At this particular location (and a few others in the harbor), the owner has the choice on whether he wants commercial or residential. In this case, Tod Ridgeway has opted to convert to residential. First, if it makes a difference, I am only using this pier for private use and would request a cancelation of my commercial permit. However, if the city still disputes the size of my permit, I clearly request that this matter be appealed. As you know the pier head line is set in the code and boats are allowed to use the area beyond the pier head line by the width of the boat. Further, the city required that a 6 foot public walkway be constructed in front of my bulkhead line. This area is not usable for berthing a boat. Please let me know how you would like to proceed. General Conditions: 1, The time limit for completing the authorized activity ends on June 8, 1990. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached. 2 You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Congressional Authorities: You have been authorized to undertake the activity described above pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403). 2. Limits of this authorization. a. This permit does not obviate the need to obtain other Federal, state, or local authorizations required by law. b. This permit does not grant any property rights or exclusive privileges. c. This permit does not authorize any injury to the property or rights of others. d. This permit does not authorize interference with any existing or proposed Federal project. 3. Limits of Federal Liability. In issuing this permit, the Federal Government does not assume any liability for the following: a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes. b. Damages to the permitted project or uses thereof as a result of current or future activities undertaken by or on behalf of the United States in the public interest. c. Damages to persons, property, or to other permitted or unpermitted activities or structures caused by the activity authorized by this permit. d. Design or construction deficiencies with the permitted work. e. Damage claims associated with any future modification, suspension, or revocation of this permit. 4. Reliance on Applicant's Data: The determination of this office that issuance of this permit is not contrary to the public interest was made in reliance on the information you provided. 5. Reevaluation of Permit Decision. This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following: a. You fail to comply with the terms and conditions of this permit. b. The information provided by you in support of your permit application proves to have been false, incomplete, or inaccurate (See 4 above). c. Significant new information surfaces which this office did not consider in reaching the original public interest decision. Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. The referenced enforcement procedures provide for the issuance of an administrative order requiring you to comply with the terms and conditions of your permit and for the initiation of legal action where appropriate. You will be required to pay for any corrective measure ordered by this office, and if you fail to comply with such directive, this office may in certain situations (such as those specified in 33 CFR 209.170) accomplish the corrective measures by contract or otherwise and bill you for the cost. 6. Extensions. General condition 1 establishes a time limit for the completion of the activity authorized by this permit. Unless there are circumstances requiring either a prompt completion of the authorized activity or a reevaluation of the public interest decision, the Corps will normally give favorable consideration to a request for an extension of this time limit. Public access and public - 5-900-075(Fluter) Page 3 FINDINGS FOR E�CCUTIVF DIRECTOR'S DETERMINATION: A. Project Description: The applicant proposes to demolish a storage shed and construct a 3,063 square foot 26 foot high building that will accomodate office facilities on the ground floor and a residential unit on the second floor. Four(4) parking spaces are provided for the project as a whole. Two of the spaces are for the residential I - unit. The applicant is proposing to construct a 6 foot wide public walkway on pilings next to the existing bulkhead. The project is located in the Cannery Village area of Newport Beach and is designated Retail and Service Commercial in the City's LUP. B. Conformance to Land Use Plan/Public Access: Section 30212 of the Coastal Act state,, in art thal nearest- p public access from the public roadway to the shoreline and along the coast shall be provided in new devlo ment p p projects except in certain instances such as adequate access exists nearby or it is inconsistent with public: safety or fragile coastal resources. Section 30252 of the Coastal Act state, in part that new development should maintain and enhance public access to the crust by providing adequate parking. 1 Parking The applicant has received a modification from the City to allow for tandem parking on the parcel. Parking consists of 2 sets of tandem spaces (4 spaces total). Two of the :.panes are in a garage which the City has requested be reserved for the use of the second story residence. The other two spaces are located in a partially enclosed covered area and are for the use of the commercial space. This number of spaces is adequate for the proposed uses. The rationale for this modification is that the Lot is only 30 feet ;side and cannot accomodate the :necessary parking 4 abreast. As stated above the project is located in the Cannery Village area in a portion designated Retail and Service Commercial. This land use designation is intended to provide for a specialty retail core. Residential uses are permitted on the second floor or above where the ground floor is occupied by another permitted use. The LUP states: "Professional and business offices not providing 'goods or services to the public or not ancillary to an otherwise permitted use are allowed only on the the second floor or above." The office use intended by the applicant and required by the LUP is for professional services to the public: ;such as an architect's office. Given the parking restraints (tandem spaces) this kind of use is more appropriate' than speciality retail. Adequate off-street parking is a major element of public access in Newport Beach. This project provides enough parking for both intended uses. Therefore, the Executive Director determines that the project is consistent with section 30252 of the Coastal Act for maintaining and enhancing public access by providing adequate parking facilities. S_Qfln_nir(Giuter ) Page 4 2. Lateral access Another element of public access is access along the shoreline. The City has imposed a condition on the project which requires an offer to dedicate a public access easement on the waterfront. The applicant is proposing a public access walkway on piers next to the existing bulkhead. The City wants the Commission to evaluate the merits of the pier walkway as a solution to the public access requirement. The project is located in an area where the bulkheads are not all in the same relationship to the water on each lot. The bulkhead jogs further waterward on the lot to the east and is in the same location as the bulkhead on the lot to the west. The lot is smaller than some of the neighboring lots because of the placement of the bulkheads. Given the narrow width of the lots and the relatively shallow depth of the subject lot (70 feet) it is unfeasible to provide the needed parking and have room left for a viable commercial space and then also provide for a public easement and walkway. There would not be room for a privacy buffer for the residential unit. Because of the configuration of the bulkheads and the existing public walkways (see exhibit 1&3) only two possible solutions are available that will allow for a continuous lateral access walkway along the waterfront. The bulkheads on the subject lot and the neighboring lot to the west could be moved waterward to connect with and form a continous bulkhead line (see exhibit 3) that would only require access dedication along the waterside property lines. However, a project of this sort would require that potentially valuable marine habitat be filled in order to create this access connection. The Coastal Act allows new bulkheads/seawalls and other protective devices only to protect endangered existing structures or for coastal dependent uses such as boat yards. Rather than relocating the bulkhead further waterward to create land for this walkway the ,applicant has proposed to provide for a walkway'on pilings located next to.the bulkhead. This will be less environmentally damaging than relocating the bulkhead and will be more than offset by the public good that will be gained by providing access along the waterfront. The adjacent property will need the same kind of. pier walkway in order to join up with the existing walkway on the lot next to it and the subject propertys' proposed walkway. The City is requiring the offer to dedicate the public access now but allowing for the actual construction of the wa,Kway when the property adjacent is developed and the City can require the other portion of the walkway to be constructed. As stated above, the construction of the walkway over the water on piers is considered less environmentally damaging than moving the bulkhead out to connect with the bulkheads which have existing public walkways. Any solution to the public access walkway will have to be consistent for both lots. As proposed, the public walkway will provide a needed link along the waterfront, and is consistent with the LUP's policy to provide vertical and lateral public access along the waterfront in the Cannery Village area. Therefore, the Executive Director determines that the proposed project is Consistent with Section 30212 of the Coastal Act for new developments providing public access along the coast. C. Local Coastal Program: Section 30604(a) of the Coastal Act provides that the Commission shall issue a Coastal Permit only if the project will not prejudice the ability of the local government having jurisdiction to prepare a Local Coastal Program which conforms with Chapter 3 policies of the Coastal Act. 5-900-075(Fluter) Page 5 The Newport Beach Land Use Plan was certified on May 19, 1962. The proposed development will not createadverseimpacts. ZONE: SP-6 APPLICANT: Russell Fluter, Newport Beach OWNER: Same as applicant Commissioner Pers6n stated that he resides within 300 feet of the subject site; however, he has been advised by the City Attorney's Office that he would be able to participate in the subject application inasmuch as the subject project would not have an impact on his property and he would not have any financial gains. Commissioner Edwards stepped down from the dais because of a possible conflict of interest. James Hewicker, Planning Director, addressed public access to the bay, and he stated that the Cannery Village Specific Area Plan and the Land Use Plan of the Local Coastal Program as approved by the Coastal Commission requires public access to the water except where certain conditions exist. Mr. Hewicker indicated that said conditions are stated in the staff report. He said that vertical access to the bay . exists at the street end of 28th Street, and horizontal access exists across the bayside portion of the project that is immediately to the east of the subject site, and he explained the easement requirements that were imposed on the project that was approved west of the subject site in 1976. Mr. Hevicker commented that the proposed easement would provide a link to the required public access specified under the Specific Area Plan and the Land Use Plan. Mr. Hewicker also addressed the location of the bulkhead. Commissioner Debay and Mr. Hewicker discussed the easements of adjacent properties and the subject easement. Mr. Hewicker advised that staff suggested the approval of the Coastal Commission on the basis that if the Coastal Commission does not allow the perpendicular link, that it would not be advisable to obtain the easement. -26- December 7, 1989MINUTES BEACH ROLL -CALL, INDEX Commissioner Pers6n commented that continuous public access has been provided for every project that has been approved by the City, ` and the easement be constructed at the time the construction occurs. He commented that there has - been discussion with the applicant of an irrevocable offer to construct or dedicate an easement in the future. Commissioner Pers6n stated that the idea is for the public to walk from 19th Street to the Rhine Channel. Commissioner Pers6n suggested a condition requesting an irrevocable offer to dedicate in perpetuity for easement purposes, or otherwise, at the request of the City. Mr. Hewicker advised that it would be necessary to move the bulkhead located on the subject property and on the property west of the subject site. Commissioner Glover stated that it is important that the public have access to the bay. In response to a question posed by Chairman Pomeroy, Mr. Hewicker advised that the Coastal Commission opposes moving the bulkhead out and permitting in -fill behind the relocated bulkhead, but the Commission also opposes structures or - cantilevered decks over the water. He explained that to connect the horizontal portion of the proposed project with the horizontal segment of the adjacent project, that a dogleg may be required and the Coastal Commission may oppose the dogleg inasmuch as it would have to be constructed over the water. Discussion ensued with respect to what type of structure could be constructed that the Coastal Commission would support over the water. Commissioner Debay addressed the difference of opinion between the Coastal Commission and the City with respect to the construction of decks. In response to a question posed by Commissioner Debay with respect to the dedication of a walkway, Mr. Hewicker explained that the applicant could offer to grant the easement and build the walkway in perpetuity at the request of the City and/or the Coastal Commission. Commissioner Debay and Mr. Hewicker discussed the dogleg. The public hearing was opened in connection with this item, and Mr. Jerry King, J. A. King & Associates, appeared before the Planning Commission on behalf of the applicant. Mr. King reviewed the subject application, and he addressed the extended bulkheads and public access across the adjacent properties. Mr. King stated that the applicant has discussed the bulkhead with -27- - COMMISSIONERS ` December 7, 1989MINUTES CITY OF NEWPORT BEACH ROLL .- CALL = INDEX the Coastal Commission, and . that he requests to develop the property as it exists and only repair the existing bulkhead. He explained that the public access to be constructed would either be a -cantilevered deck or a deck with pilings sunk into the water. Mr. King commented that the applicant is willing to make the dedication as required; however, he said that the applicant is concerned with the liability. He stated that the project is proposed to be .60 below the FAR (Floor Area Ratio), and if the project were constructed to the allowable floor area ratio the applicant would not be able to provide the required number of parking spaces. Mr. King advised that there have been projects in the City that allowed a dedication without construction of public access, and he addressed previous difficulties to provide public access on the site. Chairman Pomeroy asked if the applicant would agree to construct the public access when the adjacent property is improved. Mr. King responded that the applicant would like to make some comments regarding this matter. In response to a question posed by Commissioner Glover, Mr. King stated that the applicant opposes Conditions No. 2 and No. 3 in Exhibit "A" requiring the dedication and construction of the public access along the entire water frontage of the site. He explained that the applicant has requested that the request be delayed until the adjacent property is developed. Mr. King further explained. that the construction as requested would allow for a continuous access as opposed to an unsafe condition that would place the applicant in liability. Mr. King concurred with Commissioner Debay that the applicant would prefer Condition No. 2 requesting dedication, and to delete Condition No. 3 regarding construction of a physical connection at the present time. Mr. King and Commissioner Pers6n discussed the dedication and construction requirements of the residential condominium project located on Lido Park Drive. Commissioner Pers6n stated that he was always of the opinion that applicants are responsible to construct the public access. Commissioner Debay clarified her comment with regard to Condition No. 3 to state "that the applicant shall construct a physical connection at his expense at such time.." Mr. Russell Fluter, applicant, appeared before the Planning Commission. Mr. Fluter responded that any improvements that he agreed to he would be willing to provide at his expense as a -28- December 7, 198I N Ui ES BEACH ROLL' CALL INDEX performance bond, etc. Chairman Pomeroy asked if the Planning Commission agreed to require the dedication, would he be willing to construct the public access when the adjacent lot dedicates public access. Mr. Fluter stated that when he purchased the subject property he did not believe that he would be required to develop the public access as requested. Mr. Fluter explained that the reason why he opposes the access is because the development is a potential owner/occupied residence in conjunction with the commercial use on the first floor, and foresees problems with potential vagrancies inasmuch as the area is hidden from public view. He commented that he agrees with public access; however, the condition is an unfair burden on a lot that. is 30 x 70 feet. Mr. Fluter addressed his concerns with regard to the liability and the lack of lighting on the proposed walkway. Mr. Fluter urged the Planning Commission to require only the dedication across the front of the subject property, or allow a 21. year irrevocable offer to dedicate. Chairman Pomeroy asked if the applicant dedicates and constructs the public access, is the property the City's and the liability passed directly to the City. Robin Flory, Assistant City Attorney, explained that the access would still be the applicant's property but he would only be granting a public access over said property. Commissioner PersGn asked what purpose is an easement when the public would not have access? Mr. Fluter addressed the possible extension of land and the numerous agencies that he had meetings with regarding a bulkhead extension. In response to a question posed by Commissioner Debay with regard to only the dedication of the easement at this time, Mr. Fluter agreed to connect the easement with the adjoining properties in the future. Commissioner Glover addressed Mr. Fluter's concerns regarding liability, and she commented that based on the type of privacy the development requires, the project should not be constructed on the site inasmuch as the City has made a commitment for public access to the Bay from Cannery Village. He said that inasmuch as the proposed access would not be an easy access, the public may not use it frequently and regardless of the proposed use, he would have the same concerns about a public walkway. -29- December 7, 1989MINUTES BEACH ROLL ` CALL INDEX Commissioner Di Sano compared developments on the Peninsula that have easy "access to walk around, with what he considered is a cul-de-sac area at the subject location. He suggested an irrevocable dedication with a promise to pay for the improvements when a "stringline concept" of an easement could be established when the entire block could be walked without being a potential vagrant area. Commissioner Person commented that the stringline concept would be based on City and Coastal Commission requests. Mr. King reappeared before the Planning Commission to concur with the findings and conditions contained in the staff report, and he said that the applicant agrees to the dedication. There being no others desiring to appear and be heard, the public hearing was closed at this time. Motion * Motion was made to approve Use Permit No. 3365, Site Plan Review No. 53 and related environmental document, subject to the findings and conditions in Exhibit "A", that Conditions No. 2 and No. 3 be combined as follows: That prior to the issuance of building permits, the applicant shall execute an agreement acceptable_ to the City Attorney which will offer to dedicate a six foot wide public access easement along the entire waterfrontage of the subject property and along a portion of the southwesterly side property line sufficient to make the required. physical connection with the public access easement on the adjoining property located at 2800 Lafayette Avenue. That said document shall provide that the construction of the physical connection of the access shall be constructed by the applicant at such time as requested by the City of Newport Beach subject to the approval of the Coastal Commission." Commissioner Debay asked if the condition could be modified to include the adjacent property located at 2806 Lafayette Avenue at which time the walk could be connected so the access does not deadend in the front of the subject property. Commissioner Person concurred, and he modified the condition to "such request for the physical connection shall not be made until the adjacent property located at 2806 Lafayette Avenue has the same requirement." Commissioner Di Sano addressed his concern that the walkway not deadend. Commissioner Person stated that the intent of the -30- COMMISSIONERS December 7, 1989MINUTES 3. That based on the information contained in the environmental document, the proposed design of the project will reduce potentially significant environmental effects, and that the project will not result in significant environmental impacts. B. Use Permit N Fine 1. That incentive uses are provided by the development which allow the establishment of general office or commercial uses. 2. That the proposed commercial development is large enough_ to accommodate a viable business. 4. That the design of the development or the proposed improvements will not conflict with any easements acquired by the public at large for access through or use of property within the proposed development. 5. The approval of Use Permit No. 3365 will not, under the circumstances of this case, be detrimental to the health, safety, peace, morals, comfort, and general welfare of persons residing and working in the neighborhood or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City and further that the proposed modification for a commercial tandem parking space is consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code. Conditions: 1. That the proposed development shall be in substantial compliance with the approved plot plan, floor plans and elevations, except as noted below. 2. That prior to the issuance of building permits, the applicant shall execute an agreement acceptable to the City Attorney which will offer to dedicate a six foot wide public access easement along the entire water frontage of the subject property and along a portion of the southwesterly side property line sufficient to make the required physical connection with the public access easement on the adjoining property located at 2800 Lafayette Avenue.
