Dear Mr. Feurestein:
The pier and float at the above z,,ddress has been inspected
by the Newport Beach Marine Department in regard to transfer
of the permit. The general impression of the inspector who
looked at the structure was that it was in a serious state
of disrepair and needed the folljwing items:
1. The water line to the dock should be in PVC and should
be approved by the City of Newport Beach Building Department
2. A City -approved anti -syphon device must be installed on
the water connection to the pier.
3. All electrical service to the dock should have a building
permit and should be installed according to Building
Department requirements, must be in conduit and have
waterproof outlets.
4. The dock itself has many broken and rotted areas and
needs repair on the decking and supports.
This dock poses a potential safety hazard and must be removed
or repaired as soon as possible. Please contact me within
15 days of receipt of this letter to let me know your plans
for improvements to the above dock.

A check of,the City Harbor Permit files has shown that the permit
for the pier and float at ' 309 Via Lido Nord,
Newport Beach, is registered to H.W. Meister.
A transfer application - must.be completed and a transfer fee paid
each time the permit has changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a pier permit and rpads as follows:
"No person shall transfer a permit for a.pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City."
Failure to pay the transfer fees can be grounds for revocation of
the Harbor Permit in accordance with Chapter 17.24-090 of the
Municipal Code.

SUBJECT: HARBOR PERMIT NO. A -456-R (Bayward of 309 Via Lido Soud)
DISCUSSION:
On June 24, 1968 the City Council approved Harbor Permit No. A -456-R for
George Gaudin at 309 Via Lido Soud. A copy of the exhibit submitted by Mr. Gaudin will
be on display in the Council Chamber. On July 12 a protest was received from Mrs. Mary
Howard Monrad, 305 Via Lido Soud. On July 22 a petition protesting the permit was
received from 13 residents of Via Lido Soud (including Mrs. Monrad). The letter and
petition were ordered filed. The residences of the petitioners will be shown on a
map on display in the Council Chamber.
On August 19, Mr. Jerome Robinson and others addressed the Council protesting
the permit. The matter was referred to the staff to check the facts.
The distance was measured with a tape between the end of Mr. Gaudin's present
pier and the nearest mooring buoy directly opposite and found to be 127 feet rather than
the 160 feet previously reported by the Public Works Department. The pierhead is 70 feet
from the bulkhead. If a boat was on the mooring the width of the channel would be
diminished by half of the beam of the boat plus the distance Mr. Gaudin's boat projected
beyond the pierhead.
In the case of a residence located three houses to the east at 319 Via Lido
Soud, the pier extends 80 feet from the bulkhead under a permit issued in 1958.
In the opinion of the Public Works Department the channel will be wide enough
to permit boats to use it even when Mr. Gaudin's boat is at its float and when a boat
is on the mooring.
The H,arbor Master has been contacted. He has advised that no action would be
taken on this matter unless the boat is operated improperly. A letter to this effect has
been requested from the Harbor District.
Mr. Gaudin has discovered that the ramp shown on his application drawing is in
the wrong location. He desires to move the ramp to the east to align it with the door
to his house. Under the circumstances he is reluctant to apply for revision to his permit.
The Public Works Department will issue the revision administratively -subject to an appli-
cation being filed unless the City Council has any objections.
CONCLUSIONS:
It should be emphasized that this harbor permit per se has no relationship to the
size of any boat which may be moored at the float. The only reason the permit required
Council approval was the fact that the float is at an angle to the bulkhead. In considering
action on the permit there appear to be at least two possible courses:
1. Cancel the suspension of the permit and file all protests on the grounds that
not enough new information has been developed to warrant calling a public
hearing to determine whether or not the permit should be revoked.
2. Schedule a public hearing to determine whether the permit should
because new information has shown that the permit was approved on
of incorrect information.

DISCUSSION:
On June 24, 1968 the City Council approved Harbor Permit No. A -456-R for
George Gaudin at 309 Via Lido Soud, A copy of the exhibit submitted by Mr. Gaudin will
be on display in the Council Chamber, On July 12 a protest was received from Mrs. Mary
Howard Monrad, 305 Via Lido Soud, On July 22 a petition protesting the permit was
received from 13 residents of Via Lido Soud (including Mrs. Monrad). The letter and
petition were ordered filed, The residences of the petitioners will be shown on a
map on display in the Council Chamber.
On August 19, Mr. Jerome Robinson and others addressed the Council protesting
the permit, The matter was referred to the staff to check the facts.
The distance was measured with a tape between the end of Mr. Gaudin's present
pier and the nearest mooring buoy directly opposite and found to be 127 feet rather.than
the 160 feet previously reported by the Public Works Department. The pierhead is 70 feet
from the bulkhead. If a boat was on the mooring the width of the channel would be
diminished by half of the beam of the boat plus the distance Mr. Gaudin's boat projected
beyond the pierhead.
In the case of a residence located three houses to the east at 319 Via Lido.
Soud, the pier -extends 80 feet from the bulkhead under a permit issued in 1958.
In the opinion of the Public Works,Department the channel will be wide enough
to permit boats to use it even when Mr. Gaudin's boat is at its float and when a boat
is on the mooring.
The Karbor Master has been contacted. He has advised that no action would be
taken on this matter unless the boat is operated improperly. A letter to this effect has
been requested from the Harbor District.
Mr. Gaudin has discovered that the ramp shown on his application drawing is in
the wrong location. He desires to move the ramp to the east to align it with the door
to his house. Under the circumstances he is reluctant to apply for revision to his permit.
The Public Works Department will issue the revision administratively subject to an appli-
cation being filed unless the City Council has any objections.
CONCLUSIONS:
It should be emphasized that this harbor permit per se has no relationship to the
size of any boat which may be moored at the float. The only reason the permit required
Council approval was the fact that the float is at an angle to the bulkhead. In considering
action on the permit there appear to be at least two possible courses:
1. Cancel the suspension of the permit and file all protests on the grounds that
not enough new information has been developed to warrant calling a public
hearing to determine whether or not the permit should be revoked.
2. Schedule' a pu,blic-hearing to determine whetheir' thle----permit should be revoked

Gentlemen:
This lawfirm represents Mrs. Mary Howard Monrad, of
305 Via Lido Soud, Newport Beach, California, in con-
nection with the above referenced application of Mr.
George Gaudin, of 538 Via Lido Nord.
Due to circumstances of an emergency nature, Mrs. Monrad
was unable to appear before the City Council at the
time this matter was considered by the Council, to voice
her objections to the application. Mrs. Monrad resides
next door to the subject property, and is deeply con-
cerned with the project because the boat will project
20 feet bayward of the U. S. Project line, into a very
small(160 foot wide) channel between pier heads and
nearest moored boats. Not only will this project sub-
stantially damage the view of Mrs. Monrad's proper
ty,
it will seriously interfere with the handling of large
boats in this narrow channel. Numerous large boats are
moored on the northerly side of Lido island across the
bay, adjacent to Highway 101 frontages, without creating
problems of the type presented by this application, be-
cause of the width of the channel. The North Lido Channel
is 590 feet wide between pier heads.
The slant type of construction which the applicant contem-
plates, is of course, a substantial deviation from your
policy, and presents a precedent for all sorts of unusual
types of mooring to accomodate large boatso which may very
well cause the City many future problems. It would seem
City Council -2-
that any large boat owner would be in a position to claim
hardship and the right to vary from standard construction
perpendicular bulkheads.
It is respectfully requested that prior to the vesting
of any rights in the applicant, that this matter be set
down for reconsideration at the next regular meeting
of the City Council and that all parties concerned be
given notice and the opportunity to appear and be heard.

Gentlemen:
In reference to Permit #A -456-R granted to me on July 5,,
1968 for the installation.of a new slip for mooring of my
boat, it has now come 'to my attention that the adjoining
property owners seem to be in contention with tbis installa-
tion.
I previously.contacted Mrs. Howard and advised her of the
Council meeting on the evening the permit was issued and
they did not seem to think it was necessary to appear as no
one did. Mr. Katz, I finally learned, was in Europe so I
could not advise him.
Mrs. Howard told me that if the boat did not extend over the
property lines she would have no objection. She told me
that her husband was on his way home and when he arrived
home she would have him call me. I did not hear from her
until about.�9..:OO O'clock when I called her back and she
said her h ' usband had been !'. dblayed.'!, because the car bad.
broken down o.n.the freeway and she would have him call me
as soon.as he_gq�'Ihome. This he didli6t do,
Mrs. J. H. Massie'at 229 Via Lido Soud phoned me and offered
to sell me her dock;,as she had heard -I was putting a big
boat in front of our home,
We have had several large boats,in several different.places
and have never. had any complaints from the neighbors or
have we ever had any accidents to any children or annoyed
anyone in any way# after we were once established.
'There are a number of people living on Lido Isle who feel
that a boat of this kind in a similar location would not
cause any trouble in any way, including some of our present
neighbors and also some on Lido Soud.
The people involved in the three escrows appreciate the
help the Council has given us and we have moved into our
new home at 309 Via Lido Soud. If I can be ofany further
assistance to you, please call on me.,

RECOMMENDATION:
That if the application be approved, it be subject to the prior
approval of the U. S. Corps of Engineers.
DISCUSSION:
The prior approval of the City Council is required because the
application does not conform to the standard harbor drawings. The standard drawings
only permit slip floats. to be constructed perpendicular to bulkheads.
Piers are permitted,to extend bayward 20 feet of the U. S. Pierhead
Line in this area, subject to the prior approval of the U. S. Corps of Engineers.
On June 10th, Mr. Gaudin appeared before the City Council. He in-
dicated that he desired to moor his 96 foot cruiser at the proposed float. The boat
will extend from one side property line'to the other, and the boat will project 20 feet
bayward of the U. S. Project Line. The request was referred to the staff.
The installation as proposed probably will not damage any seawalls or
aggravate erosion problems, however, -Mr. Gaudin's boat is unusually large and would
project 20 feet beyond the U. S.:Project Li.ne into the 160 foot wide channel between
the pierheads and the nearest moored boats. By way of contrast, the north Lido
channel is 590 feet wide between pierheads.
A large drawing will be on display in the CO'Rncil Chamber, showing
how the boat would fit in the space.
