Commission staff have reviewed the information submitted and determined that the above referenced dredging
events conform with Consistency Certifications CC -078-99 and CC -077-01 and that no further federal consistency
review is necessary from the Commission for the dredging components of the projects. In addition, the proposed
beach disposal events have been reviewed and found by the Executive Director to be consistent with Special
Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is necessary
from the Commission for the beach disposal components of the projects.
Please be advised that only the projects described in the materials submitted for the sites li sted above have been
found to conform with Consistency Certification CC -078-99 and CC -077-01 and/or conform with the terms and
conditions of Coastal Development Permit 5-99-282, as amended. Any change in the projects may cause them to
lose their status as consistent with CC -078-99 and CC -077-01 and/or CDP 5-99-282, as amended. This
certification is based on information provided by the recipient of this letter. If, at a later date, this information is
found to be incorrect or incomplete, this letter will become invalid, and any development occurring at that time
must cease until a new determination regarding conformance with CC -078-99 and CC -077-01 and/or CDP 5-99-
282, as amended, is obtained.

This is in reply to your application dated March 14, 2002, for a Department of the Army
Permit to perform maintenance dredging bayward of 724 Via Lido Nord over a 1350 sf area
(0.031 acre) in an existing marina, in Newport Bay, within the city of Newport Beach, Orange
County, California. The proposed activity includes ocean disposal of 200 cy of dredge material
at designated L.A.-3 site.
Based on the information you have provided, the Corps of Engineers has determined that
your proposed activity complies with the terms and conditions of Regional General Permit
(RGP) No. 54.
As long as you comply with the general permit conditions of RGP No. 54, an individual
permit is not required. This letter of verification is valid until July, 24, 2005, when RGP No. 54
will expire. A general permit does not grant any property rights exclusive privileges. In
addition, it does not authorize any injury to the property or rights of others or authorize
interference with any existing or proposed Federal project. Furthermore, it does not obviate the
need to obtain other Federal, State., or local authorizations required by law.

The maintenance work done to your pier and dock requires a final inspection.
At the time of this inspection it, was noted that a ramp runs from the bulkhead
to the pier, instead of stairs. This is not to be found in the Standard Design
Criteria for Harbor Construction. Generally there are steps leading from the
bulkhead to the pier. Steps drop the structure from being above the 9' height
limitation in a much shorter distant than a ramp to address the concern for
visual obstruction to the adjoining bayfront residents. Is there a reason for this
ramp instead of steps? If so, please let this office know what they are.
Secondly, the eastern finger of the dock extends about 18" beyond the pierhead
line. This needs to be brought back even with the other finger.

beach restoration., The locations and applicants for the proposed

The staff has reviewed the projects and has determined that the work

Development Description: Demolition of a existing private dock and construct
new 50' dock for an existing SFD located on Lido Isle. Project has RWQCB,
State Lands, and Corps of Engineering approvals.
I. The Executive Director of the South Coast Regional Commission hereby grants, subject to
condition(s), a permit for the proposed development, on the grounds that the development
as conditioned will be in conformity with the provisions of Chapter 3 of the California
Coastal Act of 1976, will not prejudice the ability of the local government having juris-
diction over the area to prepare a Local Coastal Plan conforming to the provisions of
Chapter 3 of the Coastal Act, and will not have any significant adverse impacts on the
environment within the meaning of the California Environmental Quality Act.
II. Conditions: None

III. This permit may not be assigned to another person(s) except as provided in Section
13170 of the Coastal Commission Rules and Regulations.
IV. This permit shall not become effective until:
A. Completion of the Regional Commission review of the permit pursuant to the notice
of public hearing.
B. A copy of this permit has been returned to the Regional Commission, upon which copy
.all permitees or agent(s) authorized in the permit application have acknowledged
that they have received a copy of the permit and have accepted its contents.
V. Any development performed on this permit prior to the review by the Regional Commission
is at the applicant's risk and is subject to stoppage upon completion of the review
pending the Regional Commission's approval and/or completion of any appeal of the
Regional Commission's decision.
VI. Work authorized by this permit must commence within two years from the date of approval.
Any extension of time of said commencement date must be applied for prior to expiration
of the permit.

transfer pier permit 0175-724 for the property located
at 724 Via Lido Nord
The structure was inspected on 3-27-80 at which time it
was determined that the following deficiency exists.
A continuous pressure anti -siphon device must be attached
to the municipal'water service, bayward.of the bulkheadf
in compliance to title 17 of the California Administrative
Code.
In accordance with Se ction 10-D of the City Harbor Permit
Policies, "All structural deficiencies must be corrected...
A permit for this work must be obtained from the Community
Development Department.
