SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER # 5 -95 -131 -APPLICANT: Jim Collins
LOCATION: 637 Via Lido Soud. City of Newport Beach. County of Orange
PROPOSED DEVELOPMENT: The existing "U" shaped float currently a part of the
existing boat dock located at the adjacent property at 633 Via Lido Soud is
proposed to be relocated to the subject site and used as the proposed float
for a new boat dock. New construction consists of a 41x4l' pier, 101041
platform, and 3'x22' gangway.
RATIONALE: The proposed development is similar to a previously proposed (but
unbuilt) boat dock at 633 Via Lido Soud adjacent to the subject site. This
previously proposed dock was approved by De Minimis Waiver 5-95-033. Further,
De Minimis Waiver 5-95-032 was previously approved for another proposed dock
on the subject site at 637 Via Lido Soud. The two docks previously approved
both received clearance from the Regional Water Quality Control Board. The
previous clearances would be applicable to the current proposal. Thus, the
proposed development would not have significant adverse impacts to coastal
access, coastal resources, nor public recreation opportunities, and is
consistent with the City's Certified Land Use Plan, past Commission actions ir
the area and the Chapter Three policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their
June 13-16, 1995 — , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

would not extend into Newport Harbor past the U. S. Project Line.
RATIONALE:
The proposed development would not interfere with navigation in Newport
Harbor. The proposed development would not have significant adverse impacts
on public recreation opportunities, coastal access or resources, and is
consistent with the City's Certified Land Use Plan, past Commission actions in
the area, and the Chapter Three policies of the Coastal Act.

Dear Mr. Collins:
The City of Newport Beach Marine Division is responsible for
administering the issuance of permits for work on piers over City
Tidelands and for compliance to the City regulations.
It has been brought to this departments attention that work has
commenced on the pier and dock bayward from 637 Via Lido Soud by
your contractor. Before work can start a Harbor Permit must be
issued to you. This has not been done, primarily because, we
don't have documentation that the U.S. Army Corps of Engineers
have approved this project or evidence of a stamped set of plans
from the City Public Works Division.
Startinv work on.this project before receiving the permit from
the Marine Division is a violation of the City Municipal.Code and
Harbor Permit Policies. Therefore if work continues, this matter
will be turned over to the City Attorney's office for further
action.
If you need to discuss this matter with the Marine Division,
please call 714-644-3044 and ask for Wes Armand or Tony Melum.

1995, and the pier and docks bayward from the residence complies
with the plans submitted to this department.
The inspection did not reveal the existance of a backflow
prevention device. Please arrange to have one installed and call
me when it has been completed.

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER #-5-95-130-APPLICANT:- Jim Collin5
LOCATION: 633 Via Lido Soud. City of Newport Beach. CountY of Orange
PROPOSED DEVELOPMENT: Construct a new boat dock consisting of a 41x4l' pier,
10'xl4l platform, 3'x,221 gangway, 6'x5O' 1111 shaped dock, and two 141,
diameter guidepiles.
RATIONALE: 'Except for the "L." shaped dock, the proposed development is
similar to a previously proposed (but unbuilt) boat dock located at 637 Via
Lido Soud adjacent to the subject site. This previously proposed dock was
approved by De Minimis Waiver 5-95-032. Further, De Minimis Waiver 5-95-033
was previously approved for another proposed dock on the subject site at 633
Via Lido Soud. The two docks previously approved both received clearance from
the Regional Water Quality Control Board. The previous clearances would be
applicable to the current proposal. Thus, the proposed development would not
have significant adverse impacts to coastal access, coastal resources, nor
public recreation opportunities, and is consistent with the City's Certified
Land Use Plan, past Commission actions in the area and the Chapter Three
policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their
June 13-16. 1995 —, meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will berequired.

Sirs:
The City of Newport Beach Marine De-oartment has received a request
to transfer pier permit 0172-0633-1 - for the property located at 633
Via Lido Soud, Newport Beach, CA. The" -facility was inspected on
October 4,, 1994.
We cannot transfer the pier permit until the following deficiency
has/ha-\,,e been corrected and WE 'HAvE BEEN NOTIFIED OF THE
CORRECTION:
1. The electrical. receptacles must be GFI or twist lock to be used
in a water environment.
2. A City -approved anti- W hon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no longer
an approved backflow prevention device. This reWirement is in
accordance with Title 17 of the California Administrative Code.
A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECT`ED. When we have been notified, the structure will again be
inspected and when the requirements have been met the ier ermit

for the property

The structure was inspected on 4/25/79 at.which time it was determined
that the following deficiencies exist:
1. No anti -syphon device on water line to float
.2. Electrical outlet at pier needs water proof cover.
3. Electrical conduit to dock very rusty, should be checked to determine
condition.
4. Right float fl.nger, facing bayward, appears broken and/or weak;
5.
In accordance with Section 10-D of the City Harbor Permit Policies, "All
Structural deficiencies must be corrected..." A permit for this work
,must.be obtained from the Marine Department.
The electrical and/or plumbing problems noted above have been forwarded
to the Community Development Department. They will make a field inspection
and forward the results to the Marine Department.
If deficiencies exist, the property owner will be notified of the need for.
corrections. A building permit for this work will be required from the
Community Development Department.
Would you please advise this department when this requirement has been met.
