The pier permit drawing for the above address is being faxed to you per your request. I
understand that Mr. Bishop has contacted you in regards to the water rights between his
property and that belonging to 536 Via Lido Nord. Therefore, I have also sent you the
drawing for 536.
This has been an issue with Mr. Bishop for some time now and this department has

Dear Mr. Bishop:
In regards to your pier permit area and the adjoining pier at 536 Via
Lido Nord, a field inspection revealed that the pier at 536 is within the
required five foot setback. However regarding the issue of the vessel
side -tied near your property line, it would appear that it would have to
cross over into your permit area when docking or pulling away from
the dock. This Would appear to be the case for the small vessel berthed
at the back of the dock, since it has no other choice, if it goes around the
above mentioned side -tied sailboat, but to cross over into your permit
area.
The Fire and Marine Department has always encouraged adjoining
neighbors to work out disputes of this type in a way that is amicable to
both parties. When that fails, and a violation of the Newport Beach
Harbor Permit Policies is at issue, the Marine Envirom-nental
Management Division may assist in arriving at a solution to the
problem.
This office is hopeful that both you and Mr. Brewer can arrive at a
mutually acceptable agreement in regards to the use of the harbor
permit areas bayward from your residences.

Recommendation
If desired, approve the Maintenance Dredging Harbor Permit Appli-
cations.
Discussion
These applications require City Council approval under the conditions
of.approval of the City of Newport Beach "blanket" permit for main-
tenance dredging issued on February 12 by the U. S. Army Corps of
Engineers.
The locations and applicants of the proposed maintenance dredging
applications are:
534 Via Lido.Nord - Mr. Joey Bishop'
536 Via Lido Nord - Dr. Phil Harrsen
844 Via Lido Nord,- Mr. Jim Higson
846 Via Lido:Nord Mr. Jim.Higson
915 Via Lido Soud -Mr. B. R. Morris
921 Via Lido Soud Mr. E. Yeager
The staff has reviewed the proposed dredging and have determined that
the work to be done is between the U. S. Pierhead tine and the U. S.
Bulkhead Line. There is no anticipated adverse -affect on proximity
beaches or contiguous bulkheads.
Shellmaker, Inc., the dredging contractor, will minimize turbidit
y
as much as is possible and will barge the dredged material to the
Environmental Pr otection Agency designated dispo sal site, four miles
at sea.
