special conditions defined in this permit The post-dredgmg report shall be sent within 45 days
after completion of the complete individual dredging project authorized in this permit. The

Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 54.
As long as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July 24, 2005, when RGP No. 54
will expire. A general permit does not grant any property rights exclusive privileges. Also, it
does not authorize any injury to the pioperty or rights of others or authorize interference with
any existing or proposed Federal project. Furthermore, it does not obviate the need to obtain
other Federal, State, or local authorizations required by law.

read the U.S. Army Corps of Engineers permit, RGP#54 and- the California Coastal
Commission permit #5-99-282 for maintenance dredging in Newport Harbor and that I
will comply with all of the conditions of those permits, I will further hold the City
harmless from and indemnify them against any claim for damages arising out of the
exercise of these permits. In addition, 1, as the applicant shall reimburse the City of
Newport Beach for all attorney's fees and other costs expended by them in defending
any claim, lawsuit, or judgment arising out of the activities of the applicant carried on
under the authority of such permit.

A copy of any variance, exception, conditional use permit or other issued permit is

approved tentative tract maps. On the basis of this finding, these plans are approved in
concept and said approval has been written upon said plans, signed and dated.
Should Newport Beach adopt an ordinance deleting, amending or adding to the Zoning
Ordinance or other regulations in any manner that would affect the use of the property or
the design of a project located thereon, this approval in concept shall become null and
void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970, and state and local
guidelines adopted thereunder, this development:
Has been determined to be ministerial or categorically exempt.

All discretionary approvals legally required of Newport Beach prior to issuance of a

This concept approval in no way excuses the applicant from complying with all
applicable policies, ordinances, codes and regulations of Newport Beach.

In order for the project to meet current code requirements
a new, longer, ramp will be used and three of the four piling
will need to be replaced with 1611 square rather than the 141,
square that is already there.
The purpose of the project is to preclude damage to the inshore

STANDARD CONDITIONS:
Notice of Receipt and AcknowIgdqMer1t. The permit is not valid and development shall not
commence until a copy of the permit, signed by the permittee or authorized agent,
acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to
the Commission office.
2. Expiration. If development has not commenced, the permit will expire two years from the date
this permit is reported to the Commission. Development shall be pursued in a diligent manner
and completed in a reasonable period of time. Application for extension of the permit must be
made prior to the expiration date.
3. Interpretation- Any questions of intent or interpretation of any term or condition will be resolved
by the Executive Director or the Commission.
4. Assignment. The pa".it maybe assigaed to any qualified person, provided assignee files with
the Commission an affidavit acceptingall terms and conditions of the permit.
5. Terms and Conditions Run with the Land. These terms and conditions shall be perpetual, and
it is the intention of the Commission and the permittee to bind all future owners and possessors

EXECUTIVE DIRECTOR'S DETERMINATION (continued):
The Executive Director hereby determines that the proposed development is a category of
development, which, pursuant to PRC Section 30624, qualifies for approval by the Executive Director
through the issuance of an Administrative Permit. Subject to Standard and Special Conditions as
attached, said development is in conformity with the provisions of Chapter 3 -of the Coastal Act of 1976
and will not have any significant impacts on the environment within the meaning of the California
Environmental Quality Act. If located between the nearest public road and the sea, this development is
in conformity with the public access and public recreation policies of Chapter 3.
FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION:
A. Proaect Description
The subject site is located between the first public road and the sea at the southeastern end of Lido
Island in the City of Newport Beach (Exhibits 1 & 2). Vertical public access to the harbor exists at a
small beach park located approximately 450' north of the subject site. Single-family residential
development characterizes the subject site and the surrounding area. The proposed project involves
relocation of an existing "U" shaped dock, installation of a new 3' by 28' gangway, and replacement of
three 14" concrete pilings with three 16" concrete pilings (Exhibit 3). No work is proposed to the
existing pier. The existing dock will be located further offshore to preclude the inshore end of the dock
from getting damaged due to extensive shoaling. The dock will remain within the Project Line limit. As
allowed by the City of Newport Beach Harbor Permit Policy (Section V. 1, Bayward Location of Piers
and Floats), dock projects within the subject area may extend up to 20' beyond the U.S. Pierhead Line
to avoid the need for excessive dredging.
The dock project will be used for boating related purposes to serve a single-family residential
development. The site has been surveyed by the City of Newport Beach Harbor Resources Division for

eelgrass and no eelgrass was discovered within 15 feet of the project area. The site has not been
surveyed for Caulerpa taxilfolia, therefore a pre -construction Caulerpa taxilfolia survey must be
conducted. These eelgrass and Caulerpa taxiffiblia surveys are valid for a limited period of time (until
the next growing season for eelgrass and 90 days for Caulerpa taxilfolia). If construction does not
occur within the respective time periods, a subsequent survey will be required. If any eelgrass or
Caulerpa taxiffiblia are found on the project site, Special Conditions No. 2 and No. 3 identify the
procedures necessary to be completed prior to beginning any construction. The proposed project has
received an approval in concept from the City of Newport Beach Harbor Resources Division. The
Regional Water Quality Control Board (RWQCB) has determined that the proposed project will not
adversely impact water quality if standard construction methods and materials are used. The applicant
has applied for a permit from the U.S. Army Corps of Engineers.
B. Marine Resources
The proposed recreational boat dock development and its associated structures are an allowable and
encouraged marine related use. The project design includes the minimum sized pilings and the
minimum number of pilings necessary for structural stability. There are no feasible less
environmentally damaging alternatives available. As conditioned, the project will not significantly
adversely impact eelgrass beds and will not contribute to the dispersal of the invasive aquatic algae,
Caulerpa taxifolia. Further, as proposed and conditioned, the project, which is to be used solely for
recreational boating purposes, conforms to Sections 30224 and 30233 of the Coastal Act.
C. Water Quality
The proposed work will be occurring on, within, or adjacent to coastal waters. The storage or.
placement of construction material, debris, or waste in a location where it could be discharged into
coastal waters would result in an adverse effect on the marine environment. To reduce the potential for
construction related impacts on water quality, the Commission imposes special conditions requiring,
but not limited to, the appropriate storage and handling of construction equipment and materials to
minimize the potential of pollutants to enter coastal waters. To reduce the potential for
post -construction impacts to water quality the Commission requires the continued use and
maintenance of post construction BMPs. As conditioned, the Commission finds that the development
conforms to Sections 30230 and 30231 of the Coastal Act.
D. Local Coastal Proaram
The LUP for the City of Newport Beach was effectively certified on May 19, 1982. The certified LUP
was updated on January 9, 1990. As conditioned, the proposed development is consistent with
Chapter 3 of the Coastal Act and with the certified Land Use Plan for the area. Approval of the project,
as conditioned, will not prejudice the ability of the local government to prepare a Local Coastal Program
that is in conformity with the provisions of Chapter 3.
E. California Environmental Quality Act (CEQA)
As conditioned, there are no feasible alternatives or additional feasible mitigation measures available
that would substantially lessen any significant adverse effect that the activity may have on the
environment. Therefore, the Commission finds that the proposed project, as conditioned to mitigate the
identified impacts, is the least environmentally damaging feasible alternative and can be found
consistent with the requirements of the Coastal Act to conform to CEQA.

SPECIAL CONDITIONS:
Water Qualit
A. Construction Responsibilities and Debris Removal
(1) No construction materials, equipment, debris, or waste will be placed or stored
where it may be subject to wave, wind, or rain erosion and dispersion.
(2) Any and all construction material will be removed from the site within 10 days of
completion of construction.
(3) Machinery or construction materials not essential for project improvements will not
be allowed at any time in the intertidal zone.
(4) If turbid conditions are generated during construction a silt curtain will be utilized to
control turbidity.
(5) Floating booms will be used to contain debris discharged into coastal waters and
any debris discharged will be removed as soon as possible but no later than the

(6) Non -buoyant debris discharged into coastal waters will be recovered by divers as
soon as possible after loss.
B. Best Management Practices Program
By acceptance of this permit the applicant agrees that the long-term water -borne berthing of
boat(s) in the approved dock and/or boat slip will be managed in a manner that protects water
quality pursuant to the implementation of the following BMPs.
(1) Boat Cleaning and Maintenance Measures:
a. In-watertop-side and bottom -side boat cleaning shall minimize the discharge of
soaps, paints, and debris.
b. In -the -water hull scraping or any process that occurs under water that results in
the removal of paint from boat hulls shall be prohibited. Only detergents and
cleaning components that are designated by the manufacturer as phosphate -
free and biodegradable shall be used, and the amounts used minimized.
c. The applicant shall minimize the use of detergents and boat cleaning and
maintenance products containing ammonia, sodium hypochlorite, chlorinated
solvents, petroleum distillates or lye.
(2) Solid and Liquid Waste Management Measures:
a. All trash, recyclables, and hazardous wastes or potential water contaminants,
including old gasoline or gasoline with water, absorbent materials, oily rags,
lead acid batteries, anti -freeze, waste diesel, kerosene and mineral spirits will
be disposed of in a proper manner and will not at any time be disposed of in the
water or gutter.

(3) Petroleum Control Management Measures:
a. Oil absorbent materials shall be examined at least once a year and replaced as
necessary. The applicant will recycle the materials, if possible, or dispose of
them in accordance with hazardous waste disposal regulations. The boaters
will regularly inspect and maintain engines, seals, gaskets, lines and hoses in
order to prevent oil and fuel spills. Boaters will use preventive engine
maintenance, oil absorbents, bilge pump -out services, or steam cleaning
services as much as possible to clean oily bilge areas. Bilges shall be cleaned
and maintained. Detergents will not be used for cleaning. The use of soaps
that can be discharged by bilge pumps is prohibited.
2. Pre -Construction Eelgrass Surve
A. Pre Construction Eelgrass Survey. A valid pre -construction eelgrass (Zostera
marina) survey shall be completed during the period of active growth of eelgrass
(typically March through October). The pre -construction survey shall be completed
prior to the beginning of construction and shall be valid until the next period of active
growth. The survey shall be prepared in full compliance with the 'Southern California
Eelgrass Mitigation Policy" Revision 8 (except as modified by this special condition)
adopted by the National Marine Fisheries Service and shall be prepared in consultation
with the California Department of Fish and Game. The applicant shall submit the
eelgrass survey for the review and approval of the Executive Director within five (5)
business days of completion of each eelgrass survey and in any event no later than
fifteen (15) business days prior to commencement of any development. If the eelgrass
survey identifies any eelgrass within the project area Which would be impacted by the
proposed project, the development shall require an amendment to this permit from the
Coastal Commission or a new coastal development permit.
B. Post Construction Eelgrass Survey. If any eelgrass is identified in the project area
by the survey required in subsection A of this condition above, within one month after
the conclusion of construction, the applicant shall survey the project site to determine if
any eelgrass was adversely impacted. The survey shall be prepared in full compliance
with the "Southern California Eelgrass Mitigation Policy" Revision 8 (except as modified
by this special condition) adopted by the National Marine Fisheries Service and shall be
prepared in consultation with the California Department of Fish and Game. The
applicant shall submit the post -construction eelgrass survey for the review and approval
of the Executive Director within thirty (30) days after completion of the survey. If any
eelgrass has been impacted, the applicant shall replace the impacted eelgrass at a
minimum 1.21 ratio on-site, or at another location, in accordance with the Southern
California Eelgrass Mitigation Policy. All impacts to eelgrass habitat shall be mitigated
at a minimum ratio of 1.21 (mitigation: impact). The exceptions to the required 1.21
mitigation ratio found within SCEMP shall not apply. Implementation of mitigation shall
require an amendment to this permit or a new coastal development permit unless the
Executive Director determines that no amendment or new permit is required.

3. Pre -construction Caulerpa Taxifolia Surve
A. Not earlier than 90 days nor later than 30 days prior to commencement or
re -commencement of any development authorized under this coastal development
permit (the "project"), the applicant shall undertake a survey of the project area and a
buffer area at least 10 meters beyond the project area to determine the presence of the
invasive alga Caulerpa, taxitblia. The survey shall include a visual examination of the
substrate.
B. The survey protocol shall be prepared in consultation with the Regional Water Quality
Control Board, the California Department of Fish and Game, and the National Marine
Fisheries Service.
C. Within five (5) business days of completion of the survey, the applicant shall submit the
survey:
(1) for the review and approval of the Executive Director; and
(2) to the Surveillance Subcommittee of the Southern California Caulerpa Action Team
(SCCAT). The SCCAT Surveillance Subcommittee may be contacted through
William Paznokas- California DPnqrtmPnt nf Fkh A C,.qmp [A_r;A/AR7_A91A1 or Robert
Hoffman, National Marine Fisheries Service (562/980-4043).
D. If Caulerpa taxifolia is found within the project or buffer areas, the applicant shall not
proceed with the project until 1) the applicant provides evidence to the Executive
Director that all C. taxifolia discovered within the project and buffer -area has been
eliminated in a manner that complies with all applicable governmental approval
requirements, including but not limited to those of the California Coastal Act, or 2) the
applicant has revised the project to avoid any contact with C. taxifolia. No revisions to
the project shall occur without a Coastal Commission approved amendment to this
coastal development permit unless the Executive Director determines that no
amendment is legally required.

are hereby authorized to relocate an existing floating dock bayward of 933 Via Lido Soud, in
Newport Bay, in the city of Newport Beach, Orange County, California, as shown on the enclosed
drawings.
The owner or authorized responsible official must sign and date all copies of this Letter of
Pern-tission (LOP) indicating that he/she agrees to the work as described and will comply with all
conditions. One of the signed copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed). In addition, please use the two attached
postcards to notify this office as to the dates of commencement (within 10 days prior to the start of
construction) and completion of the activity (within 10 days following the end of construction).

Recommendation:

2. Approve Mr. Rosenstein's request to extend his dock beyond the Pierhead Lines.
Background
On April 9, 2003, Harbor Resources submitted a staff report in response to an appeal from Mr.
Rosenstein at 933 Via Lido Soud. His original request to lengthen his pier by approximately 16'
beyond the Pierhead Lines was denied by Harbor Resources based on the regulations of the Harbor
Permit Policies.
During the appeal process, the Harbor Commission directed Harbor Resources to research the
history of the neighboring docks to determine why they were allowed to build beyond the Pierhead
Lines. In addition, the Harbor Commission directed Harbor Resources to submit drawings of other
dock configurations so that all of the available options can be graphically displayed.
Evaluation
Harbor Resources recommends approval for Mr. Rosenstein to elongate his pier as per his original
pier permit request dated 2/11/03. Harbor Resources bases this recommendation on the following
points:
• This action will not impede the navigational channels in the area. The channel is large enough to
handle a longer dock.
• Although irrelevant, the neighbor's docks already extend beyond the Pierhead Lines. These
resident's docks do not impede the channels.
The alternate dock configuration with the pier at an angle is not preferred by Mr. Rosenstein. At
its best, this configuration still extends beyond the Pierhead Lines. Additionally, this does not
meet Mr. Rosenstein's needs for a protective beach.
The proposed dock configuration is most ideal for this particular address and fits the needs of Mr.
Rosenstein. The design is unobtrusive and within the Project Lines. It will allow for a larger
beach and also permit more sand to protect the toe of the seawall.
Discussion:
Commissioner Rodheim asked if this would set a precedent for all the owners to request
an -exception. Chris said that this is for this property only. The other properties follow
the sand line and should not need to be elongated. Commissioners Rodheim and
Corrough commended Chris for a good presentation. Commissioner Corrough said that
by elongating the pier it should solve the sinkhole problem. Chairman Collins asked if
the Harbor Patrol had been asked for their input. Chris said they have and they see no
problem with the project. The applicant said that Chris had done an outstanding job in
dealing with the request.
Public Comments:
Mark Silvey said that docks listed as A, B and C need to be dredged every two years.
Action:
Commission Beek made the motion to approve the application in accordance with
Staff s recommendations. Commissioner Lawrenz seconded the motion. The motion
carried with all ayes.
SUB -COMMITTEE REPORTS:
• Moorings — Commissioner Duffield said Phase I of dinghy storage issue is being
completed and Chris will be giving a full report at the June meeting.
• Reconstitute Members of Commercial Charter Vessel Regulations Subcommittee —
Chairman Collins said this item is not needed.
HARBOR RESOURCES MANAGER'S UPDATES:
e Tom gave an update on dredging and related projects:
I . The Corps of Engineers has completed the final version of the plans and specifications for Phase
I of the Lower Bay Dredging. Dredging in the Harbor Entrance will begin on August 25 and
Phase I will be completed by September 30. The dredging will be subcontracted to Manson
Construction and Engineering Company. Sediment core sampling begins this week that will
investigate sediment quality in six inch increments to determine if layers of sediment in other
portions of the federal channels and anchorage meet criteria for disposal at LA -3. If acceptable
material is found, the Corp will modify the contract to include as much dredging as possible based
on available funds.
2. City Council, City Manager's office and Harbor Resources staff have been working with Senator
Feinstein and her staff to acquire the necessary funding for future phases of the Lower and Upper
Bay Dredging Projects.
3. Negotiations are continuing with the Ports of Long Beach and Los Angeles for disposal of
contaminated sediments from the Lower Bay at container offloading redevelopment sites. We
have the support of the Corps of Engineers, EPA and Regional Water Quality Control Board in
accomplishing this method of disposal.

Recommendation
The Harbor Commission is requested to select one of the following action items:

2. Reverse Harbor Resources denial and approve the permit request by
Mr. Rosenstein to have his dock extended beyond the Pierhead Lines.
Permit approval would be based on Mr. Rosenstein's Hardship Claim
and would require granting an exception to the Harbor Permit Policy.
Additionally, approval of Mr. Rosenstein's request would necessitate
Harbor Resources to issue an "Approval in Concept" in order for the
dock extension request to be further processed by the Coastal
Commission and Army Corps. of Engineers.
Background
Mr. Rosenstein owns a house and dock at 933 Via Lido Soud on the eastern tip of Lido
Isle. In February 2003, a request was made to extend his entire dock structure 15 feet
by lengthening his existing dock landing near the bulkhead.
Currently, the dock extends to its maximum allowable limits at the Pierhead Lines. He
is requesting a plan to extend his pier beyond the Pierhead Lines, just short of the
Project Lines.
The Harbor Permit Policy defines Pierhead Lines as:
"The Pierhead Lines, as established, shall define the limit for pier and float -type
structures."

Pierhead Lines were established by U.S. Congress based on the recommendations of
the U.S. Army Corps of Engineers. The Corps. of Engineers and California Coastal
Commission have jurisdiction to issue permits for dock reconstruction activities other
than those which require maintenance. The City of Newport Beach, as Trustee to the
State Tidelands, must also uphold these boundary lines as prescribed by their Charter.
The Harbor Permit Policy directly applies to piers such as Mr. Rosenstein's at Bulkhead
Station No. 171:
"Lido Isle — Piers may be permitted to extend out to the U.S. Pierhead Line,
except on the westerly side between U.S. Bulkhead Station No. 172 and No. 174.
Piers may be permitted to extend 20 feet beyond the U.S. Pierhead Line between
U.S. Bulkhead Station. No. 172 and 174."
Based on this bayward location of the pier requirement, Harbor Resources can only
approve piers at Station 171 to the Pierhead Line and thus denied Mr. Rosenstein's
permit request on February 21, 2003.
Hardship Claim
On April 2, 2003, Mr. Rosenstein met with Harbor Resources to discuss his previous
request and to submit a Hardship Claim as an appeal (Appendix A). He feels that his
request will not cause an obstruction or hazard to navigation and that a longer pier will
better preserve the integrity of his beach.
The basis for his Hardship Claim is as follows:
Due to the location of this particular address, the currents erode his beach
away from his bulkhead and bayward under his pier. As a result, the
Rosensteins have had to dredge their property four times since 1993, with a
combined total cost of $15,000. Since their dock is only 24 feet from the
bulkhead, their beach has a steep incline and is practically non-existent. By
extending their dock an extra 15 feet:
a. The beach angle would decrease causing more sand to be exposed.
b. Their bulkhead would be further protected.
c. Future dredging would be minimized or eliminated.
2. The neighbors at 929 and 939 Via Lido Soud, have piers that are built at
approximately 700 angles, allowing them to have docks further away from
their bulkhead.
3. The neighbors at 915, 921, 925 and 929 have piers that extend beyond the
Pierhead Lines, even though they fall within the same boundaries as the
Rosensteins, U.S. Bulkhead Station No. 171. The residences at 921 and 929
have newly constructed piers completed in or about 2002.

Hardship Claim Review
Harbor Resources would like to address each point of the Hardship Claim above:
1 According to aerial photography (Appendix B), the sand would normally have
a tendency to collect under Mr. Rosenstein's pier. This is inferred from the
"dip" in the sand line in front of the Rosenstein's house. On either side of
their house, the sand line resumes its natural path and extends bayward
toward the neighbor's respective piers. It is possible and likely that this "dip" in
the sand line in front of the Rosenstein's house occurs because of their
constant attention to dredging over the years.
In addition, the bulkhead may be further strengthened if more sand is allowed
to accumulate along the shore.
2. For the purposes of this request, it is irrelevant that the neighbors at 929 and
939 have docks that are at 700 angles. The past conditions of approval for
these structures are unknown and are not applicable to the present request.
3. For the purposes of this request, it is irrelevant that the neighbors at 915, 921,
925 and 929 have docks that extend beyond the Pierhead Lines. The past
conditions of approval for these structures are unknown and are not
applicable to the present request.
Evaluation
As enforcing body for the Harbor, it is duty of Harbor Resources to uphold the rules and
regulations of the City Municipal Code and of the Harbor Permit Policies, as well as act
in good faith as Trustees to the State Tidelands. It is also our responsibility to be fair to
all applicants and enforce the rules unilaterally. Careful attention must be taken so that
precedents will not be set for other bay front homeowners with similar concerns.
Based on the above facts with specific mention to the Pierhead Line regulations, Harbor
Resources is required to issue or deny permits based on the Harbor Permit Policy
established by the City Council.
However, it is within the limits of the Harbor Commission to allow an exception to the
Harbor Permit Policy, thereby granting Mr. Rosenstein permission to extend beyond the
Pierhead Lines.
"Exceptions may be approved by the Harbor Commission to any of the
requirements and regulations set forth if there are special circumstances or
conditions affecting the harbor installations that would impose undue hardship on
the applicant, or a waterfront property owner's access to the water is impacted by

a public works project, or if it would be detrimental to the best interest of the
City."

REQUEST FOR DOCK RELOCATION AT 933 VIA LIDO SOUD
We are requesting that our dock be relocated out past the current position at the 80 -foot
U.S. Pierhead Line. Our rational for this is that we are located at the Eastern end of
Lido Isle, and the currents erode our beach away from our seawall, causing us to have
to dredge approximately every 24 to 30 months. We have dredged four times since
purchasing our property in 1993, and have incurred costs in excess of $15,000.
Our dock is currently located only 24 feet from the seawall, and we cannot keep enough
sand up against our seawall without making a steep incline on the beach. This causes
the sand to slide back down and beaches our dock. If we were able to relocate the dock
out 10 to 20 feet, this would solve our problem of constant dredging and enable us to
keep a sufficient sand level against our seawall.
Our neighbors on both sides of our property have docks that are build at approximately
70 degree angles from their seawall, which allows them to have their docks further
away from their seawalls.
It has been related by the Newport Beach Harbor Resource Division that piers between
Harbor Bulkhead stations #171 and #172 cannot extend beyond the 80 -foot U.S.
Pierhead Line. However the neighboring piers at 929, 925, 921 and 915 Via Lido Soud
all extend out to the 100 -foot U.S. Project Line, and they are all within the #171 and 172
Harbor Bulkhead Stations. The pier at 929 Via Lido Soud is adjacent to our property,
and that dock was built in 2002, as was the pier and dock at 921 Via Lido Soud.
We are requesting your approval to move our dock out 15 feet from its current position.
This will not cause any obstruction or hazard to navigation, and will allow for more
open beach along the bay front.

The altemate dock configuration with the pier at an angle is not preferred by Mr.
Rosenstein. At its best, this configuration still extends beyond the Pierhead
Lines. Additionally, this does not meet Mr. Rosenstein's needs for a protective
beach.
The proposed dock configuration is most ideal for this particular address and fits
the needs of Mr. Rosenstein. The design is unobtrusive and within the Project
Lines. It will allow for a larger beach and also permit more sand to protect the
toe of the seawall.

I was wondering if you could lend me a hand, if it wouldn't be too much trouble.
Basically, the story is that the Harbor Commission wants our department to investigate, as
best as we can, the history behind 915, 921, 925, 929 and 939 Via Lido Soud. The reason
is because 933 is appealing a decision by Harbor Resources to build beyond the Pierhead
Lines while their neighbors at the above addresses are already clearly beyond the Pierhead
Lines.
According to our records, we believe that the alleged recent construction of a few of
those docks were under Maintenance permits.
What I am looking for is to see if you have done any work on the above addresses and if
so, were they under maintenance or full permits (what was the general scope). This might
then give the Harbor Commission the justification they need to go ahead and allow 933 to
build beyond the Pierhead Lines.
I've attached an aerial view of the area to save you some time.

construct, alter, improve, demolish, or repair any structure,
prior to its issuance, also requires the applicant for such
permit to file a signed statement that he is licensed pursuant to
the provision of the Contractors License Law (Chapter 9,

Dear Mr. Melum:
Reference is made to your letter dated May 17, 1994 in which you submitted on behalf
of Mr. Ira Rosenstein at 933 Via Lido Soud, a notification for the maintenance dredging of
200 cubic yards of sand and silt material by hydraulic suction and disposal of the dredged
material to an adjacent beach reclamation area.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Rosenstein's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

authorized to replace an existing residential boat dock in
Newport Bay at 933 Via Lido Soud, Newport Beach, Orange County,
California,,as shown on the enclosed drawings and subject to the
enclosed conditions.
The owner or authorized responsible official must sign and
date all copies of this Letter of Permission (LOP) indicating
that he/she agrees to the work as described and to comply with
all conditions. One of the signed copies of this Letter of
Permission must be returned to the Corps of Engineers (a
preaddressed envelope is enclosed for your convenience). Notice
of the commencement of the activity must reach this office at
least 10 days before the activity actually starts. Please use
the enclosed card.

We have received all necessary approvals for reconstruction of the
dock under the existing permit except for review of plans and
specifications by the Public Works Department. once those have
been received and reviewed by our Public Works Department we will
issue approval to proceed with the reconstruction and the final
permit will be issued contingent upon inspection of the completed
docks by the Marine Department.
To initiate final inspection once the project is completed, please
contact Ray Garver at our office, (714) 644-3044. Once he has
made an inspection of the reconstructed dock, he will issue a final

Dear Sir:
I am enclosing a check in the amount of $75 to cover the pier permit annual fee
relative to pier #0171-0933-1 for my property at 933 Via Lido Soud, Newport Beach.
Per my telephone conversation with Dorothy on April 12, 1993, 1 would appreciate
your changing my billing and correspondence address to 3 Glenmeadow Court,
Dallas, TX 75225 as we are in the process of demolishing the present house and pier
and will be building in the upcoming months.
Relative to your letter of January 12, 1993 that a deficiency exists on the present pier
and that it needs to be replaced, I would like to leave this open at the present time due
to the above mentioned replacement.
You received the transfer fee for $300 and association transfer card when my escrow
was closed in January 1993. If you have any questions, please call me at my business
phone shown on this letterhead.

Dear Sir:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0170-933 for the property located at 933
via Lido Soud, Newport Beach, CA. The facility was inspected on
1/11/93.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A city -approved anti -syphon -device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed.
The Newport Beach City Council Harbor Permit Policies state:
10. D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the city's minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies -must be corrected prior to transfer of the
permit."
A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pien permit
will be transferred. Included in requirements for transfer of the
pier permit is the $300 transfer fee and the signed transfer card.

Regarding: Lot 321, Lido Isle
Dear Mr. Desatoff:
It is proposed to add a structural slab (designed by others) spanning from
a support at ' the face of an existing retaining wall t I o the bulkhead line at
933 Via Lido Soud, Lido Isle. The span of the slab is 81 - 4"± F, - IL sup-
port. A 31 - 8 "± high concrete block wall is added on top of the bulkhead
to support the slab, thus the loads added to the bulkhead are axial loads.
A visual inspection of the bulkhead reveals that the grade differential
between the lot grade and grade in front of the bulkhead varies from 21 to
4'. The slope of the beach immediately in front of the wall is estimated
at 1:10 and as the beach fronts on the bay it is not subject to extreme
scouring action. Also, the docking facilities for power boats are far enough
away that the boats will not cause scouring and the grade in front of the
bulkhead can be assumed as reasonably stable. However, no future excava-
tion should be made without engineering review.
The construction of the existing bulkhead wall is not known, as no plans
were available. Based on conversations you had with local marine con-
tractors it is estimated that the sheet piling is probably a minimum of
121 in length; this can be verified during construction. The axial stress.
added from the structural slab (including an allowance for 60 p. s.f. live
load) is approximately 12 p. s. i. , which is negligible.
It was also observed that construction of a similar nature was done on the
adjacent lot in the past, with no apparent damage to the bulkhead occuring.
Although it is not possible to. fully attest to theadequacy of design or the
present condition of all the existing components of the bulkhead, there was
no visual evidence of failure and the work being done does not contribute
additional lateral loads and would not contribute to failure of the bulkhead.
As bulkheads of this type are flexible structures any vertical or lateral
deflection could cause cracking in the new structure. Although this is un -
likely with the conditions existing at the site, the owner must be aware
of this risk.
