Mark Sites (Applicant/Applicant's agent), hereby certify that I have
read the U.S. Army Corps of Engineers permit, RGP#54 and the California Coastal
Commission permit #5-99-282 for maintenance dredging in Newport Harbor and that I
will comply with all of the conditions of those permits. I will further hold the City
harmless from and indemnify them against any claim for damages arising out of the
exercise of these permits. In addition, I, as the applicant shall reimburse the City of
Newport Beach for all attorney's fees and other costs expended by them in defending
any claim, lawsuit, or judgment arising out of the activities of the applicant carried on
under the authority of such permit.

Project description:
The proposed dredging project entails removing approximately 250 cubic yards of a sand
/ silt mixture from the west (back) side of the UCI crew's 120' long floating dock. This
would prevent further damage to the dock and coaching launches by providing adequate
depth to avoid grounding at low tide. The majority of the material has come from an
adjacent embankment which, through natural erosion, has sloughed off in sufficient
quantity to fill the berthing areas. The loss of embankment material also threatens to
undercut an existing concrete head walk and staging area, and to undermine the wooden
pilings of the existing pier.
It is proposed that the dredged material be used to rebuild the embankment from which it
came. The material would be pulled from underneath and behind the dock using a
mechanical excavator (backhoe), and placed and compacted in order to rebuild the eroded
bank. This work would be accomplished at low tide, and would take from one to two
days to accomplish. Any excess dredged material not used to reinforce the embankment
can be placed in the adjacent parking lot to dry and be used for fill elsewhere.
Alternately, any excess material in the dredging site can be removed with a hydraulic
suction dredge and pumped to any suitable site up to 300' away.
This work will be performed under a dredging permit issued by the City of Newport
Beach, through U. S. Army Corps of Engineers RGP #54.

It was originally believed that any leftover fill would be useful to the
Department of Fish and Game somewhere on Shellmaker Island, They have
since declined, Therefore, it is now proposed to put all dredged fill on the
adjacent embankment using only an excavator to precisely place and
compact the material. The maximum distance from dredge to fill site is 50'.
A hydraulic suction dredge will not be required for this project.

To whom it may concern:
The California Department of Fish and Game (Department) has reviewed the dredging application
submitted to the City of Newport Beach by the University of California, Irvine on February 22, 2002.
The proposed project will occur on the southeastern portion of Shellmaker Island located within the
Upper Newport Bay Ecological Reserve, managed by the Department of Fish and Game. Approximately
250 cubic yards of material will be removed and placed on the adjacent embankment. The material will
be compacted to stabilize the bank, and promote natural vegetation growth. The Department met with
University staff on site to review the proposed project on December 2, 2002. After careful review and
discussions with the project applicant, the Department grants permission to allow the dredging to occur
during the months of December 2002 to March 2003 with contingency placed on the following
requirements:
• Dredging will not occur outside of the footprint of the existing dock.
• Excess spoils will be permitted to dry in the agreed upon site adjacent to the UCI rowing
complex, with the requirement that all materials must be removed within one month of the
conclusion of operations.
• Dredgespoils placed on the embankment will be monitored for destabilization, and maintained to
avoid slope failure.
• All efforts will be made to avoid disturbance to wildlife and native plants, and the operator will
notify the Department of any potential impacts occurring as a result of this project.
• The Department reserves the right to cease operations if negative impacts to sensitive and
endangered species are observed.

This is to report on the meeting of Monday, December 2, at noon with Brian Shelton. Present
were Brian, representing DFG; Mark Sites, our agent representing the drilling contractor; Paul
Hope, Senior Administrator at the Department of Athletics at UCI; and myself, representing the
UCI crew.
Our first agenda item was to review the dredging application with respect to start date. We
settled on a window between December 26 and March 1, with preferred dates of December 30,
31 and January 2. From the crew=s perspective the December start date is critically important
due to winter break and the fact that athletes will not be not using the dock during that time.
We agreed to the larger window in case of difficulties with permitting and/or other factors over
which we have no control. Brian was in agreement with this decision.
Next we took up the question of disposition of the dredged material, which in our application we
propose to use in rebuilding the eroded bank. Brian was favorably disposed to our proposal and
agreed that compacting the material against the bank in the area adjacent to the dock would not
adversely impact any environmentally sensitive flora or fauna.
Finally we covered the question of ingress and egress of equipment. Because the excavating
machine will stage from the lawn area in front of the boathouse, and because it will be trucked in
to and offloaded on the hardpan immediately south of the boathouse, it can move to its
operational positions on the bank and slope without damage to sensitive areas.
To conclude our meeting, I reviewed these points with all assembled, and found all parties in
agreement. As the meeting broke up, Brian said he would call you Monday afternoon,
December 2, and I promised to get this memo of understanding on its way to you as soon as
possible.

Coastal Commission. However, because these agencies are unable to approve the application

Tony,
No, we do not have everything we need to review your request. Please submit
the following:
1. A better site map - it is unclear to me whether this site is within
the area covered by the approved dredging permit. Based on the maps we
have, it looks like the site is outside the approved area. Furthermore, it
doesn't appear as though this project is in front of a bulkhead. The permit
only authorized dredging and beach nourishment in areas in front of
bulkheads. Please clarify...
If the project is not within the boundary of the approved permit, UCI will
need to submit a separate application for the work they want to do. The
information that is required by the special conditions of CDP 5-99-282
provide a good check list of the types of information that should be
submitted with their application.
If the project is within the boundary of the approved permit, the following
needs to be submitted: Q
2. An eelgrass survey
0. Identify the fee title land owner - the information submitted so far
suggests that CDFG owns the land. However, CDFG's letter says they 'manage'
the land. Does 'manage' mean own? Or, does some other entity actually own
�tk}e land and then lease the land to CDFG?
Submit evidence of landowner authorization for the work to occur
Special Condition 10 of CDP 5-99-282). If CDFG doesn't own the land, then
e owner needs to give their approval for the work to occur.
5 Submit State Lands Commission approvals (Special Condition 9 of CDP
99-282) - if the site isn't within the City's tidelands grant then you
must submit evidence of approval from State Lands or evidence that no
approval from them is needed.
6. Submit Risk Disclaimer, if required by permit (Special Condition 14
of CDP 5-99-282). If the project is occuring on land that is not owned in �y dl -
fee title by the City of Newport Beach or the County of Orange and that is !! `f�7
not granted to the City or County pursuant to a State Tidelands Grant then
a risk disclaimer must be submitted from the fee title land owner.

Dredging Permit. The property owner is the Department of Fish and Game. They have
reviewed the project and the Reserve Manager for Shellmaker Island, Brian Sheldon, of

OUTLINE OF SAMPLE COLLECTION AND ANALYSIS
COLLECTION
Samples collected by a hand coring device driven into a representative area of the dredge
site and receiving beach. Stored in plastic containers and immediately delivered to the lab.
SAMPLE PREPARATION
Entire sample transferred into 1 liter glass containers, deionized water added, and
mixed to desalt and disperse the sediment. The sediment is allowed to completely
settle and the clear water is removed by siphoning. The sample is placed in a drying
oven at 50°C and occasionally stirred until the entire sample is completely dry. The dry
sample is transferred to a desiccator for cooling. The sample is disaggregated and a
Riffle sediment splitter is used to evenly split the sample to reduce the quantity of
material to be analyzed to an allowable retention weight for the sieves.
SAMPLE ANALYSIS
The dry split fraction is processed through a # 10 U.S. standard sieve to remove the
gravelishell fraction of the sample. The material retained on the sieve is weighed and
value recorded. The material passing through the # 10 sieve is wet sieved through a
#230 sieve to remove the silt/clay fraction. The material retained on the sieve is
transferred back into the glass container and placed back into the drying oven at 50°C.
The remaining sample is allowed to completely dry and the material is weighed and
recorded to yield the sand fraction. The silt/clay fraction is calculated by subtracting
the gravel/shell and sand fractions from the total analysis weight.

I did read in the ACOS letter that there were prohibitions of project
start dates until after Sept 30, so I understand this is the time to get

I am not so concerned about the Belding's savannah sparrow (since it can
flit about for 1-2 days, and nesting is over), but I am about the salt
marsh bird's beak.
To resolve this quickly, if there has been no vegetation or biological
information produced, UCI can flag the area to be dredged, and Brian can /
see if any vegetation (and what type)is within that footprint. /--

The fall quarter at UCI has now begun, and with it the
rowing program is back in full swing. With each day that
passes it becomes more urgent that we move forward with
the dredging so our docks do not fail through wracking on
the unevent bottom at low tides. As I've written before,
and as I'm sure you can appreciate, there is a real safety
issue here concerning break-up of the docks during launching.
In reviewing prior correspondence, copies enclosed, it's
not clear to me if you have had an opportunity to review
the dredging application, thus I'm enclosing a copy with
this letter. The application is dated February 22 and was
prepared by Mark Sites, a dredging contractor who is also
a UCI graduate and while a student at UCI a member of the
varsity crew. Mark is familiar with crew requirements as
well as all aspects of the permitting process, which makes
him an ideal resource for this project.
(Not reflected in this correspondence is the fact that Mark
and I met with Brian Shelton and John Scholl prior to
preparing and submitting the dredging application to make
sure Brian and John, as representatives of DFG, felt
comfortable with the dredging project as outlined by Mark.)
The dredging application was submitted to Tony Melum, Director,
Harbor Resources in Newport Beach on June 17 (copy of letter
of conveyance enclosed). The delay in submitting the
dredging application was occasioned by the necessity for
a Caulerpa survey, which was satisfactorily completed.
Therefore, at least as I understand it, all that was
required for Mr. Melum to approve the dredging application
was an okay from DFG, which I requested in my letter of
June 17 to Brian Shelton, copy enclosed.

Between June 17 and July 10 Brian and Mr. Melum exchanged
phone calls without successfully making contact. I wrote
to Brian on July 10 (copy enclosed) thanking him for his
attempts to reach Mr. Melum, and followed up on August 13.
with another letter.(copy enclosed) stressing again the
urgency of a timely approval and offering to help in any
way I. could in facilitating approval of the dredging
application.
On Thursday morning, August 22, Brian called to let me know
he had forwarded the request for DFG approval of the dredging
application to you, and I wrote to him the following day
(copy of letter of August 23 enclosed) thanking him for
this courtesy.
Two weeks later, September 11 (copy of letter enclosed),,
I wrote to you asking for an update on the approval and
in particular asking that if there were anything I could
do to be helpful, I would welcome the opportunity.
If there is any aspect of the application process.that we
have failed to meet or address, I would be most appreciative
of your so advising me. I'm sure you know that a.good
personal and professional relationship with you, Brian
and John is, from my point of view, absolutely essential
for the healthy development of the UCI crew program. I rely

Dear Terri:
Looking through the tide charts the other day, I became aware of
the fact that over the next several months we are going to have
some extreme tides here in the Newport area, a situation which
absent the removal of material under our docks puts the structure
in jeopardy. Therefore, I wanted to take a moment to write and
ask if there is anything I can do to help facilitate your
approval of the dredging application which Brian Shelton
sent to you in mid-August.
The problem is, after a few years of siltation, when we get a
really good low tide, the dock rests on the (uneven) residual
material, with the result that the flotation material falls
from beneath the dock and is taken away by the incoming tide.
Thus the dock not only wracks on the hills and valleys of
siltation beneath it, but it is unevenly supported by floats
when the tide comes.back in.
A couple of years ago we were launching an eight after one,of
these episodes, and the dock separated into two parts as the
men were wrestling the shell down to the water. It was a nasty
moment, and I want to make sure we do everything we can so that
it won't be repeated.
First, when Greg Springer, an alumnus of the rowing program who
is also a skilled construction worker, put the dock back
together for us, he warned that another such incident would
very possibly be the undoing of the dock itself, the.proverbial
straw that broke the camel's back. And second:
When you think that we built the dock over the summer of.1965
and launched it that fall, it's remarkable how it has held
together. We have always taken good care .of it; but
everything has a finite life, and I sometimes feel like the
dock is.approaching the end of its allotted span.

I am writing to convey an application for a dredging permit prepared by our mutual friend Mark Sites of
Intercoastal Dredging. Mark is a graduate of UCI and was an oarsman during his college years, therefore he is
well acquainted with the site and has personal knowledge of what is required to keep it operational.
The launching area for rowing shells at Shellmaker Island was last dredged seven or eight years ago by Plazi
Miller at Shellmaker, Inc. As with earlier dredgings, the material was pumped onto barges which were then
towed out to sea, where the material was deposited.
This removal of material has had adverse consequences in that over time the sloping bank, which is not
bulkheaded, sloughs off into the area most recently dredged. This has resulted in the gradual subsidence of our
site, particularly the lawn area southeast of the boathouse and the concrete walkway leading from the
boathouse to the ramp. (This walkway is now severely fractured.)
The application that is being submitted with this letter seeks to stabilize the banks using a land-based device to
bring the dislodged material back onshore and pack it on or against the bank. The procedure is more fully
described in the description that accompanies the application.
The purpose of this letter is to ask that you call or write if I can be of any help in expediting the processing of the
application. Under normal circumstances we would have asked for a dredging permit last year, but with the
additional delay find that the situation is now critical. At low tide there is insufficient water to float our coaching
launches which means our crews cannot practice.
Also there is a safety risk, because flotation material drops out from underneath the dock when it wracks on the
mud. Last time this happened the dock broke up under the weight of the crew and we had to shut down
operations so our student -athletes would not be at risk: we became aware of the problem during an early
morning launch when the dock split into two parts virtually under the feet of the oarsmen who were attempting to
put their boat in the water.

The University of California, Irvine is seeking a permit to dredge the area underneath the floating dock at our crew base
located on Shellmaker Island. We have obtained the application form from tht; City of Newpori Beach and they have
indicated their willingness to issue the permit provided we have approval from the Department of Fish and Game on the plan.
Our men's crew coach, Duvall Hecht has been working closely with Mr. Troy Kelly on this project and he has referred us to
you for authorization.
As you may know, UCI has been operating its varsity crew program from Shellmaker Island since 1965 through a license
agreement with the Department of Fish and Game. Over the years, mud has gradually silted in under the dock and is now
creating havoc during low tide. As the dock settles on the uneven mud below, it twists and turns which places a great deal of
strain on the 28 year old structure. If this is allowed to continue, the dock will be destroyed and the channel itself may
become impassable for the crew boats and the launch.
Our plan is to remove a sufficient amount of material from under the dock so it floats clearly during low tide and our boats
can obtain access to the Back Bay. We will have the dredging company transport the excavated material and dispose of it off
site in accordance with State and Federal laws governing such matters.

Attached please find documentation relating to our discussion on Monday,
June 7, regarding my request for DFG approval of the accompanying dredging permit.
The history of the facility may be of interest to you and your associates. It
dates to the fall of 1965 when UCI opened. Crew was one of the "founding sports",
and the boathouse and dock were built during the summer preceding the school's
opening.
The site was very different then. The area east of the boathouse more or less
slumped into the inlet where the dock is now situated. John Lusk took on the
project of helping us prepare the site; he brought in a crane with a clamshell
scoop that shaped the area where the dock now rides, and with the aid of the
scoop dug it out sufficiently so that it floated clear even at low tide.
That was 28 years ago, and it is remarkable to think that the same dock is still
in place. Only now at low tide it doesn't float, rather it wracks itself on
the mud that is gradually silted in. A new dock couldn't stand much of this,
and this old one is going to go to pieces on us if it continues.
Dredging beneath the dock will help solve another problem at Shellmaker, namely
the low level of the parking lot. We plan to use the dredged material as fill
so that high tides do not flood the parking area.

your associates in departmental headquarters do so, I would be very much in
