No Caulerpa Taxifolia was observed in subject area noted above. This Preliminary Eelgrass Survey is the result of studying this property to determine the presence of eelgrass. This report as required in accordance with the Southern California Eelgrass Mitigation Policy (SCEMP) since eelgrass is widely distributed throughout Southern California Coastal and Harbor Regions. This policy has been set in place to protect marine habitats and sea grass beds that play a role in the life cycle chain for marine life to reproduce. This survey assists development projects by contractors like you to conduct activities in conjunction with BMP's concerning impact and management for promoting Eelgrass and controlling the spread of Caulerpa. Proposed new dock would be a smaller dock footprint and gangway system and no platform. See Figure 2. The new dock system would be composed of Douglas fir. Eelgrass was not observed in construction site; see Figure 2 & Eelgrass Survey Report. Caulerpa was not observed in any areas surveyed; see Caulerpa Survey Report. Eelgrass Impacts No eelgrass in survey area. See Figure 2. Survey Method Survey conducted March 19, 2014 beginning at 1115 hr, at N Lat +33. 609940", W Long -117. 915694 ". Day was overcast, air temperature 68° F. Water was 62° F. Depth ranged from sea wall at 0' to approximately 12' at end of existing dock, visibility was 4 ft. See Table 1. Survey area delineated spanning 30' ft wide paralleling sea wall to 80' ft out from sea wall past end of proposed dock to cover entire area to ensure >75% coverage of bay floor. Survey conducted by diver's 3' ft apart. Lanes ran parallel with sea wall scanning approximately 4 ft on either side. See Figure 2. Survey Findings Dimensions of proposed dock are shown in Figure 2. Eelgrass at this proposed project site was not observed. See Eelgrass Survey Report for detailed findings and observations. Sea life observed were mussels on bottom in sediment (sand and dirt). Discussion No eelgrass was observed in project area. Proposed project shows an approach 4 feet long to a platform that is 10 feet wide by 14 feet long with 2 -14" T piles replacing 5-14" existing piles. Proposed gangway shows Tx 26' from platform to dock slip. Proposed dock slip would be "L" shape at the head walk and 61 feet long by 4 feet wide at end of dock slip (See Figure 3). Existing approach/platform with 5-14" piles are to be removed along with gangway and dock slip. Dock slip dimensions would change reducing overall foot print from existing of 660 sqft to proposed of 788 sqft. Existing "L" shape (at head walk) dock slip dimensions are 54 feet by 6 feet (See Figure 2). Mussels on dock floats, piles and bottom exist. No eelgrass is present in survey area. Impact to navigational waters will not change. Best management practices are recommended in replacement of piles and installation of proposed dock system. The project proponent is aware of the Harbor Permit Policies (Council Policy H-1) and Title 17 of the City of Newport Beach Municipal Code. The project proponent understands that the above referenced structure(s) is under the purview of these Policies and Codes. 2. Any future work on the above mentioned structure(s) requires permits with the City of Newport Beach and any other applicable agencies. Painting and work considered to be cosmetic in nature does not require a permit. 3. The conditions set forth in this document pertain to the proposed dock system and/or bulkhead under consideration. Any future modifications or alterations to the dock system and/or bulkhead may require new conditions which may override or change these conditions. These conditions supersede all past conditions associated with this property. 4. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. The project shall be implemented in conformance with the Local Coastal Program - Coastal Land Use Plan. Page 1 of 2 7. In accordance with Municipal Code 10.28.040 the following noise regulations apply: "A. Weekdays and Saturdays. No person shall, while engaged in construction, remodeling, digging, grading, demolition, painting, plastering or any other related building activity, operate any tool, equipment or machine in a manner which produces loud noise that disturbs, or could disturb, a person of normal sensitivity who works or resides in the vicinity, on any weekday except between the hours of seven a.m. and six -thirty p.m., nor on any Saturday except between the hours of eight a.m. and six p.m. B. Sundays and Holidays. No person shall, while engaged in construction, remodeling, digging, grading, demolition, painting, plastering or any other related building activity, operate any tool, equipment or machine in a manner which produces loud noise that disturbs, or could disturb, a person of normal sensitivity who works or resides in the vicinity, on any Sunday or any federal holiday." 8. Vessels may not extend beyond the end of the fingers by more than the width of its beam except as otherwise noted in the Municipal Code. 10. No Caulerpa was observed, and no eelgrass was present in the general vicinity of the project area. As you know, this preliminary report was required in accordance with the Southern California Eelgrass Mitigation Policy (SCEMP) since eelgrass is widely distributed throughout the Newport Bay. This policy protects an important marine habitat, seagrass beds, which provide habitat and food for adult and juvenile marinelife such as halibut, lobster, seabirds and even endangered sea turtles.
