Dear Sirs:
The City of Newport Beach Harbor Resources Office has received a request to transfer
the above noted pier permit for 239 Via Lido Soud. The facility was inspected on April
11, 2001. We cannot transfer the pier permit until the following deficiencies has been
corrected and we have been notified of the correction:
A new Backflow Prevention Device must be installed at the facility. The purpose of this
device is to protect the domestic water system from being contaminated by seawater.
A drawing of an approved device and a drawing showing a typical installation is
attached. The device that is in use currently no longer is accepted by the State of
California Health Department and must be updated.
There is a dock float that protrudes beyond the edge of the dock. This must be repaired.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.
Also, the annual pier permit fee has not been paid for 2001. At this time that fee is
$97.50. This office cannot transfer the permit until this fee is paid.

The City of Newport Beach has received an application to transfer
pier permit #173-239 f6r the property located at 239 via Lido.Soud,
Newport Beach, California.
The structure was i . nspected on 12/20/85 at which time it was determined
that the following deficiencies exist:
A City -approved anti-syphondevice is needed at water connection to pier.
Must.be installed, before transfer of pier permit.
2. Dry rot.on-dock�should be repaired. This item, however, will not
prevent transfer of the pier.

In accordance with Section 10-D of the City Harbor Permit Policies:
'lAll structural deficiencies must be corrected......", it will be
necessary for these to be corrected. A permit for any electrical or
plumbing work must be obtained from the Building Department.of the City.
All other work requires a Harbor Permit.
Please advise this deDartment when the above deficiencies have been corrected.
Another inspection Wfll be made, and if the deficiency is solved, it will
then be possible to transfer the pier to the new owner.

Newport Beach harbor Permit Policies 103 states: "Whenever a permittee sells the

It has come to the attention of the Marine Department that you have not compieted the
process of transferring the Harbor Permit for the pier and dock bayward from the above
named property.
The Harbor Permit Policies section 10.13 states:
"WhenevIer a permittee sells the abutting upland property, a request shall be made
to the City to transfer the permit. Forms for this purpose may be obtained from
the Marine Department. Failure to apply for a transfer with 30 days from the date
that the abutting upland property changed ownership will result in an additional
fee by the City."
To complete the transfer this department requires the following:

2. Permit fee
Failure to comply with this requirement will result in the matter being turned over
to the City Attorney for further action.
