LAND USE AGREEMENT
This Agreement is made and entered this day of —1
1995, by and between Kenneth G. Robinson (hereinafter referred to
as "Owner"), and the CITY OF NEWPORT BEACH (hereinafter referred to
as "City"), with respect to the following facts:
1 . owner is the present owner of the real property and
structures thereon located at 233 Via Lido Soud, Newport Beach
California (hereinafter referred to as the "property"):
2. The property is located adjacent to Newport Harbor within
the City of Newport Beach, and is subject to the provisions of
Newport Beach Municipal Code, Chapter 17.24 -- Structures in
Harbor.
3. Owner recently reconditioned the pier and floating dock
at his property without first having obtained a permit required by
Newport Beach Municipal Code § 17.24.010. When the Newport Beach
Marine Director investigated the reconditioned pier, he found that
it is larger than allowed by Newport Beach Municipal Code Chapter
-1-
17.24. However, the pier had been built to that size without
permit prior to the time Owner bought the property.
4. It is the desire of the City and Owner to avoid the time
and expense of contested litigation and to seek a mutually
satisfactory settlement of the code violation. Therefore, the City
and Owner agree as follows:
a. That Owner shall maintain the pier and dock in its
present configuration as long as he is the owner of the
property;
b. That Owner shall bring the pier and dock into
conformance with the Newport Beach Municipal Code and any
Coastal Commission regulations prior to the transfer of
ownership to any third party. This requirement shall not
be triggered by transfer to a Robinson Family Trust or to
the children of Kenneth G. Robinson.
C. Owner further agrees that on or before March 31,
1995, he shall submit detailed plans and drawings to the
Newport Beach Marine Department, depicting the structure
in the harbor as it presently exists.
5. Owner acknowledges that the property has no non-
conforming property rights allowing the oversized structure in the
harbor.
It is further agreed that if this Agreement is breached,
then City may seek the specific performance of this Agreement in
addition to seeking temporary, preliminary and permanent injunctive
relief. The parties agree that specific performance is an

appropriate remedy, that monetary damages for such violations would
be inadequate and difficult to ascertain, and that any repeated
violation would cause irreparable injury to the City.
6. This Agreement shall inure to the benef it of the City and
shall be binding on Owner's heirs, successors and assigns -in -
interest, except as provided in paragraph 4(b).
7. Attorneys' fees shall be awarded to the prevailing party
in any action to enforce the provisions of this Agreement.
8. It is expressly agreed by and between the parties hereto
that the various provisions contained in this Agreement are
severable. If any provision of this Agreement is held to be
invalid or unenforceable, all other provisions shall continue in
full force and effect.

Dear Mr. Robinson:
Now that Laura Sheedy has left the office, this file has made
its way to me for further handling.
It appears that an amicable resolution has been reached
regarding the above. Specifically, a land use agreement has been
agreed upon as the solution to this problem. In essence, the
agreement will allow the pier and dock to remain in its present
configuration. However, prior to the transfer to the property to
a third party, it shall be brought into conformance with both the
applicable Newport Beach Municipal Code and any coastal commission
regulations.
All that appears to remain is formalizing this agreement into
written form. Ms. Sheedy drafted one, and it looks to be in order.
Please contact this office order that we can finalize the
agreement.

Thank you for attending our office conference on May 17, at
which we discussed the pier and floating dock adjacent to your
property. At that meeting we discussed entering into a land use
agreement by which the City would allow you to maintain the pier as
it presently exists and you would agree to cut back the pier if
title to the property passes from you.
Upon further review of Newport Beach Municipal Code Chapter
17.24 "Structures in Harbor," I believe the best approach to
resolving this matter is for you to apply for a permit for this
structure as it currently exists. Both the City Council and the
Corp of Engineers will be required to approve the permit. Because
you have documentation, and Tony has pictures of the dock as it
existed prior to the time you purchased the property, these permits
might be approved. If they are not granted, then the we can begin
to work on resolving the issue through other channels.
In order that the matter may be resolved, please make
application for the pier and floating dock by July 1, 1994. Thank
you for you anticipated cooperation in this matter.

Dear Mr. Robinson:
The file for the above referenced matter has been referred to
this office for further action. I understand that you, or your
agent, Swift Slip, applied to revise the float bayward of your
residence at 233 Via Lido Soud. Apparently, both the stationary
pier and the floating dock were rebuilt and are not in conformance
with the Newport Beach Municipal Code, -Chapter 17.24, "Structures
in Harbor." The redecking work extended beyond the scope of the
permit. In fact, the redecked pier is larger than the pier which
is approved by permit, or by the Municipal Code, at that location.
You must either bring the pier into conformance with the
existing permit issued for that location, or obtain a revised
permit for the pier as it now exists. You have been informed that
the pier is too large to comply with the Newport Beach Municipal
Code or to get approval from the California Coastal Commission or
the Army Corp of Engineers. Therefore, you will have to cut back
the size of the pier in order to obtain a new permit.
Please decide which of these actions you are going to take and
inform the City on or before May 1, 1994. If no action has been
taken regarding this matter by May 1, this office will commence
legal action to enforce the Newport Beach Municipal Code.
Please contact Tony Melum. at the Marine Department, 644-3044,
to discuss with him any questions regarding this letter.

In late November, during routine inspection of a dock
.construction, we became aware Df the property owner doing work in
access of the scope of the permit, essentially in violation of
Section 17.24 of the New -port Beach Municipal Code. We informed
the property owner at the time of the violation and attached for
your information are two of the letters we have since sent him, to
no avail.
Essentially the work has been completed and the structure is not in
conformance with the City's Harbor Permit Policies and a permit was
not pulled for the work done.
We would appreciate your assistance in getting this matter,
resolved.

In response to your above referenced letter, I have previously
reviewed the situation with Tony Melum. It is my desire to
cooperate, and, at the same time, protect my own property rights.
My position is that documentation and circumstances entitle me to
keep the existing pier.
Tony suggested it would be advisable for he, myself and the City
Attorney to have a meeting. Hopefully, we will be able to

As I mentioned to you at our meeting in late December, we have
no alternative but to require that your pier be brought into
conformance with the standard dimensions, 10 X 14 feet, as required
by the City Council Harbor Permit Policies.
Because this matter has not yet been resolved, it will be necessary
for me to turn it over to the City Attorney's office for legal
f ollow-up.

Dear Ken,
On 12/6/93 we received an application from Swift Slip to revise the
float bayward of your residence at 233 Via Lido Soud. We are
unable to issue a maintenance permit for this work because the
revisions are too extensive to qualify for a maintenance permit and
would require permits from the Army Corp of. Engineers and the
California Coastal commission.
In addition to the above it was indicated on the drawing submitted
that there would be redecking of the existing pier. An inspection
by our Field Inspector has indicated that the piers dimensions
exceed the existing permit for the pier. The pier must be brought
into conformance with the permit issued to the property or
application must be made for a revision permit for the pier. This
could be done however, the dock would have to conform to the City's
Harbor permit policies and standard drawings. This would limit the
size of. the pier to 101 wide by 141 long. Failure to bring the
pier's dimensions into conformance with the above could be grounds
for revocation of the permit as delineated in Section 17.24.090 of
the Newport Beach Municipal Code ' Section 3, which states:
Revocation of Permit.
3. The work or structure does not comply with the permit or
does not meet the standards adopted by the City Council
for such work or structure.

Dear Property Owner/Agent:
On February 25, 1985 the Marine Department received a complaint
regarding the use of the float bayward of your property at 229
Via Lido Soud. Specifically, the complaint was that a vessel tied
on the south side of your float was encroaching into the adjacent
property owner's permit area. The complaint included photographs
whcih seemed to indicate there was, in fact, an encroachment.
On March 18, 1985 at 4 P.M. I went to the residence at 229 Via
Lido Soud and ' met with Mr. Jerry O'Connor, owner of the vessel
moored on the south side tie. From.my inspection is appeared
that the vessel did not encroach into the adjacent permit area
as currently moored, and as long as it remains moored in this
location it should not present a problem.

Dear Tony,
On 1/19/85, our neighbors at 229 Via lido Soud permitted their tenant to tie up
his boat on their dock finger next to our property. The tenant's boat is
large and encroached onto our property when tied 111) there. According to the
property surveyor's metal stake�-embedded on the Droperty 'Line between our lots,
the edge of the block vall closest to our house runs right along the property
line. 1-�Then that line is extended ba�.7zard, the tenant's boat -1*1.s oil our

propertyo� The encroachment vari-es from a few inches to 5 or 6 feet as the
boa�t sways vith the water & wind. (diagram attached)
We notified the prope-rty owner, Amber Massey, her grandaughter/agent, Tilish Quinn,
and the boat owner, Jerry, of the encroachment. We asked them to either
move the boat or financially compensate us for the loss of use of our -2,--ope-rt,),-#
