The proposed work would take place at 921 and 925 Via Lido.Sound in Lower Newport Harbor in the City of Newport Beach, Orange County, California (as shown on attached drawing). Based on the information you have provided, the Corps of Engineers has determined that your proposed activity complies with the terms and conditions of Regional General Permit (RGP) No. 54 -Maintenance Dredging, Beach Nourishment, and Dock Maintenance. As long as you comply with the general permit conditions of RGP No. 54 - Maintenance Dredging, Beach Nourishment, and Dock Maintenance, an individual permit is not required. Specifically, you are authorized to: 1. Dredge 214 cubic yards of material from 0.057 acres of Lower Newport Bay using a 6" hydraulic suction dredger\ 2. Place sand along 130 linear feet of beach at 921 and 925 Via Lido Soud -2- A general permit does not grant any property rights or exclusive privileges. Also, it does not authorize any injury to the property or rights of others or authorize interference with any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other Federal, State, or local authorizations required by law. This observation comes from past dredging projects at this site. The dredge itself will not pass anything larger than a 4" sphere. Smaller objects, such as shells and cobble, may be pumped to the beach with the sand where they would be difficult to remove before becoming buried. However, shells are a common component of all bay beaches, Most trash, such as plastics, bottles, and old boat covers, becomes lodged in the intake nozzle and creates a clog. The pumping operation is temporarily stopped while the nozzle is lifted and the debris removed and placed to the side for later disposal. Some smaller trash can pass through the pipeline and be deposited along with the sand on the beach. Being lighter than the sand, most of it tends to wash to the sides of the deposited sand along with the tail -water. After the dredging operation is complete, the beach is generally raked in order to level out high and low areas, and to remove any trash that might be on the beach. In addition, any lighter trash that has washed to the sides of the deposited fill is picked up as the tide drops and properly disposed of. The dock will remain within the U.S. Project Line. RATIONALE: The proposed development consists of the reconfiguration and reconstruction of an existing dock within the U.S. Project Line. The new pier, walkway, gangway and float will be used solely for boating - related purposes. The subject site is located on Lido Island within Newport Harbor in the City of Newport Beach. Vertical public access to the harbor exists via a walkway approximately 10 lots to the north of the subject site. Lido Island, like the majority of islands in Newport Harbor, is surrounded by private recreational boat docks associated with residential development in the immediate vicinity. An inspection performed by the City determined that no eelgrass exists in the vicinity of the proposed project. Therefore, no eelgrass will be affected by the proposed project. Also, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used. The proposed development will not result in adverse impacts to coastal access, coastal resources, public recreation or coastal views. The proposed development would not prejudice the City's ability to prepare a certified Local Coastal Program and is consistent with the land use designation in the City's certified Land Use Plan, past Commission actions in the area and Chapter 3 policies of the Coastal Act.
