted for any surveys conducted for the invasive exotic alga
Caulerpa taxifolia that are required to be conducted under federal or state permits and
authorizations issued by the U.S. Army Corps of Engineers or Regional Water Quality Control
Boards (Regions 8 & 9). The form has been designed to assist in controlling the costs of
reporting while ensuring that the required information necessary to identify and control any
potential impacts of the authorized actions on the spread of Caulerpa. Surveys required to be

Dear A. Thagard:
The City of Newport Beach has recefved a complaintregarding the
use of your residential dock at the above address. Specifically
the complaint is that a large power vessel is being berthed on the
northwesterly side of the dock and creating an access problem.to
the shore mooring adjacent to the dock. It has been t he poli'cy
ofAhe City of Newport Beach and the Orange County Sheriffis
Harbor Patrol that when docks are used in conjunction with shore
moorings there must be an accomodation between the dock use and.
the shore mooring use.
The shore mooring owner has indicated that th ' e vessel berthed
there is so large that it, has limited his access to his mooring.
Please contact this department so this matter.can be resolved
and use of both the shore mooring.and the private.pier.can exist
harmoniously.

Dear Ms. Thagard:
The City of Newport Beach has received a complaint regarding the
permit zone bayward of your residence at 236 East Bay Front.
Specifically, the complaint is that a structure is being built
within your permit zone in violation of Section 17.24.010 of
the Newport Beach Municipal Code which states:
17.24.010 "Permit Required for,Construction or Alteration.
No person or agency shall build, maintain, extend or make
structural alterations on any building, pier, bulkhead, piling,
sea wall, reef, breakwater, or other structure in,, upon, or over
the waters of Newport Harbor or the Pacific Ocean or any other
water where the tide ebbs and flows within the City, or do
any filling, excavating or dredging in said waters or ocean,
without first obtaining a written permit to do so from the
city."
It appears that a bulkhead or groin wall is being constructed bay
ward of your property in violation of the above section. Please
cont act the Marine Department within five days of receipt of this
letter to preclude further action.

The staff of the State Lands Commission has received your
letter, dated August 6, 1985, and copies of the permit drawing
relative to the proposed construction ot your client's docking
facilities in Newport Bay.
The tide and submerged lands over which the proposed
project will extend are sovereign lands of the State of
California that the Legislature granted in trust to the City of
Newport Beach. Therefore, you need not apply to the State Lands
Commission for project authorization. You should, however,
apply to all other agencies having approval authority.
This action does not constitute, nor shall it bNe construed
as a waiver of any right, 11--itle, or inte.-est by the State of

Recommendation:
If desired, approve the application subject to the following conditions:
1. Approval of the California Coastal Commissi.on,
2. Approval of the Army Corps of Engineers.
Discussion:
This application is before the City Council -as required by Section 5.C.1.
and Section 22 of the Harbor Permit Policies, which state:
5.C.l. "Prior approval of the City Council will be required
before issuing a permit for shore -connected structures when the
abutting upland property is a dedicated public right of way ex-
cept along the Grand Canal on Balboa Island".
22. "Piers presently in use may be repaired but recommendations
for any additions or remodeling shall be restricted to such changes
that do not lessen the use of either the immediate water or land
areas".
As the attached drawing indicates, the applicant proposes to rebuild and re-
vise existing pier and float. The proposed revision does not reduce the use
of either the immediate water or land areas.

The structure was inspected on 7-23-79 at which time it
was determined that the following deficiency exists.
A continuous pressure anti -siphon device must be attached
to the municipal'water service, bayward of the bulkhead,
in compliance to title 17 of the California Administrative
Code.
In accordance with Section 10-D of the City Harbor Permit
Policies, "All structural deficiencies must be corrected...
A permit for this work must be obtained from the Community
Development Department.
Would you please advise this department when this require-

as possible and letting us know if it is in order and the
transfer will be approved by the city.
We are having buyers and seller sign the cards which are 0
used in connection with the transfer and will forward same
to you with Transfer Fees of $155.bO at the close of escrow,
however, we do not want to close our escrow until we know
that the facility is satisfactory and can be transferred.
