The general impression of the inspector who looked at the structure was that it was in a serious state of disrepair and needed the folljwing items: 1. The water line to the dock should be in PVC and should be approved by the City of Newport Beach Building Department 2. A City -approved anti -syphon device must be installed on the water connection to the pier. 3. All electrical service to the dock should have a building permit and should be installed according to Building Department requirements, must be in conduit and have waterproof outlets. 4. The dock itself has many broken and rotted areas and needs repair on the decking and supports. This dock poses a potential safety hazard and must be removed or repaired as soon as possible. A -456-R (Bayward of 309 Via Lido Soud) DISCUSSION: On June 24, 1968 the City Council approved Harbor Permit No. A -456-R for George Gaudin at 309 Via Lido Soud. A copy of the exhibit submitted by Mr. Gaudin will be on display in the Council Chamber. On July 12 a protest was received from Mrs. Mary Howard Monrad, 305 Via Lido Soud. On July 22 a petition protesting the permit was received from 13 residents of Via Lido Soud (including Mrs. Monrad). The letter and petition were ordered filed. The residences of the petitioners will be shown on a map on display in the Council Chamber. On August 19, Mr. Jerome Robinson and others addressed the Council protesting the permit. The matter was referred to the staff to check the facts. The distance was measured with a tape between the end of Mr. Gaudin's present pier and the nearest mooring buoy directly opposite and found to be 127 feet rather than the 160 feet previously reported by the Public Works Department. The pierhead is 70 feet from the bulkhead. If a boat was on the mooring the width of the channel would be diminished by half of the beam of the boat plus the distance Mr. Gaudin's boat projected beyond the pierhead. In the case of a residence located three houses to the east at 319 Via Lido Soud, the pier extends 80 feet from the bulkhead under a permit issued in 1958. In the opinion of the Public Works Department the channel will be wide enough to permit boats to use it even when Mr. Gaudin's boat is at its float and when a boat is on the mooring. The H,arbor Master has been contacted. He has advised that no action would be taken on this matter unless the boat is operated improperly. A letter to this effect has been requested from the Harbor District. Mr. Gaudin has discovered that the ramp shown on his application drawing is in the wrong location. He desires to move the ramp to the east to align it with the door to his house. Under the circumstances he is reluctant to apply for revision to his permit. The Public Works Department will issue the revision administratively -subject to an appli- cation being filed unless the City Council has any objections. CONCLUSIONS: It should be emphasized that this harbor permit per se has no relationship to the size of any boat which may be moored at the float. The only reason the permit required Council approval was the fact that the float is at an angle to the bulkhead. In considering action on the permit there appear to be at least two possible courses: 1. Cancel the suspension of the permit and file all protests on the grounds that not enough new information has been developed to warrant calling a public hearing to determine whether or not the permit should be revoked. 2. Schedule a public hearing to determine whether the permit should because new information has shown that the permit was approved on of incorrect information. i0seph T. A -456-R (Bayward of 309 Via Lido Soud) DISCUSSION: On June 24, 1968 the City Council approved Harbor Permit No. A -456-R for George Gaudin at 309 Via Lido Soud, A copy of the exhibit submitted by Mr. Gaudin will be on display in the Council Chamber, On July 12 a protest was received from Mrs. Mary Howard Monrad, 305 Via Lido Soud, On July 22 a petition protesting the permit was received from 13 residents of Via Lido Soud (including Mrs. Monrad). The letter and petition were ordered filed, The residences of the petitioners will be shown on a map on display in the Council Chamber. On August 19, Mr. Jerome Robinson and others addressed the Council protesting the permit, The matter was referred to the staff to check the facts. The distance was measured with a tape between the end of Mr. Gaudin's present pier and the nearest mooring buoy directly opposite and found to be 127 feet rather.than the 160 feet previously reported by the Public Works Department. The pierhead is 70 feet from the bulkhead. If a boat was on the mooring the width of the channel would be diminished by half of the beam of the boat plus the distance Mr. Gaudin's boat projected beyond the pierhead. In the case of a residence located three houses to the east at 319 Via Lido. Soud, the pier -extends 80 feet from the bulkhead under a permit issued in 1958. In the opinion of the Public Works,Department the channel will be wide enough to permit boats to use it even when Mr. Gaudin's boat is at its float and when a boat is on the mooring. The Karbor Master has been contacted. He has advised that no action would be taken on this matter unless the boat is operated improperly. A letter to this effect has been requested from the Harbor District. Mr. Gaudin has discovered that the ramp shown on his application drawing is in the wrong location. He desires to move the ramp to the east to align it with the door to his house. Under the circumstances he is reluctant to apply for revision to his permit. The Public Works Department will issue the revision administratively subject to an appli- cation being filed unless the City Council has any objections. CONCLUSIONS: It should be emphasized that this harbor permit per se has no relationship to the size of any boat which may be moored at the float. The only reason the permit required Council approval was the fact that the float is at an angle to the bulkhead. In considering action on the permit there appear to be at least two possible courses: 1. Cancel the suspension of the permit and file all protests on the grounds that not enough new information has been developed to warrant calling a public hearing to determine whether or not the permit should be revoked. 2.
