Developments -Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit application for the development
described below, the Executive Director of the Coastal Commission hereby waives the requirement
for a Coastal Development Permit pursuant to Section 13238.1, Title 14, California Code of
Regulations. If, at a later date, this information is found to be incorrect or the plans revised ' 'this
decision will become invalid; and, any development occurring must cease until a coastal
development permit is obtained or any discrepancy is resolved in writing. .
WAIVER #: 5-00-287 APPLICANT: Gary Brill
LOCATION: 128 Via Lido Nord, Newport Beach, Orange County
PROPOSED DEVELOPMENT: Reconfiguration of existing "Ll -shaped" residential dock, including
removal of existing 5' x 50' finger, widening of remaining finger to 10' x 55', and removal of three (3)
existing 12" diameter piles and replacement with four (4) new 18" diameter guide piles. No work is
proposed to the existing gangway, platform or bulkhead. The dock will remain within the U.S.
Pierhead Line.
RATIONALE: The proposed development consists of the reconfiguration of an existing dock within
the U.S. Pierhead Line. The subject site is located on Lido Island within Newport Harbor in the City
of Newport Beach. Vertical public access to the harbor exists at the street end of Via Antibes,
immediately east of the subject site. Lido Island, like the majority of islands in Newport Harbor, is
surrounded by private recreational boat docks associated with residential development. Therefore,
the proposed dock is similar in function to other residential docks in the immediate vicinity. An
inspection performed by the City determined that no eelgrass exists in the. vicinity of the proposed
project. Therefore, no eelgrass will be affected by the proposed project. Also, the Regional Water
Quality Control Board has determined that the proposed project will not adversely impact water
quality if standard construction methods and materials are used. The proposed development will not
result in adverse impacts to coastal access, coastal resources, public recreation or coastal views.
The proposed development would not prejudice the City's ability to prepare a Certified Local Coastal
Program and is consistent with the land use designation in the City's certified Land Use Plan, past
Commission actions in the area and Chapter 3 policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their September 12-15,
2000 meeting and the site of the proposed development has been appropriately noticed, pursuant to
13054(b) of the California Code of Regulations. The enclosed Notice Card shall remain posted at
the site until the waiver has been validated and no less than seven days prior to the Commission
hearing. If four (4) Commissioners object to this waiver of permit requirements, a coastal

Reference is made to your letter dated April 10, 1998 in which you submitted on behalf
of Mr. Gary Brill who resides at 128 Via Lido Nord, a notification for the maintenance
dredging of 135 cubic yards of sand and silt material by hydraulic suction and disposal of the
dredged material on the adjacent beach.
Based on the furnished information, we have determined that the proposed
maintenance dredging activity complies with the terms and conditions of Permit No. 89 -211 -
GS provided that Mr. Brill's contractor does not exceed the maximum dredging design depth
of -5 feet MLLW with a maximum allowable overdepth of -1 foot MLLW.

Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0175-0128-1 for the property located at 128
Via Lido Nord, Newport Beach, CA.. The facility was inspected on
October 4,, 1994.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. The electrical receptacles must be GFI or twist lock to be used
in a water environment.
2. A City -approved anti -syphon device is required at the water
�connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed. The device presently on the water service is no l9ng?r
an approved backflow prevention device. This reguirement is in
accordance with Title 17 of the California Administrative Code.
A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
The Newport Beach City Council Harbor Permit Policies state:
10.D. ,At the time of transfer, all harbor structures
shall be inspected for compliance with the City Is minimum
plumbing, electrical and structural requirements, and the
conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the
permit."
PLEASE ADVISE THIS DEPARTM= WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred.

The structure was inspected on August 24, 1988 and in accordance
with Section 10-D of the Harbor Permit Policies, it cannot be
transferred until it meets City requirements. The policy states:
10.D. "At the time of transfer, all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements, and the conditions of
the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit."
We cannot transfer the permit until the following deficiencies

Dear Sir:
On two occasions the Newport Beach Marine Department has corresponded with
you regarding a use at your residential dock at 128 Via Lido Soud, in violation
of the Newport Beach Harbor Permit Policies. Specifically, a vessel moored
at your dock is encroaching into the permit area at 124 Via Lido Soud.
As of 1/8/81 this situation still exists. If it is not corrected by 1/20/81
it will be necessary for the Marine Department to commence the procedures
to have the permit revoked and the dock removed, as provided for in Sections
17.24.090 and 17.24.100 of the Harbor Regulations of the Newport Beach
Municipal Code.
Section 17.24.090: "Any permit heretofore or hereafter granted for
any structure or work in the waters of Newport Harbor or the Pacific
Ocean may be revoked by the City Council upon any of the following
grounds:....7. The permittee has breached or failed to comply with
the terms or conditions contained in the permit or upon which the
permit was granted."
Section 17.24.100: "Every structure maintained in or over the waters
of Newport Harbor or the Pacific Ocean without a current valid permit
existing therefor when required by this Chapter, or maintained in a
manner or for a purpose other than or different from that provided in
the permit, shall constitute a nuisance and shall be -immediately
abated and may be removed. If upon written notive to remove any
such structure the owner thereof fails, refuses or neglects to do
so within a reasonable time specified in the notice, being not less
than five (5) or more than thirty (30) days after Such notice, the
City shall abate or remove it and the cost thereof may be recovered from
the owner of such structure in a civil action."

ponded with you regarding a vessel tied to the dock at the
above address and encroaching into the adjacent permit area bay -
ward of a property owned by Rita Kincaid.
Mrs. Kincaid, through a representative, has indicated the en-
croaclun,ent still exists and she would like the situation corrected.
The encroaching vessel must be relocated within ten (10) days to
preclude further action by the Marine Department.

The Newport Beach Marine Department has received a complaint regarding the
use of your residential float at 128 Via Lido Nord. Specifically, the com-
plaint states a vessel is tied to the west side of your float in violation
of the Harbor Permit Policies, section 21. A., which states in part:
"Boats moored at private or public docks shall not extend beyond
the projection of the property lines of the property to which the
dock facility is connected ........
On August 22, 1980, 1 viewed the violation in the field. A grey sailboat,
CF 9241 GF, is in fact over into the permit area of the residence at 124
Via Lido Nord. To correct this situation,the above listed vessel must be
relocated.

Discussion
The applications require City Council approval under the conditions of
approval placed on the City of Newport Beach general permit for maintenance
dredging issued by the U. S. Army Corps of Engineers on February 12, 1974,
and subsequently amended on May 10, 1977 to allow beach restoration. The
locations and applicants for the proposed dredging and beach restorations

The staff has reviewed the projects and has determined that the work will
be done within the parameters of the Corps of Engineers permit. The
dredging contractor will place a filter screen around the discharge site
to control turbidity. There is no known eei grass in the vicinity of the
projects. At 929 Via Lido'Soud, 128 Vla'Lido Nord, and 2130 E. Balboa Blvd..
the dredged material will be placed on adjacent beaches. This will aid in
the restoration of these beaches bayward of privatte.residences. At 2270
Newport Blvd. and 103 Via Lido Soud, the dredged material will be hauled
to sea and dumped.

The South Coast Commission finds that:
1. The proposed project is a boat slip replacement at 128 Via Lido Nord,

Newport Beach. The pro -posed project is larger than the existing facility
but does not extend beyond the U.S. Pierhead Line.
2. The Coastal Act addresses the issues of: 1) diking, filling, and
dredging of open coastal waters, 2) biological productivity and quality
of coastal waters, and 3) facilities serving commercial fishing and rec-
reational boating, in the following sections, 30233(a), 30231 and 30234.
The proposed project is in conformance with the Coastal Act. 0- . F
3. As conditioned, the project is in conformity with the provisions -
Chapter 3 of the Coastal'Act and will not prejudice the ability of the

local government to prepare a local coastal program that is in
with said chapter.
4. As conditioned, the project is in conformity with the public access
and public recreation policies of Chapter 3 of the Coastal Act.
5. As conditioned, the project will have no significant adverse environ-
mental impacts and there are feasible alternatives and feasible mitigation
measures, as provided in the CEQA, available for imposition by this Comm-
ission under the power granted.to it which would substantially lessen any
significant adverse impact that the development, as finally proposed may
have on the environment.

they have received a copy of the permit and have accepted its contents.
VI. Work authorized by this permit must commence within two years from the
date of the Regional commission vote upon the application. Any extension
of time of said commencement date must be applied for prior to expiration
of the permit.

Dear Ms. Muttersbock:
You have requested that I indicate the City of Newport Beach's position
regarding the Harbor Permit application of L. C. Smull to replace an
existing pier and float at 128 Via Lido Nord.
Mr. Smull submitted an application to the City's Marine Department on
November 29, 1978. This application was reviewed and conformance with
City standards and regulations. The review of the application also
includes consideration of the necessity for dredging. Should dredging
be required, the City requires that the application drawing show the
dredging required. Mr. Smull's application does not show any dredging
to be done at this time. Therefore, the City's approval of concept for
this project does not include dredging.
Should Mr. Smull decide, at a future date, that dredging needs to be
accomplished, he will be required to submit a new application to the
Marine Department. This application would also be reviewed for con-
formance with City standards and regulations. The review would also
include consideration for protection of any adjacent beaches both
public and private, and protection for adjacent bulkheads, both
Mr. Smull's and his neighbors.
In conclusion, Mr. Smull's present application does not include dredging
and any future request for dredging will receive careful review by the City.
I hope the above answers any questions regarding the City's procedures,
however, should you need additional information, please let me know.

subject application.,..The undersigned is her attorney in
this matter.
Applicant, L. C. Smull, seeks a permit to re-
place the existing pier, ramp and float allegedly witha
replacement of the same size, apparently meaning the over-
all 80 ft. length'of the pier, ramp and float. The Notice
does not disclose the size of the float, nor whether it will
be larger than the existing approximately 20 ft. x 36 ft.

proval of the concept.

The shoreward end of the existing float is in
less than 2 ft. of water at low tides. The outer edge of
the,ex'isting float is at the -o*ermitted distance of 80 ft.
bayward of the bulkhead line.- Therefore, the new float
will be 24 ft. in shore of the in shore most line of the
present float, and will cover areas which are now above
water level at low and medium tides.
s will require removal of sand and mud so that
the flOat will not be aground and so as to permit use of the
slip. As far as we know, no permit to dredge has been
applied for. Perhaps the sand in the area will be washed out
in the Bay by use of the screws of a yacht.
Removal of the sand from and near the shore will
reduce the amount of above -water -line beach (a beach which
exists only at medium and low tides now), reduce the area on
which tide will ebb.and flow by reason of making a steeper
slope, increase the slope of the above tideland and tideland relative -to
to the gradual, sloping contours on the open area at Antibes
Street end (immediately to the East of subject property) and
the properties to the West of subject property. This will
create a hazard to children who wade and swim in that location.
Children residing in or visiting in waterfront homes nearby
wade in the area, and also children are lured there by the
open area at the Via Antibes Street,end. Furthermore, the
removal.of the sand at subject property will cause the sand to
wash in on it from the areas to the East and the West thereof
with the changing tidal currents and with the surface chop
which will work on the sand at various levels as the water
level changes due t0p the- tides. This is bound to jeopardize
the lateral support needed for the.existing poured concrete
slab bulkheads at the Kincaid property. Those poured bulk-
heads do not extend as deeply as -concrete slab bulkheads or
.other types of bulkheads which can be driven with present da
techniques for making bulkheads. y
Also, the new float will greatly exceed the 36 ft.
maximum lengths of floats in place from the Antibes Street end
to the West. The purpose of enlarging the float
can only be to accommodate a larger boat or several boats so
.that subject property would have a range of unobstructed view
greatly in excess of the view it will permit for the dwellings
to the West, which is unfair and out of character with the
existing developments as far.as the floats are concerned.
