Marmon C94 FOM1N�P City Council Agenda Item No. 12 January 22, 2002 TO: Mayor and City Council FROM: General Services Director SUBJECT- Limitation of Skateboard Use in City Parks Recommendation: Adopt Resolution No. 2002- Prohibiting Skateboarding on Certain Streets, Sidewalks, and Parks and rescind Resolution No. 2000 -19. Background: Skateboarding activity is common in most City parks and recreation areas. Numerous locations, such as walls, benches and stairs have been damaged or marred by skateboard users. On February 22, 2000, the City Council determined that there was a need to prohibit skateboarding on certain streets and sidewalks and adopted Resolution No. 2000 -19, as provided by Municipal Code Section 12.57.020. The prohibition stems from a need to address concerns regarding pedestrian safety and public property damage. Resolution 2000 -19 and Municipal Code Section 12.57.020 are attached. The current ordinance and resolution are not specific enough to allow enforcement in the park and recreation areas. The recent opening of a new City park (Arroyo Park) and other improvements to the City park system have raised safety and maintenance issues regarding skateboarding use at various City parks or recreation areas that need to be addressed. On January 8, vandals used heavy tools to remove 16 of 65 metal anti - skateboarding devices installed at Arroyo Park. The damage estimate exceeds $1,500. Resolution 2002 - was reviewed by the Parks, Beaches, and Recreation Commission on January 10, 2002. The Commission made only two recommendations, the addition of "steps and stairs ", and the deletion of "basketball courts" from the list of designated park areas where skateboard use would be prohibited. Both recommendations have been incorporated in the attached Resolution No. 2002- Discussion: Resolution 2000 -19 does not address park areas specifically, nor specific improvements within parks and cannot be applied for enforcement purposes at any City park without a modification. Staff is recommending that Resolution No. 2000 -19 be rescinded and replaced with a resolution that will prohibit skateboarding at designated areas of City parks and public areas in addition to the streets and sidewalks currently addressed by Municipal Code Section 12.57.020. The proposed resolution is attached. The proposed resolution also defines those features (brickwork, ornamental surfaces, etc.) in all parks that are off - limits to skateboard use. A second major amendment to the existing resolution prohibits skateboard activity on any paved park area with a grade of 6% or greater. This restriction is limited to 21 of the 46 City parks. Upon Council approval of the proposed resolution, the General Services Department will post signs prohibiting skateboarding in certain areas of each of the parks or recreational areas identified in the resolution. It is anticipated that the prohibition and enforcement will resolve staff concerns regarding pedestrian safety and park vandalism. Skateboarding activity will continue to be allowed in all City parks except for the specific locations designated in the resolution, the specific features in all parks, and any paved park areas with a grade of 6% or greater. Skateboarding shall be prohibited on all public streets, sidewalks, parking lots and other public property located in the City of Newport Beach having a grade of six percent or more and which are declared by resolution of the City Council to be hazardous to pedestrians, motorists or persons operating skateboards. The City Council may by resolution prohibit skateboarding on public streets, sidewalks, parking lots and other public property having a grade of less than six percent when it is determined to be necessary to protect the health, safety and welfare of pedestrians, motorists or persons operating skateboards on said streets and sidewalks.
