Dear Mr. Powers:
The permit issued to the Irvine Company for the reconstruction of
the docks bayward of the coves condominium, the McLain Development
and the Shark Island Yacht Club included the following condition as
revised on August 26, 1974:
1. The public walkway.along the docks be open to the public
at all times.
2. The Irvine Company.shall have the responsibility of
maintaining the public walkway in a safe and unobstructed
condition.
It has come to the attention of the City of Newport Beach, Marine
Department, that the walkway is no longer unobstructed.
Specifically, the eastern section of the walkway terminates at the
Shark Island Yacht Club and there is no unobstructed method to exit
the public walkway over their property without climbing over an
ornamental wall and walking thru planters.
This situation must be remedied by the applicant and the harbor
permittee, so that the public has unobstructed access as rewired
by the above condition. -

Regarding a pier permit transfer for the property located at 615
Bayside Drive, City Pier Permit 0200-615-1:
The facility was inspected on February 18, 1993 at which time it
was determined that it conforms to Marine Department requirements.
When we have received the transfer card, signed by the previous
owner and the new owner, and by the joint owner of the pier, plus
the $300 transfer fee, we will be able to transfer the pier permit.

Dear firs. Clark:
A check of the City's Harbor Permit files has revealed that the
permit for the pier and float at 615 Bayside Drive is still
registered to Burton Yale.
As indicated in my previous letters, a transfer application must be
completed and a transfer fee paid for each time the permit has changed
ownership.
Chapter 17.24.03.0 of the Municipal Code addresses the transfer of a
permit and reads as follows:
"No person.shall transfer a permit for a pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City.
Failure to pay the transfer fees can be grounds for revocation of
the Harbor Permit in accordance with Chapter 17.24.090 of the
Municipal. Code which reads as follows:
"Grounds for Revocation - Any permit heretofore or hereafter
granted for any structure or work in the waters of Newport
Harbor or the Pacific Ocean may be revoked by the City Council
upon any of the following grounds:
4. The permittee has failed for a period of sixty (60) days
to pay the fee or fees heretofore or hereafter imposed for
the occupancy of tideiands,filled tidelands or submerged lands
upon which such work or structure exists."
Your cooperation in bringing this permit up-to-date will avoid any
further action at this time.

I. The South Coast Conservation Commission finds that the proposed
.development:
A. Will not have a substantial adverse environmental or ecolog-
ical effect.
B. Is consistent with the findings and declarations set forth
in Public Resources Code Sections 27001 and 27302.
C. Is subject to the following other resultant statutory pro-
visions and policies:
City of Newport Beach ordinances.
D. Is consistent with the aforesaid other statutory provisions
and policies in that:

E. The following language and/or drawings clarify and/or facil-
itate carrying out the intent of the South Coast Regional
Zone Conservation Commission:

have acknowledged that they have received a copy of the permit
and understood its contents. Said acknowledgment should be
returned within ten working days following issuance of this
permit.
B. That said development is to be commenced on or before 360
days from effective date of approval.
V. Therefore, said Permit (Standard,No. P-4-19-74-3107
is hereby granted for the above described development only, sub-
ject to the above conditions and subject to all terms and pro-
visions of the Resolution of Approval -by the South Coast Regional
Conservation Commission.

ENVIRONMENTAL IMPACT: This office does not intend to prepare an Environmental
Impact Statement on this activity unless significant detrimental effects are
brought to our attention.
CRITERIA: Your written comments or objections should include the number and
date of this notice and must reach this office within thirty (30) calendar
days. The decision whether to issue a permit will be based on an evaluation
of the probable impact of the activity on the public interest. That decision
will reflect the national concern for both protection and utilization of
important resources. The benefit which reasonably may be expected to accrue
from the activity must be balanced against its reasonably foreseeable detri-
ments. All factors which may be relevant to the activity will be considered;
among those are conservation, economics, aesthetics, general environmental
concerns, historic values, fish and wildlife values, flood damage prevention,
land use classification, navigation, recreation, water supply, water quality,
and, in general, the needs and welfare of the people. Details of changed
conditions on the final permit action will be provided upon request.
