Commission staff have reviewed the information submitted and determined that the above referenced dredging
events conform with, Consistency Certifications CC -078-99 and/or CC -077-01 and that no further federal
consistency review is necessary from the Commission for the dredging components of the projects. In addition,
the proposed beach disposal events have been reviewed and found by the Executive Director to be consistent with
Special Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is
necessary from the Commission for the beach disposal components of the projects.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC -078-99 and CC -077-01 and/or conform with the terms and
conditions of Coastal Development Permit 5-99-282, as amended. Any change in the projects may cause them to
lose their status as consistent with CC -078-99 and CC -077-01 and/or CDP 5-99-282, as amended. This
certification is based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring at that time
must cease until a new determination regarding conformance with CC -078-99 and CC -077-01 and/or CDP 5-99-
282, as amended, is obtained.

Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit (RGP)
No. 54.
As long as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July 24, 2005, when RGP No. 54
will expire. A general pen -nit does not grant any property rights exclusive privileges. Also, it
does not authorize any injury to the property or rights of others or authorize interference with any
existing or proposed Federal project. Furthermore, it does not obviate the need to obtain other
Federal, State, or local authorizations required by law.

read the U.S. Army Corps of Engineers permit, RGP#54 and the California Coastal
Commission permit #5-99-282 for maintenance dredging in Newport Harbor and that I
will comply with all of the conditions of those permits. I will further hold the City
harmless from and indemnify them against any claim for damages arising out of the
exercise of these permits. In addition, 1. as the applicant shall reimburse the City of
Newport Beach for all attorney's fees and other costs expended by them in defending
any claim, lawsuit, or judgment arising out of the activities of the applicant carried on
under the authority of such permit.

the soil samples provided to us by your firm. The test procedures were *in
accordance with ASTM D 422-63 (1998) and U.S. Army Corps of Engineers

Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your perm . it
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or.any discrepancy
is resolved in writing.

damaged blocks of wall, new coping on top of wall to anchor new tiebacks; and
a sheetpile with coping below sand line just waterward of the existing
bulkhead.
RATIONALE: The installation of sheetpile at the waterward foot of the
bulkhead will not have any adverse impact on marine organisms as the location
is well below the sand line, is consistent with the Coastal Act, the City's
Land Use Plan and past Commission actions.
This waiver will not become effective until reported to the Commission at their
June 11-14, 1991 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be required.

Dear Mr. Shogren:
We have talked about the magnitude of this type of bulkhead repair
and about the necessary permits to allow it to go forward. Because
this repair is relatively unique and there have not been similar
projects in the harbor area, we were initially unclear about the
permitting process. In reviewing the Coastal Act with the City
Planning Department we have decided that because of the magnitude
of the repair and the nature and location of the repair over State
Tidelands, a California Coastal Commission permit will be required.
Therefore, prior to issuing the Harbor Permit for the maintenance
of the bulkhead we will need the three permits from the Building
Department, which I believe you have, and the California Coastal
Commission Permit.

Dear Tony:
This letter is to confirm our telephone conversation earlier this week regarding Mr. Allan Carl -
ton's request for a new dock system at his home at the above referenced address.
The Board of Directors feel that Mr. Carlton has a right to keep his boat inside his own property
lines, but is concerned that any dredging he may do could cause erosion the street -end beach
next to his property. The Board feels that a bulkhead at his property line as proposed would
alleviate this problem. NyeXre sure that the City will do its best to protect the beach and the
storm drain from erosion:'�As to the pilings, the Association has no jurisdiction over this area
and realizes that the City will be handling this matter.

Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.

LOCATION: 912 Via Lido Nord, Newport Beach
PROPOSED DEVELOPMENT: Replace a U-shaped boat dock with a rectangular boat
dock.
RATIONALE: The proposed project does not exceed the U. S. Bulkhead line and
has no potential for significant adverse impacts on coastal resources or
public access.
This waiver will not become effective until reported to the Commission at their
September 13 - 16, 1989 . meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. if four (4) Commissioners object to this waiver of permit
requirements a coastal development permit will be required.

Dear Sir:
The City of Newport Beach Marine Department has received a request
to transfer pier permit #0175-912 for the property located at 912
via Lido Nord, Newport Beach, CA.
The structure was inspected on December 13, 1988 and in accordance
with Section 10-D of the Harbor Permit Policies, it cannot be
transferred until it meets City requirements. The policy states:
10.D. "At the time of transfer, all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements, and the conditions of
the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit."
We cannot transfer the permit until the following deficiencies
have been corrected and we have been notified of the correction:
1. A City approved anti -syphon device is required at the water
connection to the pier and float. A diagram indica . ting the
accepted type of installation is included herewith.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED. When we are so notified, the structure will be
inspected again and when the requirements have been met, the pier
permit will be transferred.

Recommendation
If desired, approve the Maintenance Dredging Harbor Permit appli-
cations.
Discussion
These applications require City Council approval under the conditions
of approval of the City of Newport Beach "blanket" permit for main-
tenance dredging issued on February 12, 1974, by the U. S. Army
Corps of Engineers.
The location and applicants for the proposed maintenance dredging are:
175-912 - Gil Wayne, 912 Via Lido Nord
154-123 - H. D. Twitchell, 123, E. Bay Front, Balboa Island
153-225 - Eva M. Casner, 225 E. Bay Front, Balboa Island
The staff has reviewed the proposed dredging and has determined that
the work to be done is within the parameters of the Corps of Engineers
permit. There is no anticipated adverse affect on proximity beaches
or contiguous bulkheads.
Shellmaker, Inc., the dredging contractor, will minimize turbidity
as much as is possible and will barge the dredged material to the
Environmental Protection Agency's designated disposal site, four
miles at sea.

Dear Mr. Perry:
I have reviewed the comments made in your letter of
March 16, 1966 to Trautwein Brothers with respect to my
application to enlarge the slip on my property and I
would like to make the following comments.
In paragraphs A and B of your letter you indicate that it
would be necessary to reduce the size of the existing
pier before I could obtain a permit to enlarge the slip
I fail to understand the reason for this change. The ex-
isting structure was installed and approved by the City
at the time of its construction and as there is to be no
alteration work done in connection with the existing
pier I cannot conceive that I should be required to alter
that structure.
Will you please review this matter again and let me have
your opinion regarding the points I have raised regarding
the changes requested in your letter. Thank you for your
assistance.
