RE: Notice of Intent to Revoke Pier Pennit at 113 Bay Front East
Dear Mr. Hurray,
Within the past month, Harbor Resources has received complaints concerning the condition of
the pier at 113 Bay Front E. These complaints focused on the hazards that your pier presents to
the general public with respect to beach and water access on and around your pier, and the pier is
in violation of the pier permit conditions.
On April 6, 2006, Mike Ure of Harbor Resources Division, inspected your pier and found the
structure be in violation of the City of Newport Beach Municipal Code Chapter 17.28.020,
Harbor Permit Policies, and the Design Criteria and Standard Drawings for Harbor Construction.
He found:
The gangway and pier appear to be in minor disrepair. However, the float and north
finger are not structurally sound or safe to walk on. The north finger appears to be
broken in the middle, deck boards are broken, sagging, and the fascia board & rub rail
are hanging in the water (see attached photo).
Newport Beach Municipal Code (NBMC) 17.24.0 10 requires a permit for building and
maintaining a pier. NBMC 17.24.090A provides that the permit may be revoked upon grounds
that:
I "The work or structure has become detrimental to commerce, navigation or fishing;"
Harbor Resources believes the float or pier might break away during storm conditions
and cause damage or become an obstacle to vessels traveling in the channel.
2. "The work or structure does not comply with the permit or does not meet the standards
adopted by the Harbor Commission for such work or structure;"
3. "The work or structure has fallen into a state of disrepair;" Harbor Resources believes
the pier is presently in a state of disrepair.
4. "The space occupied by such work or structure is over publicly owned land'and such
space is to be devoted to a public use." The pier is over a publicly owned and accessible
beach on Balboa Island. Harbor Resources feels the pier structure- presents a danger to
the public, thereby inhibiting safe public access.
Based �pon the inspection and photo, Harbor Resources believes the pier to be in a state of
disrepair in a manner inconsistent with the NBMC and the permit.
A courtesy phone call was made, and Mike spoke to Mrs. Hurray asking for compliance within
30 days prior to sending this letter. Since there has been no response, Harbor Resources
intends to pursue revocation of the pier permit within 30 Days, unless the permittee can
provide evidence to Harbor Resources that repairs and renovation are actively being perused.
This letter was sent via regular first class mail.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0154-0113-1 for the property located at 113
East Bay Front, Newport Beach, CA. The facility was inspected on
April 25, 1995.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no longer
an approved backflow prevention device. This requirement is in
accordance with Title 17 of the California Administrative Code.
2. The electrical receptacles must be either GfI or twist lock for
use in a water environment.
A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the. time of transfer, all harbor structures
shall be inspected for compliance with the City Is minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit.11
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN

Dear Mr. Melum:
Reference is made to your letter (No. 94 -380 -BH) dated
January 26, 1994 in which you submitted on behalf of Delmar
Pinckney at 113 E. Bay Front a notification for the maintenance
dredging of 125 cubic yards of sand and silt material by
hydraulic suction and disposal of the dredged material by
pipeline transport to a beach reclamation area.
Based on the furnished information, we have determined that
the proposed maintenance dredging activity complies with the
terms and conditions of Permit No. 89 -211 -GS provided that Mr.
Pinckney's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1
foot MLLW.

Recommendation
If desired-, approve the maintenance dredging applications.
Discussion
The application requires City*,Council approval under the conditions of approval
placed on the City of Newport Beach general permit for maintenance dredging
issued by the U. S..Army Corps of Engineers,*on February 12, 1974, and subsequently
amended on May 10, 1977 to allow beach restoration. The locations and applicants
for the proposed dredging and beach restorations are:
112-405 Burnetta Cassel, 405 Edgewater
154-113 Del M. Pinkney, 113 E. Bay Front, Balboa
110-1114 J. R. Bahan, 1114 E. Balbo.a Blvd.
The staff has reviewed the projects and has determined that the work wi , 111 be
done within the parameters of the Corps of Engineers permit. The dredgiing
contractor will place a filter screen around thie discharge site to coni -,roll
turbidity. There is no known eel grass in the vicinity of the projects.
All dredged material will be placed on adjacenil- beaches. *This will aide, in
the restoration of beaches bayward of private residences.

Gentlemen:
The enclosed permit drawing application(s) is being sent for your
information in accordance with conditions of approval under the
U.S. Army Corps of Engineers "blanket" pe,,-;,,iit for maintenance dredging.
This "blanket" permit was issued to tjqe City of Newport Beach on
February 12, 1974, and subsequently amendlod on May 10, 1977 to al-101vi
beach restoration.
As required by this permit, the Marine Department has inspected 'Ch---',
dredging site and found no eel grass within or near the project.
The City Council of Newport Beach will hear the -application at its
