Any deviation from the application and plans on file in the Commission office may require a coastal development permit for the entire project. APPLICANT: William Lyon LOCATION: 929 Via Lido Soud, Newport Beach (Orange County) (APN(s) 423-281-14) DESCRIPTION: Demolish an existing boat dock, gangway, pier and pier platform and construct a new boat dock, gangway, pier and pier platform. The proposed dock will be U-shaped (approximately 50 feet long and 20 feet wide) and have three 14 inch diameter guide pilings. The proposed 40 foot long pier and 22 foot long'gangway will be in the same as existing configuration. The existing 10 foot by 14 foot pier platform will be in the same as existing configuration. The existing 10 foot by 14 foot pier platform will be demolished and relocated adjacent to the bulkhead. The proposed pier platform will only be used for boating related purposes. No eelgrass was found in the project vicinity. RATIONALE: The proposed project is located on Lido Isle within Newport Bay. Public vertical access to the bay is available nearby at the end of Via Waziers and public vertical and lateral access is available at the end of Via San Remo. The proposed development is consistent with Section 30233 of the Coastal Act in that the project will result in the fill of coastal waters (i.e. placement of pilings) for a boating facility and the development minimizes the quantity and size of pilings which minimizes the quantity of fill of coastal waters. In addition, an inspection performed by the City determined that no eelgrass exists in the vicinity of proposed project. No eelgrass will be impacted by the proposed project. Therefore, the proposed project is the least environmentally damaging feasible alternative because it minimizes the quantity of fill of coastal waters and avoids impacts to eelgrass. In addition, the Regional Water Quality Control Board has determined that the proposed project will not adversely impact water quality if standard construction methods and materials are used, as proposed. Also, the proposed development does not extend beyond the U.S. Pierhead Line and the proposed dock is similar in function to other residential docks in the immediate vicinity. The proposed development will not adversely impact coastal resources, public access, or public recreation opportunities, and is consistent with past Commission actions in the area and Chapter Three policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their November 14- 17, 2000 meeting and the site of the proposed development has been appropriately noticed, pursuant to 1 3054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at the site until the waiver has been validated and no less than seven days prior to the Commission hearing. The dredging contractor will place a filter screen around the discharge site to control turbidity. There is no known eel grass in the vicinity.of the projects. At 929 Via Lido Soud, 128 Via-Li'do Nord, and 2130 E. Balboa Blvd.. the dredged material will be placed on adjacent beaches. This will aid in the restoration of these beaches bayward of private residences. At 2270 Newport Blvd. and 103 Via Lido Soud, the dredged material will. be hauled to sea and dumped. D.
