ACTIVITY: Proposed construction and installation of anchor pilings,
pier, ramp and float to extend eighty (80) feet bayward of the City
Bulkhead Line in front of Lot No. 493,Tract 907.,Newport Beach, Orange
County, California, as shown on the drawing accompanying this notice.
PURPOSE AND USE: To provide a private boat docking facility.
FEDERAL, STATE AND LOCAL AUTHORIZATIONS:, Approved by the City of
Newport Beach; and Application No. P-4088 filed with the California
Coastal Zone Conservation Commission - South Coast Region.
ENVIRONMENTAL IMPACT: This office does not intend to prepare an Environmental
Impact Statement on this activity unless significant detrimental effects
are brought to our attention.
CRITERIA: Your written comments or objections should include the number
and date of this notice and must reach this office within thirty (30)
calendar days. The decision whether to issue a permit will be based
on an evaluation of the probable impact of the activity on the public
interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the activity must be balanced
against its reasonably foreseeable detriments. All factors which may
be relevant to the activity will be considered; among those are conservation,
economics, aesthetics, general environmental concerns, historic values,
fish and wildlife values, flood damage prevention, land use classification,
navigation, recreation, water supply, water quality, and, in general,
the needs and welfare of the people. Details of changed conditions
on the final permit action will be provided upon request.

The anti -siphon devices that have been installed on the water lines
to your float (Watts #8 vacuum breakers) are not approved by the
City. The type that must be installed is designated a "continuous
pressure" anti -siphon device as pointed out in Section 14.08.050 (f)
of the Newport Beach Municipal Code.
For specifics, please contact the Newport Beach Community Development
Department Plumbing section.

On August 18, 1978, the Marine Department corresponded with you

regarding the transfer of your pier permit and the general condition
of the structure itself. This procedure is required as set out in
the Newport Beach Harbor Permit Policies Section 10-D.
"At the time of transfer, all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements, and the conditions
of the existing permit. All structural deficiencies must be
corrected within 6 months from the date of transfer."
After the six month period, the Marine Department re -inspects to
determine whether the corrections have been completed.
The property at 502 Via Lido Nord was inspected on March 6, 1979 and
it was noted that the corrections, as outlined in the letter of
August 18', 1978, had not been made.
It is the responsibility of the permittee to make these repairs and if
they are not iiiade, the permit may be revoked and the structure removed
"Section 4-H Repairs: The Permittee shall keep the structure
in good repair at all times. Failure to repair, when written
notice has been given by the Marine Department, shall be cause
for the revocation of the permit.

inclosed two copies of a draft permit authoriziag the construction
and installation of anchor pilings, pier, ramp and float, to extend
eighty (80) feet bayward of the City Bulkhead Line.
THIS PERMIT IS NOT VALID UNTIL SIGNED BY -THE DISTRICT ENGINEER.
Your attention is particularly invited to the special condition of
Section II.
Both copies shall be signed and dated by an owner or authorized re-
sponsible official, with his title shown thereon, and returned to this
office. The permit will then be validated and one copy will be returned
to you. If the draft copies are not signed and returned within 30 days
from the date of this letter, your request for the proposed work will
be withdrawn.
