SUBJECT: Adoption of a Joint Resolution With the Cities of Anaheim,
Costa Mesa, Orange, Santa Ana and Tustin Regarding Support
for JWA Settlement Agreement EIR 582 Scenario One
RECOMMENDATION:
Approve the attached Resolution.
BACKGROUND:
In February 2000, the Newport Beach City Council decided to initiate actions in
pursuit of a JWA Settlement Agreement extension. Those actions included
proposing to the Board of Supervisors an EIR "project definition ", which later
became Scenario One in the Settlement Agreement EIR 582. City staff worked
in concert with County airport staff to prepare EIR 582. The Draft EIR has been
circulated, comments have been received, and the final EIR is expected to be
released shortly. The County Board of Supervisors could take action to certify
the EIR in late February.
An important part of the City Council's strategy to have the Board of Supervisors
certify EIR 582 and then support an extension of the JWA Settlement Agreement,
was to gain the support of other cities directly affected by JWA operations. The
City Council felt the cities of Anaheim, Costa Mesa, Orange, Santa Ana and
Tustin could have the same interest that Newport Beach has in obtaining an
extension. A series of meetings over this issue took place with elected officials
and the City Managers of these JWA "Corridor Cities ", and a strong alliance was
formed. This coordinated effort has resulted in three separate mailings to over
200,000 residents in the JWA corridor cities, educating them on the need to
obtain a Settlement Agreement extension and keeping them informed of the EIR
scenarios and time frames.

All of the Corridor Cities are in support of EIR 582 Scenario One, and their City
Managers have signed their names to mailings stating that support. In addition,
corridor City Council members and City Managers have been visiting with their
Board of Supervisors requesting support for Scenario One.
The resolution before you is expected to be adopted by each of the corridor cities
by February 15th. It states support for Scenario One becoming the basis for the
Settlement Agreement extension and also requests the Board of Supervisors
take this action on February 26 th
The Newport Beach City Council and particularly Council Members Norma
Glover, Dennis O'Neil and Gary Proctor, have developed strong credibility with
the corridor cities. Newport Beach has been able to separate the JWA
Settlement Agreement extension issue from the El Toro issue and in doing so,
gain the strong support of Anaheim, Costa Mesa, Orange, Santa Ana and Tustin
for the Settlement Agreement extension scenario which this City feels best
protects Newport Beach and the other corridor cities from JWA future impacts.
RESOLUTION NO. 2002-
A RESOLUTION OF ANAHEIM, COSTA MESA,
NEWPORT BEACH, ORANGE, SANTA ANA AND
TUSTIN REQUESTING BOARD OF
SUPERVISOR APPROVAL OF AN AMENDMENT
OF THE JOHN WAYNE AIRPORT SETTLEMENT
AGREEMENT CONSISTENT WITH SCENARIO 1
IN EIR 582
WHEREAS, the John Wayne Airport Settlement Agreement
(Settlement Agreement) establishes limits on the number of
passengers and noise regulated departures consistent with the
limited physical facilities at JWA (number of gates and the size of
the terminal); and
WHEREAS, the County of Orange - through the efforts of the
Board of Supervisors (Board), Chief Executive Officer (CEO), Airport
Director (Director) and Special Counsel (Counsel) - has strictly
complied with the letter and the spirit of the Settlement Agreement;
and
WHEREAS, a substantial number of residents of the cities of
Anaheim, Costa Mesa, Newport Beach, Orange, Santa Ana and Tustin
(Corridor Cities) are adversely impacted by noise, air pollution
and /or traffic generated by commercial aircraft operations at JWA;
and
WHEREAS, the County of Orange has, in cooperation with the
City of Newport Beach, prepared EIR 582 which evaluates the
potential impacts of three "scenarios" (Scenarios 1, 2 and 3) - each
of which assumes some increase in the term of the Settlement
Agreement, the number of noise regulated departures and the
number of passengers; and
WHEREAS, the elected representatives of the Corridor Cities
have determined that an amendment of the Settlement Agreement
consistent with Scenario 1 would protect the quality of life and
property values of their respective constituents and would comply
with federal law; and
WHEREAS, the elected representatives of the Corridor Cities
request the Board approve a Settlement Agreement amendment
consistent with Scenario 1.
NOW, THEREFORE, THE CITY COUNCILS OF THE CORRIDOR
CITIES RESOLVE TO REQUEST THAT, ON FEBRUARY 26, 2002, THE
ORANGE COUNTY BOARD OF SUPERVISORS CERTIFY EIR 582 AND
APPROVE A SETTLEMENT AGREEMENT AMENDMENT CONSISTENT
WITH SCENARIO 1.
