CITY will permit OWNER to construct, reconstruct, install, maintain, use, operate, repair and replace said PERMITTED IMPROVEMENTS and appurtenances incidental thereto, within a portion of RIGHT-OF- WAY, all in substantial conformance with plans and specifications on file in the CITY. CITY will further allow OWNER to take all reasonable measures necessary or convenient in accomplishing the aforesaid activities. In addition, the OWNER is responsible for said PERMITTED IMPROVEMENTS and appurtenances -from the non-standard water service connection (outside of the seawall) to the building. 3. Rights granted under this Agreement may be terminated by CITY at any time by giving 60 days' notice, specifying in said notice the date of termination. CITY shall incur no liability whatsoever in the event of the termination of this Agreement, or subsequent removal of improvements by CITY. 4. OWNER and CITY further agree as follows: a. OWNER may construct and install PERMITTED IMPROVEMENTS and appurtenances incidental thereto, in substantial conformance with plans and specifications therefor on file in the CITY's Public Works Department, and as described on Exhibit "A" hereto attached. b. OWNER shall maintain the PERMITTED IMPROVEMENTS in accordance with general prevailing standards of maintenance, and pay all costs and expenses incurred in doing so. However, nothing herein shall be construed to require OWNER to maintain, replace or repair any CITY -owned pipeline, conduit or cable located in or under said PERMITTED IMPROVEMENTS, except as otherwise provided herein. C. If City or other public facilities or improvements are damaged by the installation or presence of PERMITTED IMPROVEMENTS, OWNER shall be responsible for the cost of repairs. 2 d. That should CITY be required to enter onto said RIGHT- OF-WAY to exercise its primary rights associated with said RIGHT-OF- WAY, including but not limited to, the maintenance, removal, repair, renewal, replacement or enlargement of existing or future public facilities or improvements, CITY may remove portions of the PERMITTED IMPROVEMENTS, as required, and in such event: (i) CITY shall notify OWNER of its intention to accomplish such work, if any emergency situation does not exist. (ii) OWNER shall be responsible for arranging for any renewal or restoration of the PERMITTED IMPROVEMENTS affected by such work by CITY; (iii) CITY agrees to bear only the cost of any removal of the PERMITTED IMPROVEMENTS affected by such work. by CITY; (iv) OWNER agrees to pay all costs -for renewal or restoration of the PERMITTED IMPROVEMENTS. 5. In the event either party breaches any material provision of this Agreement, the other party at its option may, in addition to the other legal remedies available to it, terminate this Agreement, and, in the event the breaching party is OWNER, CITY may enter upon the RIGHT-OF-WAY and remove all or part of the improvements installed by OWNER. Termination because of breach shall be upon a minimum of ten (10) days' notice, with the notice specifying the date of termination. In the event of litigation commenced with respect to any term of condition of this Agreement, the prevailing party shall be entitled to reasonable attorneys fees and costs incurred. 6. As you can see by this exhibit, the proposed revision will extend bayward of the pier head line, essentially in violation of the Section 2D of the Harbor Permit Policies, which states; "The "Pierhead Lines," as established, shall define the limit for pier and float -type structures." In 1972 when the existing pier was approved it initially had an L shaped float bayward of the pier and also bayward of the US pier head line. The float was subsequently deleted from the application and it is suggested in the file, although not specifically mentioned, that the reason was to bring the structure within the US pier head line. The existing docks to the left of the pier extend beyond the US pier head line, however, the file doesn't indicate exactly when they were built, but it appears they were built prior to 1964 before the Harbor Permit Policies were adopted. It has been our position in the past that structures that were existing prior to the Harbor Permit Policies could be repaired and maintained, but if they were rebuilt or revised they would have to conform to the current Harbor Permit Policies. I have also attached a letter in the file from the then Tidelands Administrator to the then City Manager indicating that after discussions with the City Attorney, it was felt to allow a guest dock in this area would essentially encroach on the Rhine wharf bulkhead beyond the pier head line and should require some kind of public return. In addition, one of the proposed uses of the Rhine wharf was to allow loading and unloading, repairs and berthing of commercial fleet fishing boats. Since it is the only public location within the city to do those type of operations, the commercial fishing fleet and their supporters have been very opposed to any encroachments into that area. In reviewing the Municipal Code, the only pertinent sections are Section 17.20.010 and 17.28.010, which basically deal with the use of that particular bulkhead and their time limits and don't give a lot of guidance. I have included, for your information, a copy of the Council agenda item that originally outlined the design of the wharf. In summary, our concern is with a dangerous narrowing of the channel which currently serves businesses on the Rhine Channel. Extension of the docks naturally corresponds to not only greater boat length but also greater extensions beyond the docks due to current policy. My suggestion would be that, if the docks are extended as proposed, no vessel be permitted to extend beyond the end of the docks. This restriction would logically exclude dinghies, davits, swim steps, sprits, etc. from extending beyond the end of the docks. Such a permit could be beneficial in providing a set policy which would eliminate the "gray areas" for enforcement purposes. Thank you for the opportunity to review and comment on this project. Ocean Front Newport Beach, CA 92663 Dear Mr. Tiernan: The pier where the vessel Oceana is currently moored was constructed under a valid Harbor Permit and the permit was issued to Sea Enter- prises as you point out in your letter of March 23, 1978. The problem exists because the existing pier, a commercial structure, is allowed a zero set back -in relation.to the property line adjacent to 28th Street. Sea Enterprises has taken advantage of this and the. pier finger nearest to 28th Street is either right on or within a foot of the property line. Therefore, any vessel side -tied on that finger could be in violation of the Harbor Permit Policies Section 21-A which states: "Boats moored at private or public docks shall not extend beyond the projection of the property lines of the property to which the dock facility is connected in accordance with Section 20-C." Section 20-C states: "The projection of the property line bayward of the same bearing from the bulkhead shall generally be used in determining the allowable set backs for piers and floats. Because there are certain physical conditions which preclude the strict application of this policy without prejudice to adjoining properties, Council approval will be required in areas where precise projections of the property line have not been determined and the following conditions exist: 1. Where property lines are not approximately perpendicular to the bulkhead. 2. Where curves or angles exist in the bulkhead line. 3. Where bridges, topography, street -ends or publicly owned facilities adjoin the property." This being the case, the vessel Oceana is moored in violation of the Harbor Permit Policies and therefore is in an area not designated for moori ng . As a consequence of this, it must be relocated as pointed out in Newport Beach Municipal Code Section 17.22.010: "LOCATION. No person having charge of any vessel shall moor or anchor the same in Newport Harbor except within the areas and at the places designated therefor. Any vessel which is moored or anchored at a place not designated for such vessel shall, upon the demand of the City Manager, be forthwith moved to the place or places designated therefor. In the designation of mooring areas and anchorages, consideration shall be given to the needs of commerce, the utilization of turning basins or channel unless the same shall be secured both fore and aft except as provided in Section 17.22.150. Every vessel moored or anchored in any part of a harbor outside of any turning basin or channel shall be so moored or anchored as to prevent such vessel from swinging or drifting into any turning basin or channel." As regards -the use of a street -end, the Harbor Permit Policies, Section 1-D specifically prohibits private pier construction there and street -end moorings are limited to vessels under 18 feet in length. This occurred on Monday, August 11, at 1:00 p.m. In November of last year you were notified of this problem, and since then, there has been little improvement. Although the debris drifts into your locale from other areas, nevertheless when it lodges within the zone under your registered permit, it is the :Law that you remove it. If your employees cannot be given the necessary time to periodically clean the surface waters of your permit area, you can call the Chamber of Commerce and be advised of who is now contracting with harbor permittees for cleanup of their tidelands lease areas. Our offices can also supply this information. Under almost any circumstances, Jou, the permittee should be able to see floating rubbish within your own permit zone before we see it. Further, upon sighting it, obviously you should remove it before it is called to our attention by someone else. Therefore, again we are requesting that you take the initiative instead of i being taken by government. our course of initiative lies in enforcing the City Codes, and Council Policies, relative to maintaining the status quo of harbor permits. The debris trap concept, as you know, is a new approach to the floating debris problem. The principal behind the proposed debris trap seems sound, but it is impossible to say just what success this will have. I've discussed the drawings with a local marine contractor and it was his feelings the proposed trap will probably work; however, it is a little more elaborate than possibly necessary. I'm sure Mr. Tozer would be amenable to modifying the trap if experience shows it doesn't work. Because of the lack of precedents in this line I would recommend approval with the note that if the system doesn't work, we might request modifications. D. The City Council approved harbor permit application #221-632 December 18, 1972 for a pile supported pier and "L" shaped float bayward of Lot #12. This permit included a public walkway around the guest waiting room. 2. The applicant has requested that the City Council consider a revision to the harbor permit approved December 18, 1972 which would allow the extension of the walkway in front of Lot 9, 10 and 11. 3. The proposed walkway extension would be 14' land- ward of the U. S. Bulkhead Line and is consistent with the general redevelopment plans for this section of the Rhine, which have been reviewed by the Joint Harbor Committee, Planning Commission and City Staff. Assistant Community Development Director Hewicker stated that no Environmental Impact Report was re- quested due to the size of the addition. Following discussion, Chairman Glass opened the Public. Hearing. Phil Tozer, one of owners of the property, appeared before the Planning Commission and stated that they concurred with the staff recommendations and ex- panded on their plans which they felt would enhance the area and with the inception of their trash trap aid in clearing the bay of debris. - Mr. Tozer added that they felt the 10 ft. walkway was excessive but I would abide by that decision. City Engineer Nolan stated that the plans for the 10 ft. walk were tentative at this time. Community Development Director Hogan added that a proposed meeting was planned with Mr. Tozer and other property owners in that area to discuss methods for beautifying the area. In response to .the Planning Commission, Mr. Hogan stated that the walkway would start at 30th Street, go across end of channel to connect with Delaney's, and hopefully extend from there. Discussion followed and the Planning Commission recommended amending Condition No. 3 to 10 ft. or such lesser width that is agreed upon. We are re -designing and re- decorating Delaney's Sea Shanty Restaurant to create an impression of the type of structure one would find on Monterey's Cannery Row. We believe this architectural style will most closely coincide with and enhance the gez',cal impression being created in this area with the construction of -he Cannery Village Restaurant across the channel and other adjacent shops. Design and decoration is being done by Arthur Valdes & Co., whom we believe to be the best available in this particular style. Most of the effects will be achieved by adding false facades to the existing building and veneering the exterior walls with authentic old redwood siding which we have obtained from an ancient barn in Northern California. However, we firmly believe that if we are to achieve the desired e' fect, we must have part of the building on pilings over the bay. There is no legal problem here as the structure would be within our legal bulkhead lines. The new addition would also serve as a waiting room for this very popular restaurant and provide an attractive and much needed adjunct with guest docking. We have adequate on-site parking; there are 53 spaces of adjacent metered parking, and we recently re -located Davey's Locker to further relieve any parking pressure on this property. Since the addition required a Use Permit we respectfully request that you grant our application and help expedite the re -development of the Cannery Village, area in this very desirable direction. To the north is the Rhine; to the east, across Lido Park Drive, are the Cabanas Marinas apartments and a vacant site where a condominium project is under construction; to the south, across 28th Street, is a large trailer park; and to the west is the Rhine. Analysis The applicant proposes to construct a 1912' x 26' (509 sq.ft.) waiting room for dining guests and a new entrance to the existing restaurant. The proposed waiting room will be built on pilings placed beyond the existing bulkhead and will extend to the bulkhead line. A four foot wide public walk is proposed to extend from Lido Park Drive around the proposed building addition to the existing walk in front of the Sea Shanty and Charlie's Chili restaurants so as to retain public pedestrians' access along the Rhine. (The City Engineer has indicated that this walk should be a minimum of ten feet in width so as to be in conformance with proposed plans for a pedestrian promenade adjoining Lido Park Drive.)
