SUBJECT: Waiver of Coastal Development Permit Requirement/De Mini mis
me, Developments—Section 30624.7 of the Coastal Act
Based on your project plans and information provided in your permit
application for the development described below, the Executive Director of the
Coastal Commission hereby waives the requirement for a Coastal Development
Permit pursuant to Section 13238.1, Title 14, California Administrative Code.
If, at a later date, this information is fo-und to be incorrect or the plans
revised, this decision will become invalid; and, any development occurring
must cease until a coastal development permit is obtained or any discrepancy
is resolved in writing.
WAIVER APPLICANT: Lance Kluger
LOCATION: 744 Via Lido Nord. City of Newport Beach. Count,y of Orange
PROPOSED DEVELOPMENT: Revise an existing boat dock by extending the fingers
of an existing "U" shaped float to 55 feet in length, widening the back walk
to 6 feet, moving the existing l2'xl2' pier back to the existing seawall, and
installing a new 3'x'221 gangway.
RATIONALE: The subject site is a waterfront lot on Lido Isle. The proposed
development would not extend beyond the U.S. Pierhead Line. Access is
available via nearby public walkways to the water's edge on Lido Isle.
Therefore, the proposed development would not have significant adverse impacts
on public access, coastal resources, or public recreation opportunities, and
is consistent with the City's Certified Land Use Plan, past Commission actions
in the area, and the Chapter Three policies of the Coastal Act.
This waiver will not become effective until reported to the Commission at their
Aug-ust 8-11. 1"5 , meeting and the site of the proposed
development has been appropriately noticed, pursuant to 13054(b) of the
Administrative Code. The enclosed Notice Card shall remain posted at the site
until the waiver has been validated and no less than seven days prior to the
Commission hearing. If four (4) Commissioners object to this waiver of permit
requi,Tements, a c stal development permit will be required.

As per our telephone conversation of November 10, 1977, 1 am
returning the drawings to you.
We need the drawings completely redone and not just corrections
made on the original drawings.
The new drawings should reflect exactly what is at the site
including correct measurements. This should be in the same
format as if you were applying for a new permit. Gillis and
Derby may be able to assist you, on this.

reference.
Pursuant to Harbor Permit Policies and the Newport Beach Municipal
Code, a drawing accurately reflecting the dimensions and location

of the time of commencement as the District Engineer may specify, and
.�of any suspension of work, if for a period of more than one week, re-
sumption of work and iLs completion.
(o) That if the activity authorized herein is not started on or
before 31 day of December � 1975 , and is not completed on or before
31 day of December 1977, this permit, if not previously revoked or
specifically extended, shall automatically expire.
(p) That no attempt shall be made by the permittee to prevent the
full and free use by the public of all navigable waters at or adjacent
to the activity authorized by this permit.
(q) That if the display of lights and signals on any structure or
work authorized herein is not otherwise provided for by law, such
lights and signals as may be prescribed by the United States Coast
Guard shall be installed and maintained by and at the expense of1the
permittee.
(r) That this permit does not authorize or approve the construction
of particular structures, the authorization or approval of which may
require authorization by the Congress or other agencies of the Federal
Government.
(s) That if and when the permittee desires to abandon the activity
authorized herein, unless such abandonment is part of a transfer
procedure by which the permittee is transferring his interests herein
to a third party pursuant to General Condition v hereof, he must restore
the area to a condition satisfactory to ' the District Engineer.
(t) That if the recording of this permit is possible under applicable
State or local law, the permittee shall take such action as may be
necessary to record this permit with the Register of Deeds or other
appropriate official charged with the responsibility for maintaining
records of title to and interests in real property.
(u) That there shall be no unreasonable interference with navigation
by the existence or use of the activity authorized herein.
(v) That this permit may not be transferred to a third party without
prior written notice to the District Engineer, either by the trans-
feree's written agreement to comply with all terms and conditions of
this permit or by the transferee subscribing to this permit in the space
provided below and thereby agreeing to comply with all terms and conditions
of this permit. In addition, if the permittee transfers the interests
authorized herein by conveyance of realty, the deed shall reference this
permit and the -terms and conditions specified herein and this permit
shall be recorded along with the deed with the Register of Deeds or other

STRUCTURES FOR SMALL BOATS; That permittee hereby recognizes the
possibility that the structure permitted herein may be subject to
damage by wave wash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper steps
to insure the integrity of the structure permitted herein and the
safety of boats moored thereto from damage by wave wash and the
permittee shall not hold the United States liable for any such
damage.
