Commission staff have reviewed the information submitted and determined that the above referenced
dredging events conform with Consistency Certifications CC -031-06 and the Special Conditions of Coastal
Development Permit 5-06-117. Please note that the eelgrass and Caulerpa taxifolia 'surveys completed are
only valid for a limited time period -and that additional surveys must be completed and submitted to
Commission staff for review if the dredging and beach nourishment events listed above do not commence
prior to expiration of the initial survey. In addition, please note that this authorization shall expire on
October 23, 2011 and that all authorized work must be completed prior to that date.
Please be advised that onlythe projects described in the materials submitted for the sites listed above have
been found to conform with Consistency Certification CC -031-06 and/or conform with the terms and
conditions of Coastal Development Permit 5-06-117. Any change in the projects may cause them to lose
their status as consistent with CC -031-06 and/or CDP, 5-06-117. This certification is based on information
provided by the recipient of this letter. If, at a later date, this information is found to be incorrect or

Dear Mr. Miller:
This is in reply to your application (File No. SPL-2009-00532-FBV) dated July 1,
2009 for a Department of the Army Pern-dt to discharge fill material into waters of the
U.S., in association with the RGP 54 July Dredge Batch for George Chumo, David Stone,
and
.� �ai �The proposed work would take place at two locations within
Newport Bay within the city of Newport Beach, Orange, CA. This letter authorizes
maintenance dredging bayward of the 743 Via Lido Soud and 853/835 Via Lido Soud (as
shown on enclosed maps).
Based on the information you have provided, the Corps of Engineers has
determined that your proposed activity complies with the terms and conditions of
Regional General Permit (RGP) No. 54 -Maintenance Dredging, Beach Nourishment, and
Dock Maintenance.
As long as you comply with the general permit conditions of RGP No. 54 -
Maintenance Dredging, Beach Nourishment, and Dock Maintenance, an individual
permit is not required.

Specifically, you are authorized to:
1. Perform dredging activities with a hydraulic dredge and small track -mounted skid
steer loader;
2. At 743 Via Lido Soud, dredge 180 cubic yards of material from an 0.055 acre area
and discharge material over an 0.061 acre area for 60 linear feet; and
3. At 853/835 Via Lido Soud, dredge 430 cubic yards of material from an 0.087 acre
area and discharge material over an 0.069 acre area for 100 linear feet.
A general permit does not grant any property rights or exclusive privileges. This
letter of verification is valid until October 4, 2011. Also, it does not authorize any injury
to the property or rights of others or authorize interference with any existing or
proposed Federal project. Furthermore, it does not obviate the need to obtain other
Federal, State, or local authorizations required by law.

This is to inform you that I will be dredging the dock at 1200 West Bay Ave on
Saturday, November 6th and dredging at 835 Via Lido Soud on Sunday, November
7th, starting at 7am. The need to utilize the high tides occurring in the morning makes
it necessary to operate outside of normal hours. Please inform the Harbor Patrol and the
Newport Beach Police Department.

1, JUsa E. Miller, President, Shellmaker Inc. (Applicant / Agent), hereby certify that the
information on this application is accurate and complete. I also certify that I have read the California
Coastal Commission Permit 5-06-117 & Federal Consistency Certification CC -031-06, the Army Corps
of Engineers Regional General Permit No. 54 (File No. 200501233 -DPS) and the California Regional
Water Quality Control Board General Certification for Regional General Permit No. 54 for maintenance
dredging in Newport Harbor and that I will comply with all of the conditions in those permits. I also
certify that by acceptance of this Permit, the applicant acknowledges and agrees that the site may be
subject to hazards from waves and erosion.
I will ftirther hold the City of Newport Beach harmless from and indemnify the City against any claim for
damages arising out of the exercise of these permits. In addition, I shall reimburse the City of Newport
Beach for all attorney's fees and other costs expended by them in defending any claim, lawsuit, or
judgment arising out of the activities of the applicant carried on under the authority of such Permit.
I understand that any work authorized must be completed by October 4, 2011 after which a new
authorization is required. I also understand that the applicant will submit a Post Dredging Completion
Report no later than 30 calendar days after completion of each dredging project. All work scheduled to
be completed before 7:00 AM or after 6:00 PM (Monday - Saturday) or on Sundays or holidays must be
approved by Harbor Resources.
Per the RGP Permit, all dredging applications will be processed by the various agencies through monthly
batch submittals sent to them by Harbor Resources. Therefore, all dredging qpplications must be

Presented herewith are the results of our phi grain size analyses performed on
the soil samples provided to us by your firm. Sample 1 is from the disposal site,
while Sample 2 is from the dredge area. The test procedures were in accordance
with ASTM D 422-63 (1998) and U.S. Army Corps of Engineers Report Number
CETA 79-7 criteria.

events conform with Consistency Certifications CC -078-99 and/or CC -077-01 and that no further federal
consistency review is necessary from the Commission for the dredging components of the projects. In addition,
the proposed beach disposal events have been reviewed and found by the Executive Director to be consistent with
Special Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is
necessary from the Commission for the beach disposal components of the projects.
Please be advised that only the projects described in the materials submitted for the sites listed above have been
found to conform with Consistency Certification CC -078-99 and CC -077-01 and/or conform with the terms and
conditions of Coastal Development Permit 5-99-282, as amended. Any change in the projects may cause them to

The City of Newport Beach Marine Department has received a
request to transfer pier permit 0172-0843-1 for the property
located at 853 Via Lido Sud, Newport Beach, California. The
facility was.inspected by a representative of the Newport Beach
Marine Division on July 19, 1996.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. This requirement is in accordance with Title 17 of the
California Administrative Code.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures
shall be inspected for compliance with the City's
minimum plumbing, electrical and structural
requirements, and the conditions of the existing
permit. All structural deficiencies must be corrected
prior to transfer of the
permit-"

SUBJECT: Waiver of Coastal Development Permit Requirement/De Minimis
Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provid.ed in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is found to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.

NEWPORT BEACH
PROPOSED DFVELOPMFNT: Enlarge the existing residential dock within the U.S.
Project line.
RATIONALE: The project would be within the U.S. project line which is
consistent with the City's Marine Department"requirements and is consistent
with the Commission's previous actions.
This waiver will not become effective until reported to the Commission at their
March 22-25, 1988 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requirements, a coastal development permit will be reauired.

The records of the City of Newport Beach indicate the Harbor Permit
for the pier and float for the property described as Lot 312 and the
easterly J.5 feet of Lot 311, of tract 907, the said easterly 15 feet
of Lot 311 being measured along the northerly line of said lot, in
the City of Newport Beach, County of Orange, State of California, as
per map recorded in Book 28, page 25 to 36 inclusive of miscellaneous
maps, in the office of the County Recorder of said County is in the
name of Anson I. Dreisen, Trustee, even though Charlotte and
Maynard Franklin had purchased the property some years back. It
appears that at that purchase date, the Franklins failed to have
the above permit transferred into their names.
The Franklins now are selling the property to Warner Wheeler Henry,
Trustee, and wish to transfer the pier permit to him.
The purpose of this letter is to acknowledge that the City of Newport
Beach will. allow the transfer now of the above Harbor Permit from
Anson I. Dreisen, Trustee to Charlotte and Maynard Franklin with
just the signatures of the Franklins on*the transfer card.
The City of Newport Beach will then allow the transfer of the above
Harbor Permit from the Franklins to Warner Wheeler Henry, Trustee.
After this transfer has occurred, Warner Wheeler Henry, Trustee will become
