Re: Maintenance Dredging and Beach Restoration on East Bay Front
Dear Mr. Honig:
The City of Newport Beach does periodic beach replenishment dredging on
Balboa Island to buttress City bulkheads and to restore bay beaches. Your area
has been identified by the homeowners association as one that needs dredging
and we are currently scheduled to do this project the week of May 12. In
conversation with the contractor, he will be there by May 13, but could begin on
May 12.
In order for this to be accomplished, it will be necessary for you to temporarily
relocate your vessel during this dredging project until May 17. If you have no
place to put the vessel, please let us know and we will let the O.C. Harbor Patrol
provide an off shore mooring for you.

(Sec. 7031d.5, Business and professions Code). Any City or County which requires a pern-dt to
construct, alter, improve, demolish, or repair any structure, prior to its issuance, also requires

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit application for the
development described below, the Executive Director of the Coastal Commission hereby
waives the requirement for a Coastal Development Permit pursuant to Section 13238.1, Title
14, California Code of Regulations. If, at a later date, this information is found to be incorrect
or the plans revised, this decision will become invalid; and, any development occurring must
cease until a coastal development permit is obtained or any discrepancy is resolved in writing.

LOCATION: 125 E. Bayfront, Balboa Island (Newport Beach), Orange County
PROPOSED DEVELOPMENT: Revise existing boat dock by replacing an existing 7 by 21 foot
float with a 23 by 4 foot float with an 8 by 7 foot lobe at the landward end. No work is
proposed to the existing pier with platform and the existing gangway.
RATIONALE: The proposed lobe area will not require additional pilings beyond the number
necessary to support the dock without the lobe area. No eelgrass is present at the project
site. In addition, the proposed development will not adversely impact coastal resources,
public access, or public recreational opportunities, and is consistent with the City's certified
Land Use Plan, past Commission actions in the area, and the Chapter 3 policies of the Coastal
Act.
This waiver will not become effective until reported to the Commission at their April 13-16,
1999 meeting and the site of the proposed development has been appropriately noticed,
pursuant to 13054(b) of the California Code of Regulations. The enclosed Notice Card shall
remain posted at the site until the waiver has been validated and no less than seven days prior
to the Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

As the buyers of 125 E. Bayfront, Balboa Island, we have received copies of your letter dated
March 4 regarding the repairs that need to be couipleted to the pier at 125 E, Bayfront in order to
traTlSfeT the pier permit for this property, Because we are in the process of obtaining final
approval to reconfigure the floaL, we would like to.have the opportunity to transfer the use permit
for this pier at the close. of escrow Tiow scheduled, fOT April 8, 1999. We received approval in
concept from the City of Newport Beach on January 14, 1999 to reconfigure the float and are
now awaiting the -final permit from the Coastal Commission. After receiving this filial Permit,
we have all intentions and hereby commit to totally replace the float, install the City approved
anti-siplion device, install GFI on the electrical receptacles on the pier and ensure that there are
rollers on the piling hangers (as we will be also replacing the pilings).
We would appreciate being able to have all the above required repairs done concurrently with the
float replacement. In addition to the above work, it lis our intention to have the ramp replaced as
it is currently in a somewhat deteriorated and unsafe condition.

The City of Newport Beach Fire and Marine Department has received a request to
transfer pier permit 15401232 for the above-mentioned property. The facility was re-
inspected on March 4, 1999. We cannot transfer the pier permit until the following
deficiency hasihave been corrected and we have been notified of the corrections:
1 . A City -approved anti -syphon device is required at the water connection for the water
to the pier and float. A sketch showing the approved type of device and its installation
is enclosed. This requirement is in accordance with Title 17 of the California
Administrative Code. The State of California Department of Health no longer accepts
the device that is currently on the water line.
2. All electrical receptacles on the pier must be GF1.
3. Most of the decking on the float must be replaced.
4. There should be rollers on the piling hangers.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

Dear Sir:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0154-0123-2 for the property located at 125
E. Bay Front, Newport Beach, CA. The facility was inspected on
2/16/94.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
A City Approved Backflow Prevention Device (Anti -Syphon Device)
must be installed downstream of the water meter, landward of the
bulkhead or high tide line. Please refer to attached.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN TH * E ABOVE DEFICIENCY HAS BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirement has been met the pier permit
will he transferred. Included in requirements for transfer of the
pier permit is the $300 transfer fee and the signed transfer card.

Dear Mr. Twitchell:
In December 1991 the City of Newport Beach received your request to
transfer a joint pier bayward of 123 and 125 East Bay Front. The
inspection of the subject property, as required by the Municipal
Code, indicated that no required anti -syphon device was in place at
the pier. In December of 1991 we corresponded with you indicating
we were prepared to transfer the permit but that the City approved
anti syphon device was required. In January, 1992 we received the
transfer card properly signed by the two joint permittees, you and
Mr. Ingles, to transfer the permit to James F. Dean. This address
was 18 August Drive, Rancho Mirage, CA 92770, telephonbe 619-321-
8004.
Because the necessary work for the anti -syphon device was. never
completed, as far as we know, the permit has transferred as of this
date and is still in the name of Twitchell and Ingles. based on
your letter of this date we will make another inspection of the
property and if the correct anti -syphon device has been properly
installed we will transfer the pier permit to Mr. Dean.

Dear Sir:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0154-0123 for the property located at 123
East Bay Front, Newport Beach, CA. The facility was inspected on
12/17/91.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed.
The Newport Beach City Council Harbor Permit Policies state:
10. D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requiremenmts, and
the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer -of the
permit."
A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred. Included in requirements for transfer of the
pier permit is the $300 transfer fee and the signed transfer card.

Honorable Councilmen:
We regret to bring this matter before the City Counci I, for we prefer to
handle neighborhood problems quietly and amicably. The problem concerns the docking
rights between 125 and 127 East Bay Front on Little Balboa Island. The present owner of
127, Glenn Lewis, has docked a Coronado 35 on the south side of the dock. In this po-
sition, a major part of the boat encroaches on our property. Since September, 1975, we
have attempted to resolve the problem through discussions with the Lewises and through
meetings with the Marine Department of Newport Beach. However, despite our efforts,
the boat remains as an encroachment on our property.
Below, we have summarized the meetings and discussions which have
taken place over the last seventeen months.
We had discussed the matter of boat encroachment with the former owners
at 127 East Bay Front, Mr. Loui Ihrig. Mr. Ihrig formerly docked a small runabout on the
south side, finally had a Coronado 35 docked on the south side. An agreement was made
with Mr. Ihrig that the Coronado 35 could remain temporarily, but that when its owner moved
it, no other boat would be docked there. This concession was on our part, perhaps more I ib-
eral than it should have been, and was an attempt to maintain good relations with our neighbor.
However, the sale of the property completely changed this picture as far as we were concerned.
While the property was still in escrow, we asked Mr. lhrig, the former owner, if the Lewises
had been notified of the dock situation and of the status of the Coronado 35. Mr. Ihrig
assured me that the Lewises had been advised and were fully cognizant of the dock's limita-
tions.
On November 1. 1976, a meeting was arranged among the Lewises, Mr.
Glen Welden of the Marine Department and ourselves. At this meeting Mr. Welden reviewed
the general policies of the City of Newport Beach regarding the use of the piers. In particular,
he noted that boats must be docked within the extension of the owner's property lines and must
not encroach on adjoining properties.
On November 16, 1976, Mr. Glen Lewis indicated that he would dis-
cuss the status of the encroaching boat with Mr. Bleeker, the boat's owner. On December
6, 1976, we inquired of Mr. Lewis as to the progress in disposition of the encroaching boat.
Mr. Lewis would make no commitment. Further informal approach to Mr. Lewis was made
on January 9 of this year. Mr. Lewis indicated that he had been "too busy" to do anything
about the problem.
On January 25, Mr. Lewis saw me relative to moving the Coronado
35, indicating that he had met with city officials and that the boat would have to be moved.

No date for its moving was established at that time, however. We then dropped a note
to the Lewises, indicating that the moving should be concluded by the middle of the
month - February 15th.
On Saturday, February 12, Mr. Lewis indicated to me that it would
be impossible to move the boat, since dredging on the north portion of his dock could not
be done for 60 days - due to commitment of Shel [maker Dredging to other projects in West
Newport.
On February 17, 1 talked to Mr. Harshbarger of the Marine Department.
He indicated that he had contacted the Lewises and that the boat would be moved Sunday,
February 20. The boat was not moved.
in accordance with the stated policy of the Marine Department of the
City of Newport Beach, we feel it is incumbent upon the Lewises to vacate the encroached
space as soon as possible. Their apparent reluctance to have Mr. Bleeker remove his boat
from the encroached space cannot be understood or accepted.

Discussion
These applications require City Council approval under the conditions
Of approval of the City of Newport Beach "blanket" permit for main-
tenance dredging issued on February 12, 1974, by the U. S. Army
Corps of Engineers.
The location and applicants for the proposed maintenance dredging are:

The staff has reviewed the proposed dredging and has determined that

permit. There is no anticipated adverse affect on proximity beaches
or contiguous bulkheads.
Shellmaker, Inc., the dredging contractor, will minimize turbidity
as much as is possible and will barge the dredged material to the
Environmental Protection Agency's designated disposal site, four
miles at -sea.

and approval of the City Engineer. On work which requires the presence
of an employee of the City of Newport Beach as inspector, the salary and
other incidental expense of such inspection during the�work shall be paid
by the Permittee upon, presentation of a bill therefore.
6. Protection of Traffic: Adequate provisions shall be made
for the proteJ_ion of thei,travelling public. Barricades shall be placed
on streets, with red lights at night, also flagmen employed, all as may
be required by the parti'c'ular work in progress.
The Permittee shall not attempt,to forbid the full And free
use by the public of all navigable waters ator' adjacent to the work or
struatw�e. If the display of lights and signals on any work hereby auth-
orized is not otherwise provided by law$ such lights and.signals, as may
be prescribed by Bureau of Light Houses.,.Department of�Commarce, shall be
installed.and maintained at the expense of the Permittee.
7. Liability for Damagess. The Permittee is:responsible for all
liability for' -personal injury or property damage which may occur through
work herein permitted, and in the event any claim is made against the City
of Newport Beach or any department, officer or employee thereof, through,.
by reason of, or in connection with such work, Pormittee shal.1 defend,
indemnify and,hold them, and each of them., harmless from such claim. This
Permit shall not be effective for any purpose unless and until the above
named Permittee files with the City of Newport Beach, a surety bond in the

PLEASURE PIERS
1. The City of Newport Beach shall never be held liable or
obligated for any injury or damage resulting to either persons or
property through -the erection, use or possession of, private piers.
2. The pier shall be so constructed as not to obstruct,, ,
interfere with, or prevent the free use or passage of any sidewalks',
street, alley, public way or navigable channel.
3, The right given for the erection and maintenance of a
pier is permissive only and the Plermittee shall, upon revocation
hereof, remove said pier and appurtenances thereto, within thirty (30)
days after date of mailing writtenhotice of the revocation of this
permit., which notice may be mailed to the last known address of the
Permittee.
4. The City of Newport Beach reserves full right, power
and authority to revoke this permit, and in the event the Permittee
fails to remove said pier within the time specified, then the City
Engineer shall have the rightto immediately remove same at the cost
and expense of the Permittee.
5. Pleasure piers shall be constructed in accordance with
Standard Plan No. for Pleasure Piers, adopted by the City
Counoil. Painting of Piers shall be designated by the City Engineer.
6. The Permittee shall keep the pier in good repair at all
times and shall paint the pier when required to do so. Failure to
repair or paint pier, when written notice has been given by the City
Engineer, shall be cause for revocation of the permit and removal of
the pier.
7. The pier to be constructed herein, shall not be sold$
leased, sublet or transferred, without the prior written consent of
the City.

the property at 123-125 E. Bay Front, Balboa Island., California.
For the sum of $1310.00 -wre would be able to furnish all labor., equipment and
materials to construct a pier to the following specifications:
Pier 1prill be 41 -v,!ide and approximately 48t long with a 12'xl-21 landing on the
outer end. The walkway and landing will be set on Tee head concrete piling. All
concrete piling will be 3000 psi mix reinforced with four 3/4" steel bars tied to

Mr. Meyer and I are unable to come to an
agreement on price for a one-half interest in
his pier. It is requested that a price be
fixed in accordance with the applicable regu-
lations of your City Council.
You may find the enclosed copies of cor-
respondence with Mr. Meyer and others of some
interest.
Establishment of the original cost of the
pier, it now develops, is impossible. All
three of the bids which I obtained of the pres-
ent day replacement cost of the pier; namely,
$1150.1 $1310, and $1344 are less than the origi-
nal cost figure stated in my January 27, 1955
letter which was in error. I trust that every-
one would agree that the original cost in 1944
is less than these amounts.
Croft & Neville, Inc., estimate the life
expectancy of the pier as thirty years.

In our last discussion you referred to replacement
costs of the pier. You may be interested in the attached
copy of letter received from the firr. Croft & Neville, Inc.
which states that replacement oosts are $1310 and the life
expectancy of the pier is 30 years.
Mr. Derby of the firm Gill'is & Derby looked at the
pier on 4141'arch 6 and stated that he -would build such a pier
for $1150. The firm. Trautwein Bros. has a standard price
0.41 $4.00 a square foot to construct a pier of this type.

The average of the above figures is $1268. As these
are less than the figure 'r gave in my letter to you dated
February 24, 1955, IT rechecked with the builder of the
present pier and found that his data were incorrect. His
figure includes more than just the pier. It now develops
that his records do not permit him to segregate the cost
of the Dier.
I assume that there would be unanimous agreement that
the original cost in 1944 was less than the above figures.
Therefore a one-half interest on the original cost depreci-
ated basis would be somewhat less than stated in my February
letter.
I would sincerely appreciate your cooperation to con -
elude this.matter at an earIv date in order that I may pro-
ceed with the installation o�, our f�oat.

In a conversation last Tuesday with Mr. J. B. Webb,
City Engineer of Newport Beach,�he mentioned that you called on
him recently concerning the pier on East Bay. Mr. Webb told me
that we should, if possible, agree upon the amount you are to
receive -for a one-half interest�in the pier.
In my review of the matter starting several months ago
I ascertained from the builder of the pier the original cost and
rate of depreciation. The pier was built in December, 1944, cost
$1,360.87, and is considered to�have a normal life of thirty
years. This amount does not include the float. It would be my
imoression that the spirit of the City Council's regulations
adopted in 1941 is to use original cost depreciated as the basis
for fixing the consideration to be paid the original owner. The
pier is maintained on public property pursuant to the terms of a
revocable permit, and I believe it should not be considered as
an investment on which a profit should be taken, but as a con-
venience. If today's costs were lower than when the pier was
built, I believe the original owner would undoubtedly maintain
that original cost depreciated would be a proper basis. My calcu-
lation, using the above factors, indicates that a half interest

should be valued at $454.00.
With resDect to the float - I would be very happy to
discuss with you the possibility of sharing the existing facility
if you deem it desirable in order to prevent additional cost at
this time to bringit into agreement with the City permit. I
would consider it proper, however, to have an agreement between
us respecting the modification of the float structure to comply
with the City permit at such time as the City might order the
change or either of us or our assigns should desire to have it

Dear Mr. Webb:
As I mentioned to you last evening over the phone, the
new owner of the property at 123 East Bay -Front is Mr. H. Joe
Meyer. He lives at 1260 Lago Vista Drive, Beverly Hills - tele-
phone, CR 6-8769.
I called at their house last Saturday about 1 p.m. and
found that Mr. Meyer had just left for Anaheim. I asked Mrs.
Meyer if the real estate broker had informed them of my applica-
tion for an interest in the pier and she answered affirmatively.
She stated that they were not interested, however, in disposing
of an interest in the pier. I then proceeded to relate what the
permit provision is and suggested that her husband and I get to-
gether and attempt to negotiate the matter.
I finally met Mr. Meyer in front of our properties on
Sunday morning. He appeared to be considerably shocked at my re-
quest but agreed that the information I had given Mrs. Meyer
seemed to be correct. He stated that Mr. Felton told him that the
pier and float were private and that he need not -worry about any
provisions of the permit because Mrs. Roberts, former owner of the
125 East Bay Front property, had been given an opportunity to exer-
cise her option some time ago and had forfeited it.
Mr. Meyer was exceedingly courteous and appeared to be

I asked him if he knew whether an application had been
filed with the city to have the permit on the pier and float trans-
ferred to his name. He stated that he thought such application had
been filed by now. Incidentally, in talking to Mrs. Meyer the
previous day she stated that she understood that this application
was filed on Friday.

called on me stating that she made no representations to Mr. Meyer
concerning ownership of the pier. During our conversation, however,
Mrs. Bray did remark that the INTar Department required Mr. Felton to
ask Mrs. Roberts if she desired to have an interest in the pier and
the float before the War Department would issue its permit a few
years ago.
Mr. Meyer stated that he desired a private pier because he
wanted boat mooring facilities for both the residence and the apart-
ment. He stated that there didn't seem to be any possibility of
mooring four boats at this location. I explained that it never was
intended that more than two boats be moored at one pier. I pointed
to the two piers southerly of this one to illustrate the separate
float construction that is supposed to be at the pier in question.
Before concluding our conversation I asked Mr. Meyer if he
would check into the matter with you at an early date. He stated
that he intended to check into the case but related that he will be
exceptionally busy during the next few weeks and didn't know when
he could get at it. I hope I am wrong but I take this remark to
intimate that he intends to stall. Perhaps you might like to con-
sider mailing him an application form and explain in a letter the
provisions of the permit and the regulations.

Beach on the 15th day of December, 1941 and pursuant to the provi-
sions of the above-mentioned permits.
As a possible aid to ' your City Council in the fixing of the
amount to be paid for the account of the owner of Lot 16, 1 have as-
certained from Mr. W. J. Neville, 236 Broadway, Costa Mesa, who con-
structed the pier in question, that it cost $1,360.87. Mr. V. J.
Swanson, General Manager of Croft and Neville, Inc., has informed me
that the estimated normal life of such a pier would be 30 years.
Therefore the subject pier has about two-thirds of its original life
remaining.
While I do not feel that reproduction cost is a proper
basis to use in fixing the amount to be paid, I did ascertain from
Mr. Swanson that it would cost about $2,000 to build such a pier
today. I believe that original cost, depreciated, is the equitable
basis for deriving the amount to be paid for the prescribed interest
in this pier. If prices today were less than in 1944, 1 am sure
that the other party would request payment on the original cost,
depreciated, basis.

General Provisions:
1. Acceptanceof Provisionst It is understood and agreed by the
Permittee that the doing of any work under this permit shall constitute an
acceptance of the provisions.
2. Pe --mat from Other Agenciess The party or parties to whom this
permit is issued shall, whenever the same is required by law, seoure the
written order or consent to any work hereunder from the War Department of

the United States or any other publio-body-baving juriadiction, and this
permit shall be suspended in operatioz unless. and -until such order or
consent is obtained,
3. Transferring Permit: This permit is not transferable with-
out the written consent of the City Council of the City of Newport Beach.
4. Notice Prior to StartIng Workt The Permittee shall notify
the City Engineer at least three (3) days in advance of the date work is
to begin and its completion.
5. ins�ectioni The work shall be subject to the supervision
and approval of the City Engineer. On work which requires the presence
of an employee of the City of Newport Beach as inspector, the salary and
other incidental expense of such inspection during the work shall be paid
by the Permittee upon presentation of a bill therefore.
6* Protection of Traffic: Adequate provisions shall be made
for the protectioH of the travelling public. Barricades shall be placed
on streets, with red lights at night, also flagmen employed, all as may
be required by the particularlvrork in progress.
The PerTdttee shall not attempt to forbid the full and free
use by the public of all navigable waters at or adjacent to the work or
structure., If the display of lights and signals on any work hereby auth-
orized is not otherwise provided by law, such lights and signals, as may
be prescribed by Bureau of Light Houses, Department of Commerce, shall be
installed and maintained at the expense of the Permittee.
7. Liability for Damages-, The Fermitt-ce is responsible for all
liability for'parsonal injury or property damage which may occur through
work herein permitted, and in the event, any claim is made against the City
of Newport Beach or any department, officer or employee thereof, through,
by reason of, or in connection with such work, Permittee shall defend,
indemnify and hold them, and each of them, harmless from such claim. This
Permit shall not be effective for any purpose unless and until the above
named Permitteo'files with the City of Newport Beach, a surety bond in the
.form and amount required by the sUnd City, unless specifically exempted on

PLEASURE PIERS
1. The City of Newport Beach shall never be held liable or
obligated for any injury or damage resulting to either persons or
property through the erection, 'use or possession of$ private piers.
2. The pier shall be so constructed as not to obstruct,
interfere with, or prevent the free use or passage of any sidewalks,
street, alley, public way or navigable channel,
3. The right given for the erection and maintenance of a
pier is permissive only and the Permittee shall, upon revocation
hereof, remove said pier and appurtenances thereto, within thirty (30)
days after date of mailing written notice of the revocation of this
permit, which notice may be mailed to the last known address of the
Permittee.
4. The City of Newport Beach reserves full right, power
and authority to revoke this permit, and in the event the Permittee
fails to remove said pier -within the time specified,, then the City
Engineer shall have the right to immediately remove same at the cost
and expense of the Permittee,
5. Pleasure piers shall be constructed in accordance with
Standard Plan No. for Pleasure Piers,, adopted by the City
CoUnGil. Painting of Piers shall be designated by the City Engineer.
6. The Permittee shall keep the pier in good repair at all
times and shall paint the pier when required to do so. Failure to
repair or paint pier, when written notice has been given by the City
Engineer, shall be cause for revocation of the permit and removal of
the pier.
7. The pier to be constructed herein, shall not be sold.,
leased J sublet or transferred, without the prior 1prritten consent of
the City.
