It has been brought to my attention through an anonymous complaint that there may be an illegal
live aboard on a vessel which is berthed at your residential pier at 507 Morning Star Ln.
Please be advised that live aboards are not permitted at a residentially zoned pier such as yours.
The Harbor Permit Policies, Section: General Provisions For Permits For Harbor Structures — K,
state:
"In those areas of the Harbor where the piers and floats are bayward of residential zoned
areas, live aboards shall not be permitted."
I have asked the Orange County Sheriff s Department, Harbor Patrol, to assist us in monitoring
this vessel. Current rules allow for people to stay aboard their vessel 3 nights out of every 30
days.
Please take the necessary measures to cease live aboard activity at your residential dock within
seven (7) calendar days from the date of this letter. If you fail to take corrective action to bring
your dock into compliance by October 4, 2006, an Administrative Citation may be issued to you,
the pier permittee, and penalties will begin to accrue ($100, $200, $500 daily increments). Your
cooperation will be greatly appreciated in this matter.
If you have any questions regarding the enforcement of the Harbor Permit Policies, please feel

The City of Newport Beach Marine Environmental Management Division has inspected
the pier and float for the above-mentioned property and has found that it meets the City
standards. It is recommended that the Backflow Prevention Device be checked since it is
leaking.
The pier permit will be transferred once we receive the Transfer Application Card signed
by both the Seller and Buyer, and $178 for the balance of the Transfer Fee.

the above Harbor Permit. The facility was inspected by a representative of the
Newport Beach Marine Division on January 2,1997.
We cannot transfer the pier permit until the following has/ have been corrected
and WE HAVE BEEN NOTIFIED OF THE CORRECTION:
t All electrical receptables on the pier and dock must be GFI or twist locked.
The Newport Beach City Council Harbor Permit Policies state:
10.D. "At the time of transfer, all harbor structures shall be inspected for
compliance with the City's minimum plumbing, electrical and structural
requirements, and the conditions of the existing permit. All structural
deficiencies must be corrected prior to transfer of the permit."

The structure was inspected on 7/22/87 at which time it was determined
that the following deficiencies exist:
1. A City -approved anti -syphon devi'ce is required at the water

Dear Mr. Melum:
Enclosed is our check #135518 in the amount of $113.75. Said monies
represent payment of the annual pier permit fees for March 1, 1986
and March 1, 1987, including penalties, for the above subject permit.
I verified the amount owing with Dorothy of your department this morning.
When I first contacted you regarding the fact we acquired the property
by foreclosure on October 22, 1986 and asked to have the 1986 permit
fee prorated from acquisition to the renewal date, you stated that
the City of Newport Beach treated these fees in the same manner as
the County treated property taxes. This being that when one acquires
property and the property taxes are delinquent at the time of acquisition,
the new owner is liable for the delinquent taxes. We request that
you confirm this position taken by the City of Newport Beach in writing,
for our records.
During the same conversation you also said you would waive the usual
permit transfer fee of $230.00 required to change your records to
reflect Bank of America as owner, if we requested same. Therefore,
we request that the transfer fee be waived since Bank of America acquired
the subject property by foreclosure.

A check of -the City's Harbor Permit files has revealed that the
permit for the pier and float at 507 Morning Star Lane, Newport --
Beach is registered to Harry R. Armer,
A transfer application must be completed and a transfer fee
paid each time the permit has changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a permit and reads as follows,
"No person shall transfer a permit for a pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City".
Failure to pay the transfer fees cart be grounds for revocation of
the Harbor Permit in accordance with Chapter, 17.24.090 of the
Municipal Code.
Your cooperatiori in bringing this permit up to date will avoid
any action by the City.
