Dear Mr. Thompson,
A recent field inspection has revealed that there are two (2) vessels berthed at your dock that are
extending beyond the projection of the property line and into 533 Via Lido Soud. These are in
violation of the Newport Beach Harbor Permit Policies: Moorings, A, which states:
"Boats moored at private or public docks shall not extend beyond the projection of the
property lines of the property to which the dock facility is connected in accordance with
section 20-C."
This letter is to advise you that unless you relocate your vessels within 30 days of the date of this
notice, an Administrative Citation may be issued and penalties will begin to accrue ($100, $200,
$500 increments). Your cooperation will be greatly appreciated in this matter.
Please see the attached picture of the infraction. If you have any questions regarding the
enforcement of the Harbor Permit Policies, please feel free to give me a call.

Dear Mr. Swift,
The above referenced application was received in %this office on December 28, 1998.
For the reasons described below, the application has been deerned incomplete,
At a recent hearing, the Commission expressed concern Over platform areas
associated with boat docks, Staff has been directed to determine whether such
platforms are necessary features on boat docks. Consequently, further information is
necessary with regard to the subject application's proposed eleven by twelve -foot
platform. What purpose does this platform serve? is it necessary for the boat dock
to. function properly? if a platform is necessary, would a smaller one accomplish the .
5'ame goal? What would be the consequence it the boat dock were constructed
without the platform? Does the wider platform require more piles than would
otherwise be necessary?
Also, how many piles does the existing boat dock use? How many piles will the
proposed boat dock need? In your response please include all piles for the entire
structure (i.G. platform, ramp, dock) -
Once the additional information is received in this office and the application has been
deemad complete, the item will be scheduled for Commission review. Please do not
hesitate to contact me with any questions regarding this matter.

November 6, 1998, became effective as of that date. Any deviation from the application and

project.

DESCRIPTION: Removal of an existing 3 foot wide by 24 foot long gangway and 20 foot
wide by 30 foot long U-shaped residential dock float. These existing
structures will be replaced by an L-shaped dock float. The longest element
of the proposed dock float will be 8 feet wide by 62 feet long, the shorter
element will be 9.5 feet wide by 12 feet long. Three existing guide pilings
will be removed and replaced by three new guide pilings, placed in a
different configuration to accommodate the new dock float shape. In
addition, a 6 foot wide by 4 foot long extension will be added to the eastern
side of the existing pier. A 3 foot wide by 22 foot long gangway will also be
installed. No eelgrass was found in the project vicinity.

SUBJECT: Waiver of Coastal Development Permit Requirement/Do Minimis
Developments -Section 30624.7 of the Coastal Act
Based on: your prpjq.ct:. plans and information provided in your permit application for the
development described below, the Executive Director of the Coastal Commission hereby
waives the requirement for a Coastal Development Permit pursuant to Section 13238.1,
Title 14, California Code of Regulations. If, at a later date, this information is found to be
incorrect or the plans revised, this decision will become invalid; and, any development
occurring must cease until a coastal development permit is obtained or any discrepancy is
resolved in writing.

RATIONALE: The proposed development consists of the removal of an existing dock float
and associated structures and replacement with a new dock float, pilings, and gangway
within the U.S. Pierhead Line. The proposed dock is similar in function to other residential
docks in the immediate vicinity. In addition, an inspection performed by the City
determined that no eeigrass exists in the vicinity of proposed project. Therefore, no
eelgrass will be affected by the proposed project. Also, the Regional Water Quality Control
Board has determined that the proposed project will not adversely impact water quality if
standard construction methods and material's are used. The proposed development will not
adversely impact coastal resources, public access, or public recreation opportunities, and is
consistent with past Commission actions in the area and Chapter Three policies of the
Coastal Act.
This waiver will not become effective until reported to the Commission at their November
3-6, 1998 meeting and the site of the proposed development has been appropriately
-noticed, pursuant to 1 3054(b) of the California Code of Regulations. The enclosed Notice
Card shall remain posted at the site until the waiver has been validated and no less than
seven days prior to the Commission hearing. If four (4) Commissioners object to this
waiver of permit requjWpents, a coastal development permi ill be required.

Reference is made to your letter dated June 3, 1997 in which you submitted on behalf
of M�.' * Thompson who resides at 531 Via Lido Soud, a notification for the maintenance
dredging of 135 cubic yards of sand and silt material by hydraulic suction and disposal of the
dredged material on the adjacent beach.
Based on the furnished information, we have detern-dned that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Thompson's contractor does not exceed the maximum dredging design
depth of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

All parties are aware that the property herein is governed by the Marine Department
and Tidelands Administration, and that docking rights and privileges are involved,

authorizes and directs Escrow Holder to forward the Application for Transfer of Permit
along with the Seller check in the amount of $260.00 made payable to the TIDELANDS
ADMINISTRATOR. When approved, Escrow Holder will receive a copy of the application
signed by the Tidelands Administrator for the new Buyer herein and any special
conditions pertaining to the facility will be listed on the card and the dates or
previously issued permits or approvals by other agencies will be indicated. Escrow
Holder is authorized and directed to forward the signed Application to the Buyer
at the close of escrow. Escrow Holder is hereby release of any and all liability
and/or responsibility as to the contents and conditions contained on said signed
