Box 1768 Newport Beach, CA 92659-1768 Re: Bay Island Marine Inspection Dear Wes: In talking it over with our president, Bob Emett, we feel we would rather go for the first alternative for inspection of the docks, that is pay the $300 fee every other year for a com- plete inspection. There are two reasons for this. Unlike a normal property transaction where there is an es- crow and the dock permit must be transferred to the new owner, we have no proper "triggering" mechanism here on our island. Board members change, transfers sometimes occur intra -family, and we really have trouble visualizing how we would know and who would know to tell the Marine Department. Another factor is that many of the slips are arranged in groups but are still separately maintained. We feel that your overall inspection on a regular basis not activated by unpredictable real estate event4would create a much more orderly schedule reviewing our docks and notifying members of any needed repairs. When you are ready to set an appointment you can give me a call or contact Jimmy Anderson direct at 675-4629. Thank a lot for your interest, Wes. Very -sincerely yours, igson cc: Robert Emett CITY OF NEWPORT BEACH MARINE DEPARTMENT January 21, 1980 H-13 TO: MAYOR AND.CITY COUNCIL ITEM NO.. BOX 627, LA CANADA RECOMMENDATION: THAT THE APPLICATION BE APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. THAT THE SLIP BE.MOVED 3 FEET NORTHERLY SO T14AT IT WILL CONFORM TO THE 5 FOOT SETBACK REQUIREMENT. 2. THAT NO BOATS BE MOORED OUTSIDE THE SLIP. D13CUS31ON: PRIOR APPROVAL OF THE CITY COUNCIL IS REQUIRED BECAUSE THE APPLICATION DOES NOT CONFORM TO THE ADOPTED HARBOR PERMIT FOL lCiES IN THAT THE APPLICATION DRAWING SHOWS A SIDE SETBACK OF ONLY 2 FEET ON THE SOUTHERLY SIDE. THE EXISTING LANDING IS ALSO 35 FEET LONG., EXCEEDING THE 14 FOOT LENGTH PERMITTED ON THE STANDARD DRAWINGS. ACCORDING TO THE SKETCH SUBMITTED THIS PORTION OF STRUCTURE DOES NOT APPEAR TO BE ON TIDELANDSo THE REASON GIVEN FOR CROWDING THE PROLONGATION OF'THE PROPERTY LINE IS THAT ALL OF THE PROPERTY ON BAY ISLAND IS OWNED BY THE BAY ISLAND CLUB, AND IT IS INTENDED TO LIMIT THE NUMBER OF PIERS IN ORDER TO PRESERVE THE OPEN FEELING- IT IS PLANNED THAT WHEN T'HE ADJOINING PROPERTY OWNERS REQUIRE BOAT SLIPS THEY WtLL APPLY FOR 'JOINT OWWER-5HIP PERMITS AND ATTACH THEIR FINGER SLIPS TO THE OUTSIDE OF THE EXISTING SMITH FLOAT. At,thelast regular meeting of the . Board of Directors of Bay Island Club, a. motion 'was duly made and carried to allow you to bring your slip up to standard size, being 50 feet long by 17 feet wide. Included in this motion was.the understanding that, ifs in the future, houses, Number 6 and Number 8 desired to attach a slip to your pier, that you -would be agreeable. Of course, 'it was further understood that the occupants of both Number 6 and Number 8 would have to work out an equitable arrangement with you on shAringthe cost of your pier, The, -Board added the above arrangement to the motion. in order to keep the beach. on the east side of the island as uncluttered as possible. I saw. Curtis the other day when he was working on his boat and: he said he was about ready to enlarge the slip. You can give him a copy of this to pass on to,the pier contractors. FEBRUARY 14. 1967 T06- CITY COUNCIL -FROM: PUBLIC WORKS DIRECTOR .SUBJECT: HARBOR PERMIT -APPLICATION NO. A-1485 APPLICATION TO: ADD A SLIP TO THE EXISTING FLOAT BAYWARD OF LOT 7, BAY ISLAND APPLICANT: HUGH SUTHERLAND IV f8 BAY ISLAND NEWPORT BEACH., CALIFORNIA RECOMMENDATION: DISCUSSION: THAT SUBJECT APPLICATION BE APPROVED. THE PRIOR APPROVAL OF THE CITY COUNCIL IS REQUIRED BECAUSE: 1. MORE THAN ONE SLIP OR FLOAT IS REQUESTED BAYWARD OF A SINGLE PARCEL - 2. THE ADOPTED HARBOR PERMIT POLICIES PROVIDE THAT JOINT OWNERSHIP PIERS MUST BE AT THE PROLONGATION OF THE COMMON LOT LINE. IN THIS APPLICATION IT IS DESIRED TO ADD AN A.DDITIONAL SLIP TO AN EXISTING CONFORMING PIER AND FLOAT, THUS CREATING A NON-STANDARD JOINT OWNERSHIP PIER AND FLOAT NOT LOCATED ON THE PROLONGATION OF THE COMMON LOT LINE. HOWEVER, ON BAY ISLAND THE PROPERTY LOCATED BETWEEN THE INDIVIDUAL LOTS AND THE PIER IS A SINGLE BEACH PARCEL OWNED BY THE BAY ISLAND CLUB AND USED BY ALL. THEREFORE THERE IS NO PROBLEM OF ACCESS TO THE PIER FOR MR. SUTHERLAND. THAT THE SLIP BE,.MOVED 3 FEET 14ORTHERLY SO THAT IT WILL CONFORM TO THE 5 FOOT SETBACK REQUIREMENT* 2. THAT NO BOATS BE MOORED OUTSIDE THE SI IP. DISCUSSION: PRIOR APPROVAL OF THE CITY COUNCIL IS REQUIRED BECAUSE THE APPLICATION DOES NOT CONFORM TO THE ADOPTED HARBOR PERM,IT FOL ICIES IN THAT THE APPLICATION DRAWING SHOWS A SIDE SETBACK OF ONLY 2 FEET ON THE SOUTHERLY SIDE. THE EXISTING LANDING IS ALSO 35 FEET LONG, EXCEEDING THE 14 FOOT LENGTH PERMITTED ON THE STANDARD DRAWINGS. ACCORDING TO THE SKETCH SUBMITTED THIS PORTION OF STRUCTURE DOES NOT APPEAR TO BE ON TIDELANDS. THE REASON GIVEN FOR CROWDING THE PROLONGATION Or THE PROPERTY LINE IS THAT ALL OF THE PROPERTY ON BAY ISLAND IS OWNED BY THE BAY ISLAND CLUB, AND IT IS INTENDED TO LIMIT THE NUMBER OF PIERS IN ORDER TO PRESERVE THE OPEN FEELING- IT IS PLANNED THAT WHEN T"HE ADJOINING PROPERTY OWNERS REQUIRE BOAT SLIPS THEY WILL APPLY FOR JOINT OWNER-5HIP PERMITS AND ATTACH THEIR FINGER SLIPS TO THE OUTSIDE OF THE EXISTING' SMITH FLOAT.
