Pier Permit Conditions

Property Address: 21 & 22 Bay Island, Newport Beach, CA 92661
With reference to the plans currently under consideration to reconfigure or modify the dock
system, the following conditions will now be in effect on the above referenced pier.
1. The pier permittee is aware of the Harbor Permit Policies and Chapter 17 of the City of
Newport Beach Municipal Code. The pier permittee understands that the above referenced
pier is under the purview of these Policies and Codes.
2. Any future work on the above mentioned pier requires permits with the City of Newport
Beach and any other applicable agencies. Painting, replacement of rub rails and work
considered to be cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the current, proposed dock system
under consideration. Any future modifications or alterations to the dock system may require
new conditions which may override or change these conditions.
4. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. Patio
furniture, plants etc ... are not permitted.
5. On the south side of the southernmost finger that is 33' long, a side tied vessel may not
extend beyond the Pierhead Line. This line is 5'from the tip of this finger and 15'from the
headwalk where this finger begins.
6. A vessel in the southern slip, northern slip and side tied to the north side of the
northernmost finger, will be allowed to extend beyond the end of the slip or finger by the width
of its beam.

A copy of any variance, exception, conditional use permit or other issued permit is

approved tentative tract maps. On the basis of this finding, these plans are approved in
concept and said approval has been written upon said plans, signed and dated.
Should Newport Beach adopt an ordinance deleting, amending or adding to the Zoning
Ordinance or other regulations in any manner that would affect the use of the property or
the design of a project located thereon, this approval in concept shall become null and
void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970, and state and local
guidelines adopted thereunder, this development:
XHas been determined to be ministerial or categorically exempt.
o Has received a final Exemption Declaration or final Negative Declaration (copy
attached).
o Has received a Final Environmental Impact Report (copy attached).
All discretionary approvals legally required of Newport Beach prior to issuance of a
building permit have been given and are final. The development is not subject to
rejection in principal by Newport Beach unless a substantial change is proposed.
This concept approval in no way excuses the applicant from complying with all
applicable policies, ordinances, codes and regulations of Newport Beach. See attached
conditions to the pier permit.

The original single slip was made a joint dock shared by 501 and�.
503 Edgewater. To.more adequately aCcomodate the two residences
the applicants are proposing a revision from a single to a -double
slip.
The existing dock is adjacent -to a relatively narrow navigational
channel. However, navigation is restricted by the- height of the
footbtidge onto Bay island. During the three summer months the
channel is closed to navigation to prevent a conflict between
boats and swimmers on the adjacent public beach.
The Marine Departmenit feels that the revised structure w4-11 have
about the same impact on the Channel as the existing structure.
Notice of the public hearing have been mailed to adjacent
residents and the Bay Island Homeowner's Association.

I was shocked to see the conditions of item 4 7 in your letter of March 12,2004. We
believe we had a meeting of minds during our last meeting and shook hands to a
gentlemen's agreement regarding the subject dock revision with all parties present -
During the last two previous meetings we discussed the necessity of having to
practically "brush" the existing middle finger to enter our dock especially when
there is a strong wind on an outgoing tide when water rushes through like a raging
river. At such time there is no maneuverability and entrance to our slip must me
made on the first sweep. We further advised that the proposed finger closest to the
Bay Island bridge would be a problem that we hopefully would be able to overcome
with the desire to be a good neighbor. During the meeting Chris Fletcher and Larry
Barett then indicated to Ann Brown (co-owner of the dock) and to Mary Ana
Miller and me they would attempt to shorten this extension by six inches to possibly
one foot as their token of cooperation.
A possible boat beam of 19 feet would totally "land lock7 our boat. Anything past 15
feet is unacceptable and will be challenged through every governmental agency
available.

This letter confirms our meeting with. Fletcher regarding changes in their
'dock. It is our understanding that the dock will be changed per the amended
plan and that the angled slip facing our dock will be reduced by a minimum
of six inches and possibly more and the side of the existing slip facing our
property will be removed and no boat moored in that slip will have a beam
exceeding present width of existing slip.
The most important provision of the agreement is the dock permit and the
extension discussed will have a provision the beam of a boat will not exceed
the width discussed above that no boat or object will extend beyond the edge
of the slip extension facing our property. This agreement is to be applicable
to present owner or subsequent owners, tenants or lessees.
Please confirm immediately in writing and also send xne a copy of the actual
permit. .

Gentlemen:
Your letter of April 25, 2003 was viewed for the first time this week. We did not
receive a copy nor did the many other neighbors on Edgewater and Island Avenue
who originally objected to the alteration of the subject dock.
You advised that you did not have any record of the objections previously
expressed. As requested I have attached correspondence verifying previous hearings
and denials on this matter. Also attached is a copy of a letter dated July 31, 2002
from the Harbor Resources Division stating that all property owners within 300 feet
of the proposed work must be notified. None of these owners received any letter
applicable to your present approval and accordingly since your meeting and
approval was not done within the guidelines set by the City Council Permit policy
we request you rescind your approval and if necessary have a hearing at a later
date.
The present "approved" plan creates a more disruptive situation than did the plan
previously submitted and it will totally "land lock" my boat where it has been
berthed for past eighteen years. Please review the attached and advise.

Your application for the Approval In Concept has been denied based on the City of
Newport Beach Municipal Code Section 17.24.050. A2, which specifies that the
application shall be denied if the proposed application is likely to create navigational
congestion, or otherwise interfere with the rights of other harbor permittees within
Newport Harbor, or other oceanfront property owners.
This decision may be appealed to the City Manager by filing a written appeal with the
Office of the City Manager within fourteen (14) days from the notice of the decision. The
City Manager shall consider the appeal and render a decision within fourteen (14) days
from the date of the appeal. A decision by the City Manager may be appealed to the City
Council within fourteen (14) days from the notice of the decision. The City Clerk shall
cause written notice of the time, place and purpose of the City Council hearing to be sent
to the applicant or appellant by certified mail at least fifteen (15) days prior to the date of
the hearing.

correspondence of July 31, 2002 for the following reasons:
1. The drawings are not to a detailed scale as was necessary for our
original plans (copy attached)
2. Currently there is an agreement that no boat may be tied to the
outside of the South slip facing our property. The drawing
submitted indicates approximately a 25 foot encroachment
which would completely lock my boat in its slip.
3. The present south finger facing our property is approximately 40
feet long and not the 25 feet measured on their plans. Was this
extended without a permit?
4. The inner finger of the slip appears to indicate their desire to
extend approximately 25 feet by the color of the desired new
additions, however, the drawing indicates 10 feet. An extension in
this area will inhibit the flow of water into the channel between
Bay Island and the Peninsula. Currently there is a heavy amount
of sludge, especially after a rain when the tides change.
We do not wish to be difficult. As a matter of fact when Doug
Fletcher sought a permit to build his current house we were in
favor and did not sign any objections although encouraged to do
so by other Bay Island residents. We were assured it would not
affect us in any way other than the disruption in front of our
house during construction. The present dock request seems
greedy and will totally block our entry and egress .
Please review and advise your decision regarding this matter as
soon as possible, especially if you consider granting the changes.

As the resident(owner of the property at 503 West Edgewater I have not received
your official notice of the proposed dock revision at 21 & 22 Bay Island. My neighbor,
Len Miller, has informed me of the proposal. We are co-owners of the dock in front
of our homes.
From what I can make out from the very limited and ambiguous proposed extension
it appears that it will greatly impair and infringe on the usage of the boats located on
our dock.
If a large dock is built directly across from our property it will make it very difficult to
get the existing boats in an out. This has never been an area that has encouraged
large vessels as you have around the Bay Club and not only making any
enlargements difficult it will also impair our View and change the atmosphere of the
neighborhood.

The Harbor Resources Division is responsible for issuing the Approval In Concept for
purposed harbor construction that requires approval from the California Coastal
Commission and the U.S. Corps of Engineers. We review the proposed work, receive
comments from adjoining property owners, Homeowners Associations and either approve
or deny the application. We have communicated with your contractor that the approval
from the Association is required and to date have not received any information from the
Bay Island Association except to inforrn us that they have not received your request for
their approval.
Please contact the Bay Island Association as soon as possible to request their review of
the proposed work.
The Harbor Resources Division has received comments from the adjoining property
owners and we await Bay Island Association's response to finish reviewing this

Len Miller was in today. As you recxall he lives directly across from Bay Island next to Randy Brown's (Oppenheimer)
place. Fletcher came over to him to get his support on revising his dock. Fletcher's dock is the one closest to the channel
and we sent him a letter in 2000 letting him know he could'nt berth a vessel on that side tie nearest the channel. Anyhow,
according to Miller, fletcher will be coming in to get an application to do the revision and when that happens he wants to be
notified so he can review the plans and submit comments.

This case result�-6d from the action of the C Council in

revoking a permit to maintain a pier.on Bay Island. The plaintiff,
Mr. Ver Halen, contended that the City Council had acted without
adequate legal grounds in revoking the permit upon the request of
the Bay Island Club which owns the property to which the pier is
attached. The Bay Island Club's position was that the pier was
originally -approved by the C'
ubject to the condition
that if requested to do
ko Mr. Ver Halen"kould allow additional
slips to be attached to his pier to accommodate o,ther residents
of the Island. Ver Halen refused to comply with, this condition,
and the Bay Island Club requested that the-.,city'Council revoke his
pier permit and vest all of the pier permits on the Island "n the
Bay Island Club. We were successful in defending the City
Council's
decision in the trial court. An appeal has been filed by Ver Halen.
Briefs have been filed by all parties and we are.awaiting a date
for oral argument.

General Provisionse
1. Acceptance of Provisionst It is understood and agreed by the
Permittee that the doing of any work under this permit shall constitute an
acceptance of the provisions.
2. Permit from Other Agencies: The party or parties to whom this
permit is issued shall, whenever the same is required by law, secure the
written order or consent to any work hereunder from the War Department of
the United States or any other publicbody-baNing jurisdietion, and this
permit shall be suspended in operationunless and-untilsuch order or
consent is obtained,
3. Transferring Permit: This permit is not transferable with-
out the written consent of the City Council of the City of Newport Beach.
1 4. 'Notice Prior to Starting Work% The Permittee shall notify
the City Engi r at least three (3) days in advance of the date work is
to begin and its completion.
5. Inspectiont The work shall be subject to the supervision
and approval the, City Engineer. On work which requires the presence
of an employee of the City of Newport Beach as inspector� the salary and
other incidental expense of such inspection during the work shall be paid
by the Permittee upon presentation of a bill therefore.
6. Protection of Traffic: Adequate provisions shall be made
for the prote on of the travelling public. Barricades shall be placed
on streets, with red lights at night, also flagmen employed, all as may
be required by the particular ifirork in progress.
The Permittee shall not attempt to forbid the full and free
use by the public of all navigable waters at or adjacent to the work or
structure. If the display of lights and signals on any work hereby auth-
orized is not otherwise provided by law, such lights and signals, as may
be prescribed by Bureau of Light Houses, Department of Commerce) shall be
installed and maintained at the expense of the Permittee.
7. Liability for Damages: The Permittee is responsible for all
liability for'personal injury or property damage which may occur through
work herein permitted, and in the event any claim is made against the City
of Newport Beach or any department, officer'or employee thereof: through,
by reason of, or in connection with such work, Permittee shall defend,
indemnify and hold them, and each of them., harmless from such claim. This
Permit shall not be effective for any purpose unless and until the above
named Permittee fil,-s with the City of Newport Beach, a surety bond in the
form and amount required �y the said City; unless specifically exempted on
the face hereof.
8. ExpirLtion of Permitt If the structure or work herein auth-
orized is not 6-6—mplated on or before the day of 19—$

PLEASURE PIERS
1. The City of Ne�vport Beach shall never be held liable or
obligated for any injury or damage resulting to either persons or
property through the erection, use or Dossession of) private piers.
2. The pier shall be so constructed as not to obstruct,
interfere with, or prevent the free use or passage of any sidewalks,
street, alley, public way or navigable channel,
3*, The right given for the erection and maintenance of a
pier is permissive only and the Permittee shall, upon revocation
hereof, remove said pier and appurtenances thereto, within thirty (30)
days after date of mailing i-uritten notice of the revocation of this
permit., �P.Thich notice may be mailed to the last known address of the
Permittee.
4. The City of Newport Beach reserves full right, power
and authority to revoke this permit, and in the event the Permittee
fails to remove said pier within the time specified, then the City
Engineer shall have the right to immediately remove same at the cost
and expense of the Permittee.
5. Pleasure piers shall be constructed in accordance-�Rrith
Standard Plan No. for Pleasure Piers, adopted by the City
Counail. Painting of Piers shall be designated by the City Engineer,
6. The Permittee shall keep the pier in good repair at all
times and shall paint the pier when required to do so. Failure to
repair or paint pier,-vhen written notice has been given by the City
Engineer, shall be cause for revocation of the permit and removal of
the pier.
7. The pier to be constructed herein, shall not be sold)
leased, sublet or transferred, ijithout the prior written consent of
the City.
