SUBJECT: APPROVAL OF "TASTE OF NEWPORT" BANNERS
RECOMMENDATION:
Conditionally approve the request of Newport Beach Chamber of Commerce for the
installation of 217 banners, from the 2151 of August to the 20'h of September 2002.
Installation shall be along Jamboree Road, MacArthur Boulevard, Westcliff Drive, San
Joaquin Hills Road, Newport Center Drive East/West, and Newport Center Drive.
DISCUSSION:
The Newport Beach Chamber of Commerce (NBCC) has requested to install 217
private banners on City streetlight poles from the 215` of August through the 201h of
September 2002, in Fashion Island and other areas, for the 14`h Annual Taste of
Newport. The banners will be mounted on streetlight poles along Jamboree Road (35
banners), Newport Center Drive EastfWest (100 banners), Newport Center Drive (26
banners), Westcliff Drive (9 banners), MacArthur Boulevard (34 banners), and San
Joaquin Hills Road (13 banners). Additional banners will be installed on Newport
Boulevard (22 banners) and on Coast Highway (42 banners) in the Caltrans right -of-
way. Staff will prepare the required Caltrans Encroachment Permit application. (See
attached exhibit).
On the weekend of September 13`h to 15`h, NBCC will host the 14`h Annual Taste of
Newport — a dining and entertainment celebration highlighting the many restaurants in
Newport Beach. The Chamber reports over 75,000 people attend the Taste of Newport
events. Attendees will pay a $15 admission charge to enter the event and will, if
interested, purchase scrip to receive food and drink from participating restaurants and
caterers.
For twelve consecutive years the Costa Mesa based, Times Orange County, has co-
sponsored and underwritten the Taste of Newport. To recognize the newspaper's role,
the Chamber designed a 2 -foot by 6 -foot banner indicating the Times' logo on the top of
the banner.

The event is not co- sponsored by the City of Newport Beach, not free to the public, and
does not exclude advertisement of the sponsor (Times) as required per City Council
Policy L -16. Council Policy L -16 prohibits the use of a commercial sponsor's name on
the banner. However, the event will be community-wide, open to the public, and may
create additional revenue to the City through restaurants, businesses, and hotel
reservations.
The applicant's request to install 217 private banners will exceed the 100 - banner limit
and the single banner per pole concept allowed per City Council Policy L -16. In the
past, similar requests have been approved by City Council.
There have been no reported public complaints. Should the City Council elect to
approve the installation of 217 private banners in Fashion Island and other areas, for 32
days, Staff recommends the following conditions of approval:
1. No banners shall be installed on traffic signal poles.
2. On Newport Center Drive (from East Coast Highway) and Newport Center Drive
East/West (Ring Road) the locations shall be limited to the center median. Two
banners will be installed per each pole.
3. The applicant must provide on -going maintenance of the banners and brackets.
4. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the
banners /brackets and indemnification and hold harmless for any liability associated
with the banners /brackets.
5. The applicant must maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher.
6. Issuance of an Encroachment Permit by the Public Works Department.
7. The banners shall conform to City Council Policy L -16 with the exception of the
number of banners, advertisement of sponsor, open to the public free of charge, and
co- sponsor by the City.
8. All banners and brackets shall be removed by the end of the approved time unless
otherwise approved by the conditions stated in the Encroachment Permit.
9. All banners and brackets shall comply with the Encroachment Permit conditions.
10. If needed, the City may require removal of some of the banners to allow other
organizations to install banners at the same location and during the same time
period.

11. A minimum of two 5 -inch wide, half - circle wind slits per banner are required to
minimize the wind load on the poles.
12. The printed font of the sponsor, 'Times," shall be the same size or smaller than the
printed font "Taste of Newport."
