The City of Newport Beach has inspected the above pier and found it to meet
City standards. Once we receive the application signed by the buyer and
seller the pier will be transferred.
Please advise buyer that the plywood under the carpet on one finger of the float
seems spongy. This will not hold up the transfer.

Sirs:
The City of Newport Beach Fire and Marine Department has received a request to
transfer pier permit 20007241 above-mentioned property. The facility was re -inspected
on September 21, 1999. We cannot transfer the pier permit until the following deficiency
has/have been corrected and we have been notified of the corrections:
I . As indicated in the September 20, 1999, Pier Inspection Report, the gangway ramp to
the dock must be replaced.
2. It is recommended that the cracks in the cement on the deck be repaired.
3. The piling rollers on the East Finger must be reattached to the piling hanger.
4. When the electricity and water service to the pier and dock are reconnected, this work
must be done with Building Department electrical and plumbing permits.
Number 2 above is recommended work. The permit can be transferred with the
completion of the work described in items number I and 3.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

RECOMMENDATION:
If desired, approve revocation of Pier Permit RP20007241
BACKGROUND:
Chapter 17.24.090.4 of the Municipal Code specifies that following grounds for
revocation: "The permittee has failed for a period of sixty (60) days to pay the fee or fees
heretofore or hereafter imposed for the occupancy of tidelands, filled tidelands or
submerged lands upon which such work or structure exists."
The Fire and Marine Department has attempted many ways to seek the permittee's
compliance realizing that revocation of a pier permit is a serious step. Staff has written
letters, spoken on the phone to the permittee, received the assistance of the Deputy City
Attorney, and the collection agency used by the City has attempted to collect the fees. All
efforts have failed.
The permittee has failed to pay the annual pier permit fees for the years 1996,1997, 1998.
The 1999 fee due March 9,1999 has not been paid.

Harbor Island Drive, Newport Beach.
Dear Mr. McDonald:
The City of Newport Beach has received a second complaint regarding
the pier and float bayward from 724 Harbor Island Drive.
Sipecifically, the complaints are that a vessel is still berthed in
violation of Section 21.A. of the City Harbor Permit Policies,
which states:
21.A. "boats moored at private or public docks shall not
extend beyond the projection of the property lines of the
property to which the dock facility is connected... ".
A field inspection on November 23, 1994, revealed that a vessel is
berthed in a position that has it extendinq across the property
line at 718 Harbor Island Drive and is in violation of the above
stated code.
Please arrange to have the boat relocated to conform with the
Harbor Permit Policies. Failure to comply with this request will
result in the matter being turned over to the City Attorney for
futher action..

Dear Sir:
The City of Ncwport Beach Marine Department has received a request
to transfer pier permit #0200-0724-1 for the property located at
724 Harbor Island Drive, Newport Beach, CA.
The structure was inspected on August 18, 1988 and in accordance
with Section 10-D of the Harbor Permit Policies, it cannot be
transferred until it meets City requirements. The policy states:
10.D. "At the time of transferg all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements, and the conditions of
the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit."
We cannot transfer the permit until the following deficiencies
have been corrected and we have been notified of the correction:
1. A City -approved anti-sypho-n device is required at the water
connection to the pier and float. See enclosed sheet of
descriptions.
PLEASE --ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED. When we are so notified, the structure will he
inspected again and when the requirements have been metr the pier
permit will be transferred.
