Dear Sirs:
The above dock was inspected by The Harbor Resources Division of the City of
Newport Beach inspected the dock at the property mentioned above.
We cannot transfer the pier permit until the following deficiencies have been corrected
and the property has been re -inspected:
1. It needs a new testable Backflow Prevention Device installed (please see diagram).
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures shall be inspected for
compliance with the City's minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural deficiencies
must be corrected prior to transfer of the permit."
Please call 644-3034 to request a reinspection. Once the property has passed
reinspection and we have the signed application, the pier will be transferred.

Dear Sirs:
The City of Newport Beach Marine Department has received a request
to transfer pier permit 0200-0639-1 for the property located at 639
Bayside Dr., Newport Beach, CA. The facility was inspected on
3/28/94.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and WE HAVE BEEN NOTIFIED OF THE
CORRECTION:
1. A City -approved anti-7syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is
enclosed.
2. The electrical outlets on the dock . must be GFI or twist lock
receptacles for use in a water environment.
The Newport Beach City Council Harbor Permit Policies state:
10. D. "At the time of transfer, all harbor structures

A permit for plumbing or electrical work may be obtained from the
Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE BEEN
CORRECTED. When we have been notified, the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred. Included in requirements for transfer of the
pier permit is the $300 transfer fee and the signed transfer card.

On March 2, 1978, a I-etter was sent to you regarding failure to comply
with City Council Harbor Permit Policies dealing with the mooring of
vessel(s) at your residential float.
At that time, it was requested that any vessel not registered to the
upland occupant be relocated. In our continuing inspections in the
bay, it was noted on March 27 that the vessel(s) in violation have not
been moved..
As of April 7, any vessel moored at your float in violation of the
City Council's Harbor Permit Policies will be impounded by the Orange
County Sheriff Department Harbor Patrol in accordance with Chapter

Subject: Request for Variance Lot 52
Dear Mr. Penniman:
On December 931 1974,, the Architectural Committee of the Promontory Bay
Community Association met,to review plans for a patio and cantilevered
wooden deck for Lot 52. 639 Bayside Drive, After careful review of the
plans, it was the com-ittee's unanimous opinion that the patio and deck
will present an aesthetically pleasing appearance and be beneficial to
the community. The committee is unable to approve the plans, however,
in that two elements of the plan do not conform with the Promontory Bay
Development Standards. This being the case, the owner's agent, Mr. Dick
Natland of Urban Research Design Development, has requested a variance
in accordance with Article VY Section 5 of the Promontory Bay CC&R's.
Pursuant to that Article,, the Architectural Committee is required to
submit its findings and a recommendation to the Board. That is the pur-
pose of this letter.
The first area of non-conformance is the setback of the cantilevered deck
from the westerly property line....The standards call for 510", while the
plan shows 416". The reasoning behind this variation was to align the
edge of the deck with the edge of the building which would be architec-
turally desirable. We recommend disapproval of this variance, however,
since it violates the Harbor Permit Policies of the City of Newport Beach.
The second area of non-conformance pertains to the maximum height of the
deck above the bulkhead. The standard is 017". while this plan indicates
approximately 12". The increased dimension is due to the Glu-Lwn beams
which will support the deck. The committee feels due to the materials
proposed that this will not be detrimental and, as a matter of fact, will
present a pleasing appearance. We recommend approval of this variance.
After the Board has acted on this request, it will be necessary to forward
a letter stating the action taken to the City of Newport Beach, Department
of Marine Safety, Attention: Glen Weldon. The City will not issue a
permit unless they are assured the community association has approved the
plans.

ACTIVITY: Proposed construction and installation of anchor pilings,
cantilever deck, ramp and float to extend fifty (50) feet bayward of the
City Bulkhead Line, in front of Lot No. 52, Tract 3867, Newport Beach,.
Orange County, California, as shown on the drawing accompanying this
notice.
PURPOSE AND USE: To provide a private boat docking facility.
FEDERAL, STATE AND LOCAL AUTHORIZATIONS: Approved by the City of Newport
Beach; and Application No. P-3938 filed with the California Coastal Zone
Conservation Commission -South Coast Region.
ENVIRONMENTAL IMPACT: This office does not intend to prepare an Environmental
Impact Statement on this activity unless significant detrimental effects
are brought to our attention.
CRITERIA: Your written comments or objections should include the number
and date of this notice and must reach this office within thirty (30)
calendar days. The decision whether to issue a permit will be based
on an evaluation of the probable impact of the activity on the public
interest. That decision will reflect the national concern for both protection
and utilization of important resources. The benefit which reasonably
may be expected to accrue from the activity must be balanced against
its reasonably foreseeable detriments. All factors which may be relevant
to the activity will be considered; among those are conservation'. economics,
aesthetics, general environmental concerns, historic values, fish and
wildlife values, flood damage prevention, land use classification, navigation,
recreation, water supply, water quality, and, in general, the needs and
welfare of the people. Details of changed conditions on the final permit
action will be provided upon request.
