With reference to the plans currently under consideration to reconfigure or modify the dock
system, the following conditions will now be in effect on the above referenced pier.
1. The pier permittee is aware of the Harbor Permit Policies and Chapter 17 of the City of
Newport Beach Municipal Code. The pier permittee understands that the above referenced pier
is under the purview of these Policies and Codes.
2. Any future work on the above mentioned pier requires permits with the City of Newport
Beach and any other applicable agencies. Painting,. replacement of rub rails and work
considered to be cosmetic in nature does not require a permit.
3. The conditions set forth in this document pertain to the current, proposed dock system under
consideration. Any future modifications or alterations to the dock system may require new
conditions which may override or change these conditions. These conditions supersede all past
conditions associated with this property.
4. Only marine oriented uses are allowed on the pier, pier platform, gangway and float. Patio
furniture, plants etc ... are not permitted.
5. Your side property lines extend in the water along their same bearing. Vessels shall not
encroach upon the neighbor's property on either side.
6. A vessel may not extend beyond the end of the fingers by more than the width of its beam.
7. The maximum width of a vessel permitted to tie to the eastern edge of the dock is 9'feet. The
maximum width of a vessel permitted to tie to the westernmost edge of the dock is 17'.

approved tentative tract maps. On the basis of this finding, these plans are approved in
concept and said approval has been written upon said plans, signed and dated.
Should Newport Beach adopt an ordinance deleting, amending or adding to the Zoning
Ordinance or other regulations in any manner that would affect the use of the property or
the design of a project located thereon, this approval in concept shall become null and
void as of the effective date of this said ordinance.
In accordance with the California Environmental Quality Act or 1970, and state and local
guidelines adopted hereunder, this development:

All discretionary approvals legally required of Newport Beach prior to issuance of a

This concept approval in no way excuses the applicant from complying with all
applicable policies, ordinances, codes and regulations of Newport Beach. See attached
conditions to the pier permit.

Reference is made to your request of February 3,2006 (File No. 200600645-SJH). Under the
provisions of Section 10 of the Rivers and Harbors Act of March 3,1899 (33 U.S.C. 403), you are
hereby authorized to replace a floating dock structure, like -for -like, bayward of 754 Harbor Island
Drive in Newport Bay in Newport Beach, Orange County, California, as shown on the enclosed
drawings.
The owner or authorized responsible official must sign and date all copies of this Letter of
Permission (LOP) indicating that he/she agrees to the work as described and will comply with an
conditions. One of the signed copies of this Letter of Permission must be returned to the Corps of
Engineers (a pre -addressed envelope is enclosed). In addition, please use the two attached
postcards to noffy this office as to the dates of commencement (within 10 days prior to the start of
construction) and completion of the activity (within 10 days following the end of construction).
Furthermore, you are hereby advised that the Corps of Engineers has established an
Administrative Appeal Process which is fully described in 33 CFR Part 331. The complete appeal
process is diagrammed in the enclosed Appendix B.

STANDARD CONDITIONS:
1. Notice of Receipt and Acknowledgment. The permit is not valid and development shall not
commence until a copy of the permit, signed by the permittee or authorized agent,
acknowledging receipt of the permit and acceptance of the terms and conditions, is returned to
the Commission office.
2. Expiration. If development has not commenced, the permit will expire two years from the date
this permit is reported to the Commission. Development shall be pursued in a diligent manner
and completed in a reasonable period of time. Application for extension of the permit must be
made prior to the expiration date.
3. Interpretation. Any questions of intent or interpretation of any term or condition will be resolved
by the Executive Director or the Commission.
4. Assignment. The permit may be assigned to any qualified person, provided assignee files with
the Commission an affidavit accepting all terms and conditions of the permit.
5. Terms and Conditions Run with the Land. These terms and conditions shall be perpetual, and
it is the intention of the Commission and the permittee to bind all future owners and possessors
of the subject property to the terms and conditions.
SPECIAL CONDITIONS: See pages four to five.
EXECUTIVE DIRECTOR'S DETERMINATION (continued):
The Executive Director hereby determines that the proposed development is a category of.
development, which, pursuant to PRC Section 30624, qualifies for approval by the Executive Director
through the issuance of an Administrative Permit. Subject to Standard and Special Conditions as
attached, said development is in conformity with the provisions of Chapter 3 of the Coastal Act of 1976
and will not have any significant impacts on the environment within the meaning of the California
Environmental Quality Act. If located between the nearest public road and the sea, this development is
in conformity with the public access and public recreation policies of Chapter 3.
FINDINGS FOR EXECUTIVE DIRECTOR'S DETERMINATION:
A. Proiect Description
The project site is loc ated at 754 Harbor Island Drive in the City of Newport Beach (Exhibits #1 -2).
Single-family residences characterize the subject site and the surrounding area. The proposed project
involves the removal and replacement of an existing "U" shaped boat dock in the same configuration
with two 4' x 40' fingers, a 4' x 8' gangway lobe, a 4' x 24' backwalk and a 3' x 24' gangway with no
new piles (Exhibit #3). The existing piles will be re -used in the same location. Douglas fir and Trex
decking materials will be used.
4PThe dock project will be used for boating related purposes to serve a single-family residential
development. The site has been surveyed by the City of Newport Beach Harbor Resources Division for
eelgrass and no eelgrass was discovered within 15 feet of the project area. Since existing piles will be
used and no new piles are proposed there is no potential for direct adverse impacts to eelgrass beds,
nor is there potential for disturbance to Caulerpa taxifolia. Thus, the usu al pre- and post- project
surveys for eelgrass and caulerpa are not required by the Commission in this case.
Coastal public access is available approximately one-quarter mile southeast of the project site at the
Balboa Yacht Basin. The proposed project has received an approval in concept from the City of
Newport Beach Harbor Resources Division. The Regional Water Quality Control Board (RWQCB) has

determined that the proposed project will not adversely impact water quality if staridar&coristructi6h ''.. I
methods and materials are used. The applicant has applied for a permit from the U.S.,,Army Corps of
Engineers.'
Section 30600(c) of the Coastal Act provides forthe issua nco of coastal development permits directly
by the Commission in regions where the local government having jurisdiction does not have a certified
Local Coastal Program. The City of Newport Beach only has a certified Land Use Plan and has not
exercised the options provided in 30600(b) or 30600.5 to issue its own permits. Therefore, the Coastal
Commission is the permit issuing entity and the standard of review is Chapter 3 of the Coastal Act. The
certified Land Use Plan may be used for guidance.
B. Marine Resources
The proposed recreational boat dock development and its associated structures do not result in
the fill of coastal waters and are an allowable and encouraged marine.related use. The proposed
dock work will not have any significant adverse effect on sensitive marine resources, such as '
eelgrass. Therefore, the Commission finds that the proposed development, which is to be used
solely for recreational boating purposes, conforms with Section 30224 of the Coastal Act.
C. Water Quality
The proposed work will be occurring on, within, or adjacent to coastal waters. The storage or
placement of construction material, debris, or waste in a location where it could be discharged into
coastal waters would result in an adverse effect on the marine environment. To reduce the potential for
construction related impacts on water quality, the Commission impos I es special conditionsrequiring"..
but not limited to, the appropriate storage and handling of construction equipment and materials to
minimize the potential of:pollutants to enter coastal waters To reduce the potential for
post -construction impacts to water quality the Commission requires the continued use and
maintenance of post construction BMPs. As conditioned, the Commi5sion'finds that the development
conforms to Sections 30230 and 30231 of the Coastal Act.
D. Local Coastal Prociram
The LUP for the City of Newport Beach was effectively certified on May 19, 1982. The certified LUP
was comprehensively updated on October 13, 2005. As conditioned, the proposed development is
consistent with Chapter 3 of the Coastal Act and with the certified Land Use Plan for the area.
Approval of the project, as conditioned, will not prejudice the ability of the local government to prepare
a Local Coastal Program that is in conformity with the provisions of Chapter 3.
E. California Environmental Qualitv Act (CEQA)
As conditioned, there are no feasible alternatives or additional feasible mitigation measures available
that would substantially lessen any significant adverse effect that the activity may have on the
environment. Therefore, the Commission finds that the proposed project, as conditioned to mitigate the
identified impacts, is the least environmentally damaging feasible alternative and can be found
consistent with the requirements of the Coastal Act to conform to CEQA.

SPECIAL CONDITIONS:
1. Water Quality
A. Construction Responsibilities and Debris Removal
(1) No construction materials, equipment, debris, or waste will be placed or stored
where it may be subject to wave, wind, or rain erosion and dispersion.
(2) Any and all construction material will be removed from the site within 10 days of
completion of construction.
(3) Machinery or construction materials not essential for project improvements will not
be allowed at any time in the intertidal zone.
(4) If turbid conditions are generated during construction a silt curtain will be utilized to
control turbidity.
(5) Floating booms will be used to contain debris discharged into coastal waters and
any debris discharged will be removed as soon as possible but no later than the
end of each day.
(6) Non -buoyant debris discharged into coastal waters will be recovered by divers as
soon as possible after loss.
B. Best Management Practices Program
By acceptance of this permit the applicant agrees that the long-term water -borne berthing of
boat(s) in the approved dock and/or boat slip will be managed in a manner that protects water
quality pursuant to the implementation of the following BMPs.
(1) Boat Cleaning and Maintenance Measures:
a. In -water top -side and bottom -side boat cleaning shall minimize'the discharge of
soaps, paints, and debris.
b. In -the -water hull scraping or any process that occurs underwater that results in
the removal of paint from boat hulls shall be prohibited. Only detergents and
cleaning components that are designated by the manufacturer as phosphate -
free and biodegradable shall be used, and the amounts used minimized.
c. The applicant shall minimize the use of detergents and boat cleaning and
maintenance products containing ammonia, sodium hypochlorite, chlorinated
solvents, petroleum distillates or lye.
(2) Solid and Liquid Waste Management Measures:
a. All trash, recyclables, and hazardous wastes or potential water contaminants,
including old gasoline or gasoline with water, absorbent materials, oily rags,
lead acid batteries, anti -freeze, waste diesel, kerosene and mineral spirits will
be disposed of in a proper manner and will not at any time be disposed of in the
water or gutter.

(3) Petroleum Control Management Measures:
a. Oil absorbent materials shall be examined at least once a year and replaced as
necessary. The applicant will recycle the�materials, if possible, or dispose of
them in accordance with hazardous waste disposal regulations. The boaters
will regularly inspect and maintain engines, seals, gaskets, lines and hoses in
order to prevent oil and fuel spills. Boaters will use preventive engine
maintenance, oil absorbents, bilge pump -out services, or steam cleaning
services as much as possible to clean oily bilge areas. Bilges shall be cleaned
and maintained. Detergents will not be used for cleaning. The use of soaps
that can be discharged by bilge pumps is prohibited.

The City of Newport Beach Fire and Marine Department has received a request to

I . A City -approved anti -syphon device is required at the water connection for the water
to the pier and float. A sketch showing the approved type of device and its installation

Administrative Code. The State of California Department of Health no longer accepts
the device that is currently on the water line.
2. All electrical receptacles on the pier and float must be either GFI or Twist Lock for

needs to be a GFI and have a cover.
The Newport Beach City Council Harbor Permit Policies require that at the time of
transfer, all harbor structures shall be inspected for compliance with the City's minimum
standards, and the conditions of the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit.
Please advise this department when the above deficiencies have been corrected. Call 644-

Thank you for establishing through your own measurements
that the vessel Heavenly Ours, located at 754 Harbor Island Drive,
protrudes 19.3 feet beyond the pierhead line even when the vessel is
secured outside of its slip with the bow against the bulkhead. Your
measurement of the vessel's beam as 17 feet shows it to be in clear
violation of the city pier permit policy which limits the protrusion
to the beam of the vessel.
In addition, the vessel cannot be boarded in this location.
The swimstep is about 13 feet from the end of the slip and the
boarding ladder is on the side away from the slip and there are no
boarding steps on the dock. This would seem to be more than
adequate evidence that to use the vessel it must placed in even
greater violation by turning it "bow out" or placing it in the slip.
Either action would increase the violation by another 5 to 10 feet.
In previous conversation with the owner Mr. Harold Goolsbee,
he indicated to me that he believed he was in conformance with the
city policy and that if the city found him out of conformance, he
would do whatever was necessary to bring himself into conformance.
Because of his cooperative attitude I don't believe you will have to
resort to asking the City Attorney to file for revocation of the
pier permit of Mr. Goolsbee. I will send Mr. Goolsbee a copy of
this letter and ask him to advise the board of directors of the
Promontory Bay Homeowners Association of his planned action and
schedule of implementation. I will keep you appraised of this
violation until it is corrected.

Dear Mr. Goolsbee,
In an effort to insure clear communication with you, I am taking this
opportunity to confirm your telephone call to me last evening, which you said
was in response to a letter from the City Attorney of Newport Beach, asking
you to "work things out with the Promontory Bay Homeowners Association".
Your repeated request of "What does the Association Board of Directors
want me to do?" drew the repeated response from me of "The Board of Directors
wants you to bring your dock usage into conformance with the Harbor Permit
Policy of the City of Newport Beach. Specifically with respect to that
portion which limits the amount a vessel may protrude beyond its slip to not
more than the beam of the boat."
This is the second boat that you have had since you moved into
Promontory Bay and that both of these boats, by your own admission, "stuck out
the same amount". Your previous boat, "IT WILL DO" was often backed inside
your slip, placing all of the protrusion into the waterway and none over your
own property. This excessive protrusion into the narrow waterway resulted in
a very near miss when my own boat came within inches of having the railings
on the upper deck damaged by your protruding bow plank. On a recent Sunday,
in total disregard for the safety of passing boats, you backed the "HEAVENLY
OURS" inside you slip, leaving approximately 1/2 the length of your 61 foot
boat protruding out into the narrow waterway. Because of this gross
restriction of the channel, Mr. John Tahl, of 645 Bayside Drive, found he
could not safely proceed toward his slip with normal opposing traffic and had
to stop his 48 foot ketch. It was fortunate there was no significant wind or
tide, which could have set his boat on the rocks I with a very high risk of
considerable damage.
This seems to indicate that you do not take the Harbor Permit Policy
very seriously. Your continued practice of purchasing boats which exceed your
allowable dock space degrades your verbalized desire to cooperate. It is
because of this that the Board of Directors has asked the City of Newport
Beach to obtain your conformance.
The options which you said were available to you which could solve the
problem, which you said you also expressed to the Sheriff's Department, such
as hinging your swim step, side tying across the end of your slip or moving
the boat to another location, sound very nice. Unfortunately you have not
implemented any of them, in these many months.

Your concern that the Board of Directors had singled you out and not
proceeded against other violators in the bay, was responded to by my statement
that we are in the litigation process with another homeowner, and the economic
constraints of our limited budget restrict our ability to litigate to.one at a
time. If you have evidence of any boat in Promontory Bay, which is in
violation of any of the Harbor Permit Polocies you may report your evidence
to the City of Newport Beach, for enforcement, the same as the Board of
Directors do. With the same sense of responsibility, the Board of Directors
of the Promontory Bay Homeowners Association, stand ready and willing to act
on any solid evidence you submit of any violations of the Aticles and By Laws
of the Association.
Once again, Mr. Goolsbee, the request of the Board of Directors of the
Promontory Bay Homeowners Association is that you bring the usage of your dock
into-co.nformance with the Harbor Permit Policy of the City of Newport Beach,
or that the City,of Newport Beach make the policy meaningful, by enforcing it.

Dear Mr. Melum:
On the 19th of February of this year, I wrote you a letter requesting your
assistance in removing a vessel named Heavenly Ours, which was impinging on a critical
portion of the waterway of Promontory Bay. I advised you verbally that Coast Guard
records showed this vessel to have a width of 16.1 feet and an overall length, excluding
bow pulpit and swim step, of 60.9 feet. When this vessel is in its slip, approximately
1/3 of the vessel is protruding beyond the slip, into the narrowest portion of our
waterway.
It is clearly evident that the owner of this vessel, Mr. Harold Golsbee, was not
persuaded by your office or the City Attorney, that he is compelled to comply with the
Newport Beach Harbor Permit Policy, section 21-A, which states "Any boat moored at a pier,
dock, or float shall not extend bayward a distance of more than the width of its beam
beyond the pier, dock or float." Perhaps the owner knows that the City of Newport Beach
has never withdrawn a pier permit once construction has been completed and that he -is in
no danger of being penalized for flaunting his clear-cut violation of the Pier Permit
Policy of Newport Beach.
This seems to be an outstanding example of the often heard complaint that rules
are made for the law abiding. Perhaps the problem is that the only penalty available to
the city may not fit the crime and as such may be difficult to convince a court to
enforce.
There seems to be a clear responsible action which could resolve this unjust
situation. That is to incorporate the Harbor Permit Policies into a City Ordinance with
fines scheduled to encourage cooperation and retaining the authority to remove the pier
permit when cooperation is unattainable. This would be a clear message to discourage the
scofflaw and renew the faith of the law abiding.
The Board of Directors of the Promontory Bay Homeowners Association, has voted to
support the adoption of such an ordinance and hereby requests that you make a formal
request to the City Council of Newport Beach for the adoption of such an ordinance.

Westphall:indicatling that the d irectors of the Promontory Howeowner's Association
felt that�the situation was,creating a, hazard to navigation in-the,bay, I again
wrote Mr. Goolsbibe. .Additionally I have received a letter from a resident of
Promontory Bay who expresses h.is'feelings regarding the offending vessel. (See
letters attached),. I contacted the Sheriff's Harbor Patrol and asked them to
inspect the vessel to seeif it represented a violation of the Harbors and
Navigations Code,
In the meantime, Mr. Goolsbee had relocated the vessel at his property, and it
now extended beyond the float approximately 21 feet.
The Harbor Department felt that the vessel as now moored, while still in violation
of the Harbor Permit Policies, was not a hazard to navigation as defined by
Section 13 of the Harbors and Navigation Code.
I contacted Mr. Westphal of the Homeowner's Association and indicated the status of
the situation to him. He felt that while it might not technically be a violation
of the Harbors and Navigation Code, it was still a hazard and a violation of the
City's Harbor Permit Policies. The vessel owner obviously does not want to relocate
the boat, and feels that though it is in technical violation, it is not creating a
problem, and argues that other'techniicAl violations occur in-Promontory-�Bay Without
the City taking action.
The Marine Department feels that -An light of complaints received, and because of
the vessel's location at one of the narrowest points in Promontory Bay, something
must be done. My two letters to Mr. Goolsbee have not been able to bring about a
solution. Perhaps a letter from your office can cause.compliance from the offending
property owner.

The Newport Beach Marine Department has received a complaint
rega-Vding the use of your residential float at 754 Harbor Island
Drive. Specifically, the ccmplaint is that a vessel is being
moored at that location in violation of Section 21.B of the
Harbor Permit Policigs, which states:
1121.B. Any boat moored at a pier, dock, or float shall
not extend bayward a distance of more than the width of
its beam beyond the pier, dock or float.�"
The Maxine Department is requesting that you do whatever is
required to bring the moored vessel into compliance with the
above quoted policies.

The board of directors of the Promontory Bay Homeowners
Association, would appreciate your assistance in removing a
navigational hazard impinging on a critical portion of the
navigable waterway in Promontory Bay.
The object of our complaint is a vessel named "Heavenly
Ours", located at 754 Harbor Island Drive and is under the control
of Mr. Harold Goolsbee, of that same address. This location is at
the narrowest portion of Promontory Bay, and restricts the fairway
to such an extreme extent that medium sized vessels meeting in
that area are in danger of collision. We believe this is a
serious and unacceptable hazard in a dedicated waterway.

Since my letter to you on February 4, 1982 1 have received
additional complaints regarding the vessel at your docL
Two of these complaints have been in writing; one, I assume,
is from a resident of Promontory Bay, and the other from a
Director of the Promontory Bay Association, stating the.
Association's concern with this matter.
As I pointed out in my previous letter to you, the Vessel
is in Violation of Section 21.B of the Harbor Permit Policies
and measurements at your dock confirmed this, even in its
present side -tied location.
In addition to this, the Sheriff's Harbor Patrol feels that
the vessel is a hazard to navigation and the boat will be
cited if it is not relocated.
What this all boils down to is that the vessel must be
relocated as soon as possible.
Please contact me and let me know your plans in this regard,
so I can forestall further action. My telephone number is
