As you know we registered a complaint last September concerning the nuisance
and encroachment of Prowler II. This boat was docked at 331 Bayfront,
Balboa Island which is owned by Mr. Tom Hargraves.
We would like to register an additional complaint concerning the Prowler II
which is now docked on the opposite side of the dock at 331 Bayfront. The
Captain is living on the boat and I believe that this is illegal. This is
also creating a parking nuisance.
It was also our understanding that there would be no further encroachment
on our property. There has been another boat parked this week on the
dock that is encroaching on our property. We request that you advise
Mr. Hargraves that there is to be no encroaching.

Dear Mr. Osborne:
After our initial telephone conversation, regarding the boat
docked on the south side of the Hargraves dock, I have been unable
to contact you by telephone.
My clients feel very bad that the neighbor communication has
become as bad as it is. I am very sad and frustrated that I have
not been able to reach some type of compromise between yourself
and my clients. My clients are equally disturbed by the matter.
In the urban society of today it is very important, both to us as
individuals, as well as to the society as a whole, that people get
along with one another. One of the traits of man is that no two
people are a like or look at a problem in the same light. In
looking at both sides of the boat situation I have seen that there
have been outbursts and the lack of restraint on both sides. What
began as a lack of discretion has escalated in to a situation
where everyone wants to go to war. The direction in which the
situation is headed is only going to create further problems
between neighbors that live only tenfeet from one another. I
feel that there must be a solution that is mutually agreeable
One of the problems with the harbor is that noise echoes
everywhere across the water. When people go fishing they get all
excited and talk loud. This coupled with the noise from the boat
is disturbing to the people that live on the waterfront. When the
boat is leaving in the middle of the night the situation is
multiplied by the fact that the ambient noise level of the harbor
is way down.

At the outset, one .of the solutions suggested by my clients, which
I neglected to discuss with you in our previous telephone
conversation, would be to offer you $1,000 towards a
airconditioning unit for your bedroom. In the summer when the
boats go out in the middle of the night, about 12 to 15 times a
summer, my clients could notify you in advance that they are going
fishing and on those evenings you could close your windows and
turn on the airconditioner.
One of the hardest things in life to do is to apologize. It is
much easier to justify the actions that have been taken, rather
than say I was wrong in my actions or remarks. It is also easier
to stay mad at someone rather than accept their apology. My
clients would like to apologize for their indiscretions in the
past with a promise to take corrective measures in the future. In
addition, they would like for you to consider the monetary offer
towards an airconditioner. With a promise that they will notify
you and tell you when they are going to go fishing in the middle
of the night.
Please consider the offer, as I feel that it will be a benefit to
everyone that a peace is reached and lines of communication are
opened between neighbors.

Dear Mr. and Mrs. Osborne:
On October 5, 1987 1 received the attached letter from Mr. Thomas
E. Hargraves. This letter is a result of a telephone converstion
I had with Mr. Hargraves 4 or 5 days earlier. Mt. Hargraves was
hoping that the problem regarding the nuisance could be resolved
by communications between him and Mr. Crean, the owner of Prowler
Ii.
Mr. Hargraves also stated that the encroachment issue is basically
being raised at this time as an harassment and even though there
is a technical encroa,,,hment it is creating no problem to the
adjacent permittee.
Mr. Hargraves is not going to voluntarily resolve the encroachment
issue until he is forced to do so.
I am sending you a copy of this letter to ask you if you feel if
it would be worthwhile to give them a period of time to try to
reduce the nuisance problem at the residence'. If not, give me a
call and I will pursue the encroachment issue without delay.

Dear Johnnie,
Inclosed is a copy of the letter thtt the'eity has
recently sent to me. This letter arrived shortly
after the prowler left for the cape..
I've heard from Dave that the Prowler crew had
problems and had to work on the boat most of the
night before leaving. They were apparently very
noisy.
On other occasions I have had to talk: to Scott
about water flowing from the bow bait t,nk and
radios left on, creating an unneces ar.y noise..
I feel Scott is not cooperating as to the noir--.e
problem. I have had to talk to him at least three
times about the bow bait tank being left on and
dribbling in the water.
Now, I know fi�;hermen leave at; odd holt.rs to fret
to the fishing spots, but I fee?. you should talk
to Scott and emphasize to him the importance of
being as quiet as possible.

Dear Mr. Harshbarger:
We would like to register a complaint concerning an encroachment on our
property at 325 East Bayfront, Balboa Island by the owners of the property
at 331 East Bayfront. This encroachment has been a continuing thing for
several years. At the present time, the boat that is involved is Prowler Too
This boat does not belong to the owners of the property and we must assume
that the dock is being leased to both the Prowler I and the Prowler Too.
We have had to endure loud talking, foul language, parties on the boat before
leaving the dock, yelling back and forth and general disregard for any and
all living in the area. We have endured bait tanks running for a week at a
time and our bedroom is in the front on the water at the side where this dock
is.
We have talked with the owner of the boat only to have him cuss my husband out.
The owner of the house had intimated that we would have to put up with the
noise as this is a boating area. The owner of the house now does not speak to
US.
Several years ago, about 3:00 A.M. I was awaken by very loud and continuous
talking. I finally went down to the boat and asked to speak to the owner. I
reminded him that sound carries on water, that this was a residential area and
our bedroom was right above the dock. I also reminded him that there had been
a bait tank running continuously for the entire week. I returned to the house.
When the boat left the dock, he came over the loud speaker and said "so long
honey, I am glad I don't have to sit across from you over the breakfast table"
When I told my husband the next morning, as he had slept through this, he was
very upset and when the boat returned to the dock the next day or two he talked
to the owner. He was cussed out!! That is when we spoke to the owner of the
house and he did absolutely nothing.
There have been many other incidents, too numerous to mention, but I will cite
you two recent ones.
Last Saturday evening or rather early Sunday morning about 5:00 A.M. I was
awaken by noise. It continued and I realized it was a radio reporting the sea
conditions. I then heard an "expletive" and when I looked out the Captain of"
Prowler Too was on the bridge beating something which of course was making very
loud noises. I went down to the dock and found that he had the radio on from
Prowler I which was on the other side of the dock listening to the reports and
at that time was unzipping the covers on the bridge. I asked him to remember
that there were residents trying to sleep etc etc. He did apologize. I returned
upstairs. Then I heard loud voices, exclaiming "where is everybody". By the
time I looked out they were all over the outside of the boat remarking about it.

The owner was on the bridge talking back and forth'with the men. There must
have been 8 or 10 that boarded. When they left the dock they revved the motor
so long that our guest who was in our downstairs bedroom came up to another
bedroom upstairs in the rear of the house as she could not sleep.
Again, on Monday morning about 5:00 A.M. we were again awaken by bells,
and then a spotlight came on that beamed right into our bedroom. There was
loud talking and they kept trying to come into the dock. Apparently, they
started out and they had a problem. It finally quieted down about 5:55 A.M.
In addition to the noise on the dock, they stand out on Crystal which is behind
the houses and talk before they get into their cars when they return from
their trips.
The Captain of the boat has a motarized scooter that has been left a month
at a time on the sidewalk preventing the street sweeper from completing the
boardwalk. He also drives a truck that when it is started, regardles3of
what hour in the morning it is has a muffler that is bad and I am sure you
know what kind of noise that makes.
In the beginning we felt that we would allow the encroachment if the noise
would cease and if they could be considerate of the neighbors, however, we
have decided that the best thing is that the rules be adhered to and that
the owners at 331 East Bayfront be notified that they are not allowed to
encroach on our property - period.
We would appreciate your consideration in this matter. We would also appreciate
being kept aware of the progress of this complaint.

Dear Mr. Melum:
We have your letter dated October 6, 1987 for which we thank you. This is to
reaffirm our position concerning the encroachment on our property from boats
docked at 331 East Bayfront.
This will also confirm our conversation of several days ago concerning this
problem.
We considered the suggestion of Mr. Hargraves that perhaps the noise nuisance
could be resolved by his communication between him and Mr. Crean, owner of the
Prowler Too. However, as mentioned in our conversation this nuisance has been
an ongoing problem for three years or more, nothing has been done about it when
we complained, and we feel that the best thing to do would be to resolve the
encroachment problem.
We would also like to bring to your attention that the night after we spoke,
the owner of the house, Mr. Tom Hargraves docked his boat, left the bait tank
running all night and had a light on the dock all night which beamed into our
bedroom. That does not sound like someone eager to resolve nuisance problems.
We would appreciate your keeping us aware of the progress of this complaint.
