Re: Bay Island Marine Inspection
Dear Wes:
In talking it over with our president, Bob Emett, we feel
we would rather go for the first alternative for inspection of
the docks, that is pay the $300 fee every other year for a com-
plete inspection. There are two reasons for this.
Unlike a normal property transaction where there is an es-
crow and the dock permit must be transferred to the new owner, we
have no proper "triggering" mechanism here on our island. Board
members change, transfers sometimes occur intra -family, and we
really have trouble visualizing how we would know and who would
know to tell the Marine Department.
Another factor is that many of the slips are arranged in
groups but are still separately maintained. We feel that your
overall inspection on a regular basis not activated by
unpredictable real estate event4would create a much more orderly
schedule reviewing our docks and notifying members of any needed
repairs.

Recommendation
if desired, approve the maintenance dredging applications.
Discussion
The applications require City Council approval under the conditions of
approval.placed on the City of Newport Beach general permit for maintenance
dredging issued by the U.S. Army Corps of Engineers, on February 12, 19,74,
and subsequently amended on May 10, 1977 to allow beach restoration. The
locations and applicants for the proposed dredging and beach restorations
are:
164-19 Bay Island Club #19 Bay Island
161-7 Bay Island,Club #7 Bay Island
152-331 Hargraves Property 331 East Bayfront
110-1114 J. R. Bahan 1114 E. Balboa Blvd.
109-1701 Gingerlee Fields 1701 East Bay Avenue
The staff has reviewed the projects and has determined that the work will
be done within the parameters of the Corps of Engineers permit. The.
dredging contractor will place a filter screen around the discharge site
to control turbidity. There is no known eel grass in the vicinity of the.
projects.
All dredged material will be placed on adjacent beaches. This willaid
in the restoration of beaches bayward of private residences.

Commission staff have received information submitted as evidence of compliance with Coastal
Development Permit 5-99-282 and/or as evidence of conformance with Consistency Certification
CC -078-99 for the following sites in the City of Newport Beach:
Commission staff have reviewed the information submitted and determined that the above
referenced dredging event conforms with Consistency Certification CC -078-99 and that no further
federal consistency review is necessary from the Commission for the dredging component of the
project. In addition, the proposed beach disposal has been reviewed and found by the Executive
Director to be consistent with Special Conditions 1, 2, and 3 of Coastal Development Permit 5-99-
282. No further review is necessary from the Commission for the beach disposal component of
the project.
Please be advised that only the project described in the materials submitted for the site listed
above have been found to conform with Consistency Certification CC -078-99 and/or conform with
the terms and conditions of Coastal Development Permit 5-99-282. Any change in the project may
cause it to lose its status as consistent with CC -078-99 and/or CDP 5-99-282. This certification is
based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring
at that time must cease until a new determination regarding conformance with CC -078-99 and/or
CDP 5-99-282 is obtained.

Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that the Bay Island Club's contractor does not exceed the maximum dredging
design depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

Dear Jim:
The Marine Department has inspected the pr9posed drelge site and
has forwarded the application to all aVencies requiring
notification of,any proposed dredging in the harbor. When this
department receives responses, we will issue the permit.
There is still an obligation of the part of Bay Island Club that
should be taken care of prior to the start of this current
project. The bi-annual inspection of all the piers and docks
within the permit area of Bay Island was done on June 8, 1994,
and the $300 fee for this has not been submitted to date.
The Marine Department would appreciate.this matter being
completed before the issuance of the dredging permit.

Discussion
The applications require City Council ' approval under the conditions of
approval.placed on the City of Newport Beach general permit for maintenance
dredging issued by the U.S. Army Corps of Engineers, on February 12, 1974,
and subsequently 'amended on May 10, 1977 to allow beach restoration. The
locations and applicants� for the proposed dredging and beach restorations
are:

152-331 Hargraves Prop.erty 331 East Bayfront
110-1114 J. R. Bahan 1114 E. Balboa Blvd.

The staff has reviewed the projects and has determined that the work will
be done within the parameters of the Corps of Engineers permit. The ,
dredging contractor will place a filter screen around the discharge site
to control turbidity. There is no known eel grass in the vicinity of the,
projects.
All dredged material will be placed on adjacent beaches. This will aid -
in the restoration of beaches bayward of private residences.

General Provisions:
1. AcceRtance of,Provisionsos It is understood and agreed by the
Permittee that the doing of any work under this permit shall constitute an
acceptance of the provisions.
2. Permit from Other Ag2a2:ies-. The party or parties to whom this
permit is issued shall, whenever the same is required by law., secure the
written order or consent to any work hereunder from the War Department of

the United States or any other publio-body having jurisdiction, and this
permit shall be suspended in operation unless and -until such order or
consent is obtained,
3. Transferring Permit: This permit is not transferable with-
out the written consent of the City Council of the City of Newport Beach.
4. Notice Prior to Starting Work t The Permittee shall notify
the City Engineer at least three (3) days in advance of the date work is
to begin and its completion.
5. Inspection: The work shall be subject to the supervision
and approval of the Ci�y_ Engineer. On work which requires the presence
of ' an employee of the City of Newport Beach as inspector, the salary and
other incidental expense of such inspection during the work shall be paid
by the Permittee upon presentation of a bill therefore.
6. Protection of Traffic: Adequate provisions shall be made
for the protection of the travelling public. Barricades shall be placed
on streets, with red lights at night, also flagmen employed, all as may
be required by the particular work in progress.
The Permittee shall not attempt to forbid the full and free
use by the public'of all navigable waters at or adjacent to the work or
structure. If the display of lights and signals on any work hereby auth-
orized is not otherwise provided by law, such lights and signals, as may
be prescribed by Bureau of Light Houses, Department of Commerce, shall be
installed and maintained at the expense of the Permittee.
7. Liability for Damages: The Permittee is responsible for all
liability for'personal injury or property damage which may occui—through
work herein permitted, and in the event any claim is made against the City
of Newport Beach or any department, officer or employee thereof, throughs
by reason of, or in connection with such work, Permittee shall defend,
indemnify and hold them, and each of them, harmless from such claim. This
Permit shall not be effective'for any purpose unless and until the above
named Permittee files with the City of Newport Beach, a surety bond in the
form and amount required �y the said City, unless specifically exempted on
the face hereof.
8. EMiration of Permit- If the ��ructure or work herein auth-
orized is not completed on or before the �3011 X day of T�p 7- 19,6
this permit, if not previously revoked or speclf1c_�,extendedj shall
cease and be null and void.

PLEASURE PIERS
1. The City of Newport Beach shall never be held liable or
obligated for any injury or damage resulting to either persons or
property through the erection, use or possession of, private piers.
2. The pier shall be so constructed as not to obstruct,
interfere with, or prevent the free use or passage of any sidewalks,
street, alley, public way or navigable channel.
3, The -right given for the erection and maintenance of a
pier is permissive only and the Permittee shall, upon revocation
hereof, remove said pier and appurtenances thereto, within thirty (30)
days after date of mailing written notice of the revocation of this
permit, ipthich notice may be mailed to the last knoiftm address of the
Permittee.
4* The City of Newport Beach reserves full right, power
and authority to revoke this permit, and in the event the Permittee
fails to remove said pier within the time specified, then the City
Engineer shall have the right to immediately remove same at the cost
and expensb of the Permittee.
5. Pleasure piers shall be constructed in accordance with
Standard Plan No. for Pleasure Piers, adopted by the City
Counoil. Painting of Piers shall be designated by the City Engineer.
6. The Permittee shall keep the pier in good repair at all
times and shall paint the pier when required to do so. Failure to
repair or paint pier, when written notice has been given by the City
Engineer, shall be cause for revocation of the permit and removal of
the pier.
7. The pier to be constructed herein) shall not be sold,
leased, sublet or transferred, without the prior written consent of
the"City.

At,thelast regular meeting of the . Board of Directors of Bay Island Club, a.
motion 'was duly made and carried to allow you to bring your slip up to
standard size, being 50 feet long by 17 feet wide. Included in this motion
was.the understanding that, ifs in the future, houses, Number 6 and Number
8 desired to attach a slip to your pier, that you -would be agreeable. Of
course, 'it was further understood that the occupants of both Number 6 and
Number 8 would have to work out an equitable arrangement with you on
shAringthe cost of your pier,
The, -Board added the above arrangement to the motion. in order to keep the
beach. on the east side of the island as uncluttered as possible.
I saw. Curtis the other day when he was working on his boat and: he said he
was about ready to enlarge the slip. You can give him a copy of this to pass

of Croft & Neville, Marine Contractors, requesting that I sign
four copies of your form Application For Harbor Permit.The
Number on this application,is A-1485. In Mr. Swanson's letter
he states that:11the City of Newport Beach requests your signature
as this new construction will constitute a joint ownership
pier permit."
Under an agreement with Mr, Hugh Sutherland IV and
myself, a copy of which is enclosed, there is to be no joint
ownership of the pier or of the common finger between the
slips. The ownership if the pier and the two fingers of the
SJID immediately in front of the pier are to remain the property
of the owner of lot 7 Bay Island. The owner of lot 8 Bay Island
is granted access rights to the slip formed by the addition
wing #A-14859 dated 11/21/66.

Your mother, Mrs. Ethelyn A. Smith, is the owner of the Bay Island
Club share appurtenant to Lot 7. We own the share appurtenant to
the adjoining Lot 8. In accordance with approval by the Club, we
propose to add a boat slip to the pier in front of and now servin'g
Lot 7. For our mutual benefit we suggest that the following serve
as our understanding and agreement with you and your mother in this
regard:
1. Your mother will retain whatever ownership rights she now has
in the existing improvements (pier, etc.), beginning with the
walk at the easterly line of Lot 7 and extending to the easterly
edge of the present float and pier, excepting only that we shall
have the right to enter upon and use the pier and float as
herein provided.
2. We propose and shall have the right to construct and maintain
at our expense a boat slip through the addition of a finger to
the north side of the existing structure, the plan for which
shall be approved by the Club. In this connection we shall
have full right of access to and from the pier and float at
all reasonable times and the right to install and maintain,
also at our expense, electricity, water and other utility lines
and facilities from the pier and from one or more other sources
to or for the benefit of our slip and all boats housed by us
in the slip.
3. In consideration of the foregoing, we agree to reimburse your
mother as follows:
a. One-third (1/3) of all expenses incurred for the maintenance
and repair of the existing pier as such;
4. Except as so provided, each of us shall be responsible for any
damage to the pier, float, fingers and slip caused by us.
For our mutual benefit., each of us agrees to fully cooperate with the
other in the use of the property, rights and interests herein
mentioned, each and all of which are for the benefit of and shall
burden Lots 7 and 8 respectively.
We understand you hold a general power of attorney from your mother
and are authorized to approve and agree to the foregoing on her behalf.
Please indicate such approval and agreement by signing and returning
the copy of this letter to us.

he states that:"The City of Newport Beach requests your signature
as this new construction will constitute a joint ownership
pier permit."
Under an agreement with Mr. Hugh Sutherland IV and
myself, a copy of which is enclosed, there is to be no joint
