BOX 1768, NEWPORT BEACH, CA 92659.1768 November 19, 1991 Dover Shores Board of Directors c/o Ed Benson 1028 Westwind Way Newport Beach, cA 92660 Re: Your letter of 11/4/91 Dear Mr. Benson: On August 9, 1989 Adrienne Brennan submitted an application for a dock, ramp and pilings bayward of 501 Evening Star Lane through their agent, Waterfront Construction aka Trautwein Brothers. At the time of that submittal I indicated to Trautwein Brothers that the lot over which the pier would be built had not been designated as being in the pier permit zone as outlined in the pier permit area map for Tract #4224 submitted to the City Council on April 9, 1964. To be able to approve a dock in that location we would need, at a minimum, the approval of the property owner of Lot A. Initially it was my understanding that the property owner of Lot A was the City of Newport Beach. That has since been clarified and the property owner of that lot is the Dover Shores Homeowner's Association. I communicated this information to Trautwein Brothers and to the property owner. The property owner then supplied me with a copy of a letter from Mr. David William Shores, which purported to be approval of the association for construction of the dock over Lot A. I discussed this with representatives" of the Homeowner's Association and they indicated that this was not approval by the association and that approval would require a majority vote of the homeowners. At that time I took the position that there was no approval given to construct a dock over Lot A, and until such time as approval was given we could not go forward with our permit process. As regards the physical characteristics of the proposed structure, it appears to me that with sufficient dredging there could be water depth around a proposed dock sufficient to accomodate a vessel. This would encroach on the beach and would take existing sandy beach and put it -in the intertidal zone or in an area that was continuously under water. It does appear, however, that a dock could be built in that location. The City of Newport Beach has taken no further action on the permit feeling that at this time we cannot go forward until we have initial approval from the property owner of Lot A. 3300 Newport Boulevard, Newport Beach I hope this answers your questions. A party by the name of Dr. and Mrs George Brennan has recently purchased a home in our Community located at 501 Evening Star Lane which is des- ignated as lot #149 in the Dover Shores Tract Maps. Since their purchase they have endeavored to obtain permission to install a boat dock behind their home even though it is indicated on the original tract map and the Pier Permit Area Map as a non -boat dock property. They are now persisting in their efforts by way of a Law Suit, even though it also clearly indicates in our Community's C.C.&Rs. that this particular property never was a boat dock property going back to when the Irvine Company developed the Comm- unity in 1962&63. For your information the enclosed data sheet relates to some of the problems involved in trying to locate a functional boat dock in the back of their lot. The Association cannot turn over the Community's Childrens Beach property to a private party(Brennan) for their exclusive use without a approval by 76% of the Dover Shores Homeowners. The Brennane do not seem to understand the problem the Low Tide creates in this area which occurs at least jl times in the daytime during each year. At these low time periods no water is left at the back of their lot to support a boat and make it possible to move it out of the area because of the receding tide that occurrs frequently and over which they or anyone else has any control. The claim that a deep ditch could be dug that would trap enough water to allow a boat to navigate in and out of the area is not only unrealistic but also dangerous as this would impact the Childrens swimming area for which the area is designated on all maps as well as statements in the records on file in the City of Newport's Marine Division. In their Citation the Brennane state they " prepared plans and solicited permission from the City of Newport Beach to construct the boat dock, incurring substantial ex- pense with respect to obtaining preliminary approval for the boat dock from the City of Newport Beach" (See ** C. C.&Rs. Article IX -Section 15 on enclosed data sheet) We would appreciate the Marine Division's comments, along with the City's feelings and approach to this situation so we may be guided in our efforts to fight this unreasonable demand. epb/cp Sincerely... ?%7 % riz_f —� E. A Boat Dock placed at the waterfront of this lot would impact, and be located on Association Childrens Beach Playground and water area which during the summer months contains a diving float as part of the Childrens Play Activities. y/ 4. Nm plane for a Boat Dock were submitted by the Brennans to the Government Agencies and the Assoeiation'e Architectural Control Committee for the required approval. The Low Tides that occur many times during the year leaves no water at the Bay Side of lot #1149, which would make it physically and naturally impossible to support a Boat at this location during Low Tide periods. PYA."Extreme dangerous conditions and liability would be involved in trying to operate a Boat so close to the Childrens Swimming Area. This is the reason along with the aforementioned why this property was excluded as a boat dock property when the Community was originally planned and developed by the Irvine Company in 1965-65. 7. It is true that Villageway Management, Inc. due to a Bookkeeping error on their - part inadvertently assessed the dues on the Brennan's property as a Boat Dock property for 1 year only. When the error was discovered a refund check covering the dues difference between a waterfront boat dock property and a standard -non boat dock property was sent to the Brennans along with a letter of explanation by Villageway Management Company. ' ** 8. The .Newport Beach City and the State Coastal Commission never approved nor would they approve and issue a permit for installation of a Boat Dock at the rear of the Brannan's Property because of the aforementioned reasons and conditions prevalent at this location 9. With respect to Brennans Attorney's statement in complaint, page 3, paragraph 11.
